2. Now we are seeing individuals, organisations and governments which have no power to censor also indulging in censoring unfavourable reports about them.
3. This they do by threatening to sue or suing the whistle blowers. The threat is intended to deter not only the particular individual but others also from uttering or reporting the same allegation. If the threat fails, then the matter is made a subject of libel action. Whether it becomes sub-judice or not the person is deterred from repeating the statements as it may prejudice the courts.
5. And if the court case can be prolonged, the censorship, or denial of the freedom of speech of the respondent will be effective in hiding the truth of the matter.
6. I am not a lawyer of course but I think the law is being abused to hide acts which may be criminal. Or it may be in order to prevent the public from getting the right information to make political decision.

1. You said no need to address Tun Dr. Mahathir, just Mr Mahathir. Dr is a universal recognition given to a Medical doctor. So you don’t recognize Tun as a medical doctor whereas Tun introduces himself as Dr Mahathir at the beginning of this blog. The much valued title ‘Tun’ conferred by the king is dismissed by you. Who are you to take away a highly recognized title as ‘Tun’ from Tun Dr Mahathir?. It only clearly shows that you and Tua Cheng are either ignorant, disrespectful of Tun, try to belittle and insult Tun or your lack of manners and of poor character and upbringing.
2. You cited Lee Kuan Yew as not using the title conferred upon him. I don’t idolise Lee Kuan Yew as both of you do even though they called me Lee Kuan Yew in my school days and when I visited Raffles College in Singapore as a Secolian of University Malaya student in1971 due to my similarity and leadership quality. they said I was legendary. Any way Lee Kuan Yew does not value the title given to him because may be he thinks he is better than the Sultan or the Queen or he may have his own reasons. By and large, people value such titles.

It in not necessary to address a person with the prefix “Tun” or “Dr” because these are just honorifics. For example, Lee Kuan Yew is a Dato and a Sir. Mahathir never called him Dato Sir Lee Kuan Yew. Mahathir just called him, “Lee Kuan Yew”. CCTV always address the Chinese leaders without “Mr” or any other honorific. I am sure there news presenter have not been shot or called a traitor. This because they still appear on CCTV.
Why is a person a traitor just because he criticize the country? A person who criticizes is a person who cares. Like Mahathir, he too criticizes the country. This is not because he is a traitor but because he cares.

To DrMNumber1Admirer. You should not be be angry with Lee Kuan Yew. After all, he is just a senile old man. Although a Malaysian, I work in Singapore. Not many Singaporean bothers to listen to him. For your sanity you should do the same. In the past, Lee Kuan Yew has a very good brains. Each time he has a debate with Dr Mahathir, he beats Mahathir to a pulp. As a Malaysian, I feel embarass. Now that he is not so sharp, it will be good time if your hero can have a debate with Lee Kuan Yew and redeem himself. Perhaps, the topic of the debate can be “Is there more censorship in Malaysia or in Singapore during the period when both Mahathir and Lee Kuan are premiers of their respective countries”. We can invite the Brunei Sultan, and the Presidents of Indonesia and Philippines to be judges of the debate. We can call this debate the “ASEAN mother of all debates”.

THE founding leader of the People’s Action Party (PAP) who led it for 38 years as secretary-general has predicted its loss of power in government.
Mr Lee Kuan Yew said in a new book to be launched today that the day would come when voters ‘get tired of a stable government and say let’s try the opposition’.
‘There will come a time when eventually the public will say, look, let’s try the other side, either because the PAP has declined in quality or the opposition has put up a team which is equal to the PAP and they say, let’s try the other side. That day will come.’
He referred to the Japanese Liberal Democratic Party, which held power from 1955 to 2009, with an 11-month interruption from 1993 to 1994, and said its downfall was partly because it ‘carried on with old ideas’.
He added: ‘No system lasts forever, that’s for sure. In the next 10 years to 20 years, I don’t think it’ll happen. Beyond that, I cannot tell. Will we always be able to get the most dedicated and the most capable, with integrity to devote their lives to this? I hope so, but forever, I don’t know.’
Mr Lee, who was party leader until 1992 and now remains on its central executive committee, made these candid comments in a series of interviews with a team of Straits Times journalists. The interviews are published in a new book, Lee Kuan Yew: Hard Truths To Keep Singapore Going, to be launched today at St Regis Singapore.

