1. The Malaysian Insider recently reported the MACC Chief Abu Kassim might be replaced, basing it on “source”.
2. Abu Kassim has some health problem but he himself says that he hopes to retire at 60, the mandatory retirement age. Obviously he does not think that his health would force him to retire any time soon.
3. Government has certain procedures for sick employees to retire before reaching retirement age. A Medical Board will have to be set up to examine the health of the person who seeks to retire early.
4. The Board will issue a proper medical report on the state of the person’s health and certify his being unfit to work.
5. If the officer’s appointment is at the pleasure of the Yang di Pertuan Agong, then the certificate must be produced for the Agong to agree to his retirement, and for his signature.
6. There is doubt whether in the case of the former A.G. Tan Sri Gani Patail the procedures were followed. When he was retired the PM stated that it was for health reasons. Gani himself denied this although he was suffering from kidney failure. A kidney failure person can work for quite a considerable length of time. It is not a cause for early retirement.
7. And now Gani is reported to begin a career as a lawyer. Obviously he is fit to work.
8. The question is whether the MACC chief will also be retired prematurely for health reason? It is known that the MACC has submitted its report to the AG. The AG says he would act without fear or favour. But he requires time as the report piles up to his height. How much time? Or is the AG to determine whether there is a case for the judges to judge or will he be the judge and dismiss the case as indeed he had done with the Bank Negara report.
9. There is currently a deficit in terms of trust in the present Government and its institutions. There are many reasons for this deficit. Saying that everything is fine will get the Government nowhere. Deeds count more than words.
10. The removal of Tan Sri Abu Kassim will only convince the people that all that is being said against the Government is true, that it exist merely to prevent the rule of law being applied to the leadership of the nation.

PEMECATAN DAN PENGGANTIAN
1. The Malaysian Insider baru-baru ini melaporkan bahawa Ketua Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Abu Kassim mungkin diganti, berdasarkan pada “sumber”.
2. Abu Kassim mempunyai beberapa masalah kesihatan tetapi beliau sendiri berkata bahawa beliau berharap untuk bersara pada 60, umur wajib persaraan. Jelas sekali beliau tidak berfikir bahawa kesihatan beliau akan memaksa beliau untuk bersara dalam masa terdekat ini.
3. Kerajaan mempunyai prosedur tertentu untuk kakitangan yang sakit untuk bersara sebelum mencapai umur persaraan. Suatu Lembaga Perubatan perlu ditubuhkan untuk memeriksa kesihatan sesiapa yang meminta untuk bersara awal.
4. Lembaga ini akan mengeluarkan laporan perubatan yang sewajarnya mengenai keadaan kesihatan orang itu dan mengesahkan beliau adalah tidak mampu untuk bekerja.
5. Jika pelantikan pegawai itu adalah atas titah Yang di Pertuan Agong, maka sijil perakuan hendaklah dikemukakan kepada Agong untuk dipersetujui persaraan itu, dan menandatanganinya.
6. Wujud keraguan dalam kes bekas Peguam Negara Tan Sri Gani Patail sama ada prosedur ini telah diikuti. Apabila beliau dibersarakan, Perdana Menteri menyatakan bahawa ini adalah atas sebab-sebab kesihatan. Gani sendiri menafikan ini walaupun beliau mengalami kegagalan buah pinggang. Seseorang yang menghidapi kegagalan buah pinggang boleh berfungsi untuk tempoh masa yang agak panjang. Ia bukan satu sebab untuk bersara awal.
7. Dan sekarang ini Gani dilapor akan memulakan kerjaya sebagai seorang peguam. Jelas sekali dia berkeupayaan untuk bekerja.
8. Soalnya ialah sama ada Ketua SPRM juga akan dibersarakan awal atas sebab kesihatan? Telah diketahui bahawa SPRM telah mengemukakan laporannya kepada Peguam Negara. Peguam Negara berkata, beliau akan bertindak secara adil dan saksama. Tetapi beliau memerlukan masa kerana laporannya tebal bertimbun sehingga ketinggian beliau. Berapa banyak masa? Atau adakah Peguam Negara yang akan menentukan sama ada terdapat kes untuk hakim mengadilinya, atau beliau sendiri nanti akan menjadi hakim dan menolak kes itu sepertimana yang dilakukannya dengan laporan Bank Negara.
9. Buat masa ini terdapat defisit dari segi kepercayaan terhadap Kerajaan masa kini dan institusinya. Terdapat banyak sebab-sebab defisit ini berlaku. Dengan hanya menyatakan bahawa semua adalah baik tidak akan bawa Kerajaan ke mana-mana. Tingkah laku adalah lebih baik daripada kata-kata.
10. Penyingkiran Tan Sri Abu Kassim akan hanya meyakinkan rakyat bahawa semua yang sedang dikatakan terhadap Kerajaan adalah benar, bahawa ianya wujud semata-mata untuk mengelakkan kedaulatan undang-undang dikenakan kepada kepimpinan negara.