IN ITS basement, some of the most important discussions on the future of Singapore were held in the 1950s. But if Minister Mentor Lee Kuan Yew has his way, the house at 38 Oxley Road will not survive his passing.
‘I’ve told the Cabinet, when I’m dead, demolish it,’ said MM Lee in an interview for the book Hard Truths, which will be launched on Friday, 21 Jan.
Mr Lee told journalists from The Straits Times it would cost too much to conserve and maintain the house. Already, there are cracks on the wall, although the pillars are sound. ‘I don’t think my daughter or my wife or I, who lived in it, or my sons who grew up in it, will bemoan its loss. They have old photos to remind them of the past,’ said MM Lee.
So far, opinions are divided. Mr Tan Szue Hann, architecture editor of Singapore Architect magazine, said the house should be conserved as ‘it hosted meetings that shaped the Singapore that the world has come to recognise and admire.’
But Mr Ho Weng Hin, partner of architectural conservation consultancy Studio Lapis, said the owner’s preference is important. ‘Some owners may not want their private space intruded upon,’ he said.
Mr Ong Keng Yong, director of the Institute of Policy Studies, noted: ‘The only way to find out (whether the public attaches significance to the house) is to ask the people of Singapore, possibly through a poll. If they think it should be conserved, the government of the day should bear the cost of maintaining it.’

Tampines Town Hub 2015: Something for everyone

THE 261,700 Tampines residents who want to visit the library, play futsal, watch a concert or just eat and drink can find all that in one place by 2015.
This scenario for a buzzing heart of the heartlands was unveiled by Minister for National Development and MP for Tampines GRC Mah Bow Tan on Friday morning as he announced the Tampines Masterplan for 2011-2015.
The proposed project – dubbed the Tampines Town Hub – will occupy 5.7 ha of land, or about seven football fields.
Existing facilities such as the Tampines Regional Library, North East CDC, Town Council and HDB branch offices will be relocated to the site. In addition, food and beverage outlets, retail shops, a performing arts theatre and a community club will be built there. It will also contain recreational facilities like an astro-turf football pitch, badminton and tennis courts.
Mr Mah said he envisioned a central location in the town with something for everyone.
He added: ‘It all originated from the old concept of a community centre where people would drop in freely. But in today’s world where there are so many different interests, and people have so many places to go to, what we hope to do with the town hub, is to gather people back again.’

Salam Yang Amat Berbahagia Tun,
There has been many issues brought up by each ethnic group in Malaysia nowadays. Some of the issues brought up might be considered as sensitive to them but not to the others. This is the fact that we must accept when we live in a country of multi racial. However, there must be proper ways for us to highlight issues raised through proper manners and means to avoid confusion to society.
If we are not able to solve the issues amicably, probably there will be more issues coming up in the near future. It is not an easy task for the Government to provide clear and acceptable explanation with reasonable facts with regards to the issues raised coz everybody has sensitivity and pride that must be taken care of very carefully.
Should and once this situation getting worst, Malaysia probably will need to redraft all the history text books so as to satisfy each ethnic group in this country. Hopefully this will not happen.

Censorship. There’s no bad or good about censorships. It has to a lot to do with the situation and condition when such actions or words are uttered which would determine whether it is supposed to be censored or not. In this part of the region where close-knit family ties are part of our culture regardless of race, we are by nature a more reserved lot than our western counter parts. We learn to respect each other during our childhood. To respect our elders and what’s not. So, we practiced self censorship and would rather walk away or keep quiet if we think it is not right to speak our mind for fear it will offend the person.
However, as we approach a more borderless world where we are expose to more western cultures, thru internet or for some younger folks, the opportunity to study overseas, the part of self censorship and self restraining has slowly being diluted.
And any attempt to curtail this is projected as an act of restrained freedom of speech and anti democracy.
For this part, it will seriously take to task the maturity of the government of the day to either take actions to curtail it or just let it be.
Without censorship whether in words or actions, the young and “immature” country like us will be plagued with chaos of various political parties or NGOs making their stands or believe heard.
It will be difficult to control the citizen more so when they are not mature enough to know what is actually sensitive and what is not.
Even in a modern country like the UK, although its censorship were quite relaxed, some words are not meant to be said or done like mocking the Queen. It is considered a taboo even.
Censorship is needed, but it will depends on the situation and condition that will commensurate the severeness of such actions to be taken. Overly censorship of topics involving public interest is not good. It will only goes make the public even more curious to know what’s going on, and overtime it will be perceive as a cover-up by the government to protect some one or some interest that will turn the citizen the other way around.

My apology for digressing from your topic. In the latest book , Hard Truths to be launched by Straits Times Press Singapore, excerpts from the book were published in the Sunday Times, 16 Jan 2011. The book is based on 16 interviews with Minister Mentor Lee Kuan Yew. Apart from Allahyarham Tunku and the late JB Jeyaretram (former Singapore Opposition MP), your name was mentioned twice in the excerpts which I reproduce below. As for Allahyarham Tunku and late JB Jeya, they have long gone from the surface of this earth and we will not be able to get their opinion/reply from the negative remarks about them. However, since you are still around it would be nice to hear your comments.

When we fail to censor, especially the pornographic materials in the internet available to all and sundry including children, aren’t we just falling to the stratagems of the dajjal which is to wreak havoc with the minds and moral of the Muslims? On the other hand, with all these filths around…might we be building the children’s (adults also) character if we can make them withstand and/or refuse all temptations arising therefrom? Could the latter argument be the rationale for Tun’s ban on censorship of the internet (apart from making this country attractive to foreign investors, especially in the MSC)?

Ok, Tun is talking about people taking legal actions to silence others. The southerner LKY and his sidekicks are notorious for doing this such that every government’s actions or inactions were met with deafening silence. Our leader of the oppositions is an avid student of LKY’s methods but most of his forays in this direction has yet to bear sweet fruits, especially those with regard to his actions against Tun himself. 1. I am also not a lawyer, but this is interesting. If you talk about freedom of speech, censoring is certainly undemocratic, yet it is required. On an example, censoring immoral materials to the public is required even though it is against their choices.
2. Censorship is always not black or white; it is shady which is subjected to political, moral, or religious issues which are driven by harmful, objectionable, sensitive, or inconvenient information. I bet there must be many encounters on issues of (to be or not to be) censor during your leadership.
3. Whistle blowing on the other hand is always about wrongdoings where most of the time results of whistle blowing acts are unfavourable to the wrongdoers and their allies.
4. A reprisal act to protect you from defamation is a must. But a reprisal acts which abuse the laws to hide criminal acts are why places like online leak sites exists. Some of them have been anonymously contributing just because it is important to the public to know the wrongdoings yet it is dangerous for them to reveal themselves.
5. Protection acts can be manipulated easily and even can be twisted to hide the facts. Unless you know and prepared for what you are against to, you need to be prepared to be a sacrificial hero if you wish to reveal yourself. (In bringing integrity to the data) What happing to Rudolf Elmer on Swiss bank accounts should be a reason to be afraid on what influential people can do in protecting themselves.