ii) THE ABILITY TO THINK OUT OF THE BOX
iii) COMPASSION

The present government’s democracy is only a facade to fool rakyat. The PM has in fact turned this government into a tyranny government. Peguam Negara kembalikan semula kertas siasatan kepada SPRM

PUTRAJAYA 18 Jan. – Jabatan Peguam Negara telah meneliti dan mengkaji dua kertas siasatan berkaitan kes SRC International dan satu kertas siasatan kes yang dikatakan melibatkan dana RM2.6 bilion yang dikemukakan oleh Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) pada 31 Disember lalu.
Peguam Negara, Tan Sri Mohamed Apandi Ali berkata, setelah meneliti keseluruhan keterangan di dalam kertas siasatan tersebut, jabatan itu hari ini mengembalikan kertas-kertas siasatan tersebut untuk mendapatkan penjelasan daripada pihak SPRM serta beberapa cadangan dan tindakan yang disyorkan oleh pihak SPRM.
Jabatan itu juga mengarahkan agar kertas siasatan dikembalikan dalam masa terdekat. – UTUSAN ONLINE

A.G. Tan Sri Gani Patail was only months away from retirement. Surely, the government could have waited just the few months. And why wasn’t it even discussed with him. He was denied entry into his office, goddamn it. And then given the rank of a legal officer in the remaining months. A VERY HIGH level government servant treated like a pariah. Nothing wreaks huh?
I am not sure what valid point you are trying to make about the Government insuring its workers in this argument. If he had died during the few months had he remained in office, insurance company pays up. What is the problem?

Surah Maryam
إِنَّ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ سَيَجْعَلُ لَهُمُ الرَّحْمَنُ وُدًّ
96. Sesungguhnya orang-orang yang beriman dan beramal saleh, kelak Allah Yang Maha Pemurah akan menanamkan dalam (hati) mereka rasa kasih sayang..