Obviuously its is being done on the ground that it will jeopodice certain people that is under investigation and that the sub judice prinsciple should adheared to. This is all for the sake of particular person/persons and the whole nation is held at bay and the right of the majority is denied. The most frustrating part is that we all know about this but we are powerless to do anything about it, for example using the loop holes in the law to postpone cases and to prolong the suffering of the complainant, and making a mockerry of the law itself. Every body is talking about it but with the help of certain people who are cunning to twist the law, they can get away with murder, ablivious to what the people might feel. But then we are herpless even though we know and keep repeating that JUSTICE DELAYED IS JUSTICE DENIED. I fell the whole senario is again very much related to Politic , the government should not be coerce to comply with the demands of the miniority. Personally there is nothing degrading or humilating to any particular race in the book itself, and every one knows the exixtance of the cast system in certain country as factual. It has never been practice here openly and there should not be any remorse by any pearticular race in this country for that matter. Truths will remains truths forever, only time will uncover them. To use censorship to deter the truth from being exposed may work in short time…As far as for the whistle blower, upholding truth has never been easy throughout human civilisation. One must be brave, impartial, determined, smart and without ‘side interest.’
Tun is always stir up situation and has been imposed censorship all the time. That never stop him from keep commenting on what disturb him.
Guidelines for censorship therefore must be governed properly so that to be abused.
Censorship in Malaysia is selective. Whenever it supports the agenda of the BN government and its politicians it will surely be enforced. Thats the way it has always been and that is how it will remain.

In my opinion, I think that to some extent but only limited to good cause, censorship is a must. For example, remarks that is made to create a stir in the society (hatred among religions, hatred among races, national security issues) must be banned to prevent from affecting the stability of the country.
Others include military confidentials, back-bitting, slanders, information that is misleading which does not benefit the society at large, etc, should also be controlled. Freedom of speech be it may, I don’t think would be useful if its only led to more disaster than before. All these is to be managed effectively by the Government who run the country. And normally, the good Government is the one who manage to get the people’s trust and create more harmony and wealth.
But what if other people who is not the Government is doing such? As mentioned, one effective way in doing so is by using the law. By obatining court order, other people mouth is being shut from talking about it.
Well, in this point of view I would like to refer back to the lesson I learnt in Islam. My teacher once said, it is the principal of Islam where if it is true it is called ‘mengumpat’ or backbitting. If it false it is called ‘fitnah’ or slander. Both are not permitted. Therefore, Muslim should not wait for court order before they stop all the backbitting or slander. And this is applied to everybody and not just for the cause of one person only. Some people only practice this for the good of their own only but tend to resort to different approach if it is in their opposite. For example, some people don’t like people talking about Anwar’s sodomy case but they themselves are talking openly accusing many BN leaders for all sort of allegation without any base or court proceedings.
If we have basis and convinced that there is some degree of truth on our allegation, we can lodge a report and let the law take it from there. Otherwise I call for all to stop the backbitting and slander as it would create more bad than good. By saying this, a whistle blower should not be refrained from lodging a report just because we should not practice backbitting or slander in Islam.

I get very angry and rather emotional when I read all the unfair “attacks” by people who dont know any better. You dont deserve those remarks. I was in Singapore on Sunday and read the excerpts of Lee Kuan Yew’s new book which will hit the bookstores on 21 Jan. I felt very angry reading it and I think he is paranoid about Malaysia and you.
I dont intend to write long but suffice to let you know that you are greatly loved and admired by the many. Ignore the few ignorant ones who are in denial or whose selfish agenda were not fulfilled.

I heard part of protect whistle-blowers is they must not spill the beans to everybody. But you want the gov. to protect whistle-blowers right to tell everybody. there pros and cons.
How about this if the witness is against PR then gov. protect their right to hold press conference and tell the world.
If its against BN , then need to enforce rules witness does not speak to anybody during course of cover up (opss I mean investigation.)

I salute you for your astute observation and courage to speak out. This is a very sensitive topic to write. fellow commenters please be forewarned that you might be sued the normal sum of rm100 millions, if you are not careful and explicitly mention names with regards to the ongoing sodomy trial. A big time criminal undergoing a prolong criminal trial can impose censorship on all and sundry from discussing the particular crime by way of sub-judice or threat to sue for defamation.
The long arm of the law just takes too long to conduct the trial. Experienced criminal lawyers know how to delay the legal process until PRU 13 hoping PR can win and if PR wins the general election, the sodomy trial is a foregone conclusion. Political fortune changes hands and hopefully not another sordid trial on Altantuya to be open up. Wallahualam.
I too wonder whether the act to protect whistleblowers cover this thing or not, most likely not. The act to protect whistleblowers mostly aim at whistle blowing on colleagues and friends.