Rasullulah s.a.w hadith by the virtue of regular commuter to the mosque.
“Bila kamu melihat seseorang yang sentiasa berulang alik ke masjid, maka bersaksilah kepadanya dengan keimanan”.
Rasulullah s.a.w. bersabda:
مَا مِنْ عَبْدٍ يَسْتَرْعِيهِ اللهُ رَعِيَّةً يَمُوتُ يَوْمَ يَمُوْتُ، وَهُوَ غَاشٍّ لِرَعِيَّتِهِ إِلاَّ حَرَّمَ اللهُ عَلَيْهِ الْجَنَّةَ
Ertinya: “Mana-mana hamba yang Allah memberikannya jawatan ketua kepada orang ramai, dan dia mati dalam keadaan menipu rakyatnya, maka Allah akan mengharamkan syurga kepadanya”. Hadis riwayat Muslim.
إِنَّهَا سَتَكُونُ أُمَرَاءُ يَكْذِبُونَ وَيَظْلِمُونَ، فَمَنْ صَدَّقَهُمْ بِكَذَبِهِمْ وَأَعَانَهُمْ عَلَى ظُلْمِهِمْ فَلَيْسَ مِنَّا وَلَسْتُ مِنْهُمْ وَلاَ يَرِدُ عَلَى الْحَوْضِ وَمَنْ لَمْ يُصَدِّقْهُمْ بِكَذَبِهِمْ وَلَمْ يُعِنْهُمْ عَلَى ظُلْمِهِمْ فَهُوَ مِنِّيْ وَأَنَا مِنْهُ وَسَيَرِدُ عَلَي الْحَوْضِ.
Ertinya: “Akan datangnya para pemimpin yang banyak berdusta dan melakukan kezaliman. Maka sesiapa yang membenarkan pendustaan mereka, dan membantu di atas kezaliman mereka, maka dia bukanlah daripada golongan kami dan aku bukan daripada golongan mereka dan dia tidak akan datang ke kolamku (di akhirat nanti). Dan sesiapa yang tidak membenarkan pendustaan mereka dan tidak membantu kezaliman mereka, maka dia adalah daripada golonganku dan aku daripada golongannya, dan dia akan datang (meminum) kolamku”. Hadis riwayat Ahmad dengan isnad yang sohih.

Since that 1MDB thing appeared, there were and are many weird things happening…to some, they meant nothing, to others, what najib and his goons had done and in the process of doing (including dismissing MACC boss), are reinforcing the notion that najib and BN government are up to no good…..cheating, lying, ridiculing, making a fooling, etc of the people of Malaysia and those from outside this country.
All the other PMs (bolehlah masukkan pak lah) tried their best to bring good name and good deeds to this nation…..but this najib is bringing down our country and his cronies are supporting him to bring down this country faster…..they dont have conscience…no wonder a lot of people hated umno leaders.
Memang Malu punya Kerajaan yg di pimpim olih Najib
Kelihatan Benar Tidak Berkemampuan
Tiada Visi walau sekarang abad 2016
Pemikiran Najib serupa Bodoh macam budaya pemimpinan 60’an

Fariq Islam has perhaps put in perspective what lies at the heart of a government’s rights and obligations in this matter raised by the Tun. At least it refers correctly to the powers a government has when dismissing or relieving an officer of his obligations or role in any position.
Having said that one has to bear in mind that by someone retiring before the age of retirement is not necessarily evidence of government intervention in the process.
The AG having reportedly suffering from kidney problems may not have satisfied the governments standards for remaining in the job. The same standards apply in most commonwealth countries. Remember that even government departments have insurance for their workers co underwritten by private sector insurers.
Just becaue the former AG wants ot engage in private practice does not mean there was something sinister in his retirement or removal. Being fit by government standards (because of the different standards for underwriting risk) is not quite the same as being fit in private practice. In private practice the AG underwrites his own risk.
Putting all of this aside one wonders why the Tun has engaged in undermining UMNO.
What the public think (as gullible as many of them are) is really not reason enough to discredit or destroy a government and the only protection the Malays truly have.
It takes a lifetime to build up a reputation, it takes a little unthinking act to destroy it forever. Sad

Adalah kuasa Allah swt untuk menggerakkan hati manusia untuk dipanggil bertugas. Selagi tidak digerakkan hati, maka manusia hanya bisa berusaha yang belum tentu dijanjikan kejayaan.
Begitulah yang dimaksudkan dengan satu hadith qudsi berkenaan wali Allah yang boleh difahami bahawa Allah menggerakkan gerak wali Allah itu.
Berusahalah, namun apabila Allah berkata ‘jadi!, maka jadilah ia.
Tiada apa yang perlu kita risaukan asalkan adab adab beragama kita amalkan.
Nak pecat pun pecatlah. Sekarang pun ‘bandar merah’ pun dah kena gantung.