My apology for digressing from your topic. In the latest book , Hard Truths to be launched by Straits Times Press Singapore, excerpts from the book were published in the Sunday Times, 16 Jan 2011. The book is based on 16 interviews with Minister Mentor Lee Kuan Yew. Apart from Allahyarham Tunku and the late JB Jeyaretram (former Singapore Opposition MP), your name was mentioned twice in the excerpts which I reproduce below. As for Allahyarham Tunku and late JB Jeya, they have long gone from the surface of this earth and we will not be able to get their opinion/reply from the negative remarks about them. However, since you are still around it would be nice to hear your comments.

Question: Some commentators say that you have created Singapore in your image, including ‘always living in fear of a catastrophe’. Why are you so worried that it could all fail?
I’m concerned that Singaporeans assume that Singapore is a normal country, that we can be compared to Denmark or New Zealand or even Liechtenstein or Luxembourg. We are in a very turbulent region. If we do not have a government and a people that differentiate themselves from the rest of the neighbourhood in a positive way and can defend ourselves, Singapore will cease to exist.
It’s not the view of just my generation but also those who have come into Defence, Foreign Affairs ministries and those who have studied the position. Whether it’s Ng Eng Hen, who was a surgeon, or Raymond Lim, formerly an academic and a lawyer by training, or Vivian Balakrishnan, an eye surgeon, they all understand now the circumstances that conscribe us. If we ignore those circumstances, we’ll go down the drain.
We have not got neighbours who want to help us prosper. When we prospered, they for many years believed we were living off their resources. It was only when they became aware that our economic policy of welcoming foreign investments made the difference that they were sufficiently convinced to also do likewise.
We are an upstart in this region because we survived for so long and I believe we can survive easily another 50 to 100 years given the international environment, provided we have a strong system that enables us to maximise our chances.
Q What do you mean by a ‘strong system’? Is it another phrase for the People’s Action Party (PAP) continuing to be in power?
Whether it’s the PAP or any other government does not interest me. I’m beyond that phase. I’m not out here to justify the PAP or the present government. I want to get across just how profound is this question of leadership and people and the ethical and philosophical beliefs of the leadership and the people.
Q Are we really as vulnerable as you suggest? Critics would say you make things seem so dire that so many things practised elsewhere, including in small countries, such as political competition, will not be available here.
No, we are not preventing competition. What we are preventing is duds getting into Parliament and government. Any person of quality, we welcome him but we don’t want duds. We don’t want Chee Soon Juan, or J.B. Jeyaretnam. They’re not going to build the country. But if any serious man turns up and forms an alternative equal to us, I say, ‘Good’. Then we are getting a proper alternative. But look at the candidates they put up.
Now, are we not vulnerable? If we are not vulnerable, why do we spend 5 to 6 per cent of GDP (gross domestic product) year after year on defence? Are we mad? This is a frugal government, you know that well.
We dug a deep tunnel for the sewers at the cost of $3.65 billion in order to use the sewage water for Newater, to be independent.
We are not vulnerable? They can besiege you. You’ll be dead. Your sea lanes are cut off and your business comes to a halt. What is our reply? Security Council, plus defence capabilities of our own, plus the Security Framework Agreement with the Americans.
They stopped sand. Why? To conscribe us. As Mahathir (former Malaysian Prime Minister Mahathir Mohamad) says, ‘Even at their present size they are trouble, you let them grow some more they will be more trouble’. We’ve got friendly neighbours? Grow up.
Why would we put a strong minister in Defence if it’s not important? He’s the strongest minister in the Cabinet next to the PM, toughest, most capable. We have always put a strong man there. Do we parade our vulnerabilities? We are living in an adult world. Why do we have peace? Because it is not cost-free if you hit us. If you hit us we will hit you and the damage may be more on your side.
Q But this point about not being a normal country…
Forgive me for saying this: Assuming that I’m just nearly as intelligent as you are, but I’ve lived more than 85 years and I’ve been through all these ups and downs and I’ve spent all my life since the age of 32 figuring out how to make this place work, right?
First, I believed and said the only way it could work was to join Malaya because otherwise we cannot live. Our water, our raw materials, imports, much of the exports come from Malaya. That was at that time. We couldn’t get to Malaya because the Tunku didn’t want the Chinese population.
We worked around that and we joined Malaysia. Then we found ourselves trapped, from a communist Singapore to a Malay-ultra Malaysia. Has Malaysia changed? How has it changed?
Why did I break down when we got out on the 9th of August? Because I left behind tens of thousands of people who had joined our rallies, and I knew that they were going to be handicapped, again a minority and leaderless. We provided the leadership. So when you tell me we’re not vulnerable, I say, ‘Oh, God!’
You speak to the SAF (Singapore Armed Forces) commanders. Why do they do this – two years of every young man’s life, 4, 5 to 6 per cent of GDP and a frugal government that builds up reserves? We do this because of hallucinations? Or because that’s the only way we can be left alone to survive and prosper?
Why do you think we spent all this effort to solve our water problem until we became specialists in water? Mahathir knew we needed Johor water. So when the water agreement was going to end in 2011 for Tebrau and Skudai, we knew we would be short. Then we discovered Newater. He thought we were bluffing. You say we’re not vulnerable?
We should not gloss over our worries. They are real problems. And we are what we are because we can stand up for ourselves. If we can’t, we’ve had it. The Security Council passes resolutions. So what? Who goes to Kuwait’s rescue? The US. Why? Because of oil. Why? Because next stop would be Saudi Arabia.
Who’s coming to our rescue because of water? The US? No. We rescue ourselves. Either the media grows up, especially the young reporters, or we’re going to bring up a generation that lives in a dream world of security when none exists…
I had to make this society produce results, then we will become prosperous, then we can have a strong defence, and the world has a place for us. If you believe we’re like Norway or Sweden or Denmark, then we won’t survive.
Singapore is an 80-storey building on marshy land. We’ve learnt how to put in stakes and floats so we can go up for another 20, maybe over a hundred storeys. Provided you understand and ensure that the foundation is strong. Crucial is interracial, interreligious harmony. Without that, quarrelling with one another, we are doomed.

You are as usual confusing the proper workings of a democracy with your own preference not to be sued by people like Anwar Ibrahim.
Our Constitution and laws provide an inalienable right to any citizen to sue another for perceived defamation. The exercise of that right by individuals and organizations must not be confused with censorship and we should leave it to the courts to resolve each case according to its merits. If a complainant exercises his rights frivolously, it is up to the judges to ensure he is punished for abusing due process.
In Malaysia, it is often the Government which practices censorship through ownership, licencing and control of the “Free Press” and unilaterally banning books and magazines. For example, why did you not when PM publish the Government investigation and audit report on Perwaja’s $12 billion losses? Why did the Home Minister ban Zunar’s cartoons and the police illegally confiscate his books merely because they are critical of Najib and his wife, and similarly, Kin Quek’s ‘March to Putrajaya’?

Why don’t you light a fire under the posteriors of the Home Minister and Chief Justice to ensure that justice is administered judiciously AND swiftly? Is it not their job for which the Taxpayer has to cough up year after year without decent results?

What did YOU have in mind when YOU introduced the Printing Press and Publishing Act (PPPA) so that printers, publishers and newspapers can be sued for defamation for articles written by others?

I would not know what honor has to do with whistleblowing, Ayahanda. They say US politics is very complex and so I do believe is the Malaysian politics. Only they had the Tucson shooting incident.