1. If Tan Sri Abu Kassim is dismissed, then it’s so obvious and without any doubt that DSN is willing to do almost anything to retain his position/power as the PM of Malaysia. DSN is a power-crazed leader, and he must be toppled soonest possible for the sake of Malaysia & Malaysians.
2. PM Najib @ Ah Jib Gor has no integrity left. Only those who are after ‘cash and positions’ want him to stay.
3. DSN is the one who should/must be dismissed and replaced soon on grounds of ’mentally unfit’ – ‘GILA kuasa, gila duit, korup, pecah amanah, salah-guna kuasa, etc…’.
4. It’s funny that DSN is still able to walk around without any feeling of shame for all his wrongdoings. Normal and mentally healthy people would feel so ashamed if they were in his place and would have resigned immediately.

Najib guna duit untuk kekal berkuasa. Tahun lepas, jabatan perdana menteri yang paling banyak dapat belanja pembangunan. Sekarang saya tak suka bayar cukai sebab najib tak pandai berbelanja.
Sekarang saya prefer bayar guna duit tunai sebab dah banyak jugak kedai yang tak charge gst bila kita bayar cash. Padan muka Najib!

Apa yang rakyat lihat dan tunggu adalah menilai tindak-tanduk kerajaan dan sisa-sisa pimpinan Najib semakin menghampiri PRU14 sekitar 24 bulan dari sekarang.
TITIK MASA PRU14 ADALAH DETIK PENILAIAN SEJAUH MANA PENERIMAAN RAKYAT TERHADAP PIMPINAN NAJIB.
Jika rakyat menganggap Najib adalah “ZALIM TERHADAP RAKYAT” maka wajarlah UMNO/BN dihukum pada PRU14.
Nasib UMNO/BN bukan hanya terletak pada Najib semata-mata tetapi pada KEBIJAKSANAAN MAJORITI AHLI-AHLI UMNO. Jika majoriti ahli-ahli UMNO sedari (sekarang) bahawa kepimpinan ketuanya tidak diterima majoriti rakyat maka sesuatu yang drastik perlulah dilakukan segera.

1. Selalunya begitulah. Ramai yang mengundur sehingga akhir hayatnya.
2. Kalau setakat uzur seseorang itu tidak mendatangkan apa-apa masaalah besar dalam perkhidmatan kepada majikan selalunya terus diberi peluang.
3. Majikan kita ialah kerajaan. Kerajaan dibentuk oleh perlembagaan negara yang telah tertulis sekian lama.
3. Pasti kerajaan tidak sekejam sebagaimana kita ketahui dengan adanya undang-undang bertulis atas perkara-perkara yang melibatkan kesihatan.
4. Malah undang-undang dalam kerajaan telah memberi peluang kepada tokoh-tokoh yang sakit meneruskan perkhidmatan dengan mengadakan panel-panel kesihatan mendapat rawatan dengan kemudahan cuti rehat.
5. Melainkan atas kerelaan sendiri pemberi khidmat untuk meletak jawatannya atau tidak dapat lagi mengikut terma-terma yang ditetapkan contohnya ada unsur penipuan atas kemudahan yang diberikan.
6. Ada beza antara seorang ketua kerajaan dengan ketua yang memiliki Syarikat sendiri. Dalam kerajaan, ketua itu sendiri perlu mematuhi undang-undang kerajaan iaitu majikan kita.
7. Yang pasti kerajaan dengan undang-undang yang bertulis sekian lama tidaklah sekejam dengan ketua yang bertindak bagai kerajaan itu miliknya.
8. Yang boleh menentukan seseorang itu patut diberkhentikan ialah kerajaan iaitu majikan kepada ketua negara Malaysia.
9. Sebab itulah kita rakyat (yang tertindas akibat perkara yang direncanakan oleh menteri-menteri yang bekerja bagi majikannya iaitu kerajaan) patut membantah atas usaha kerajaan dalam kes TPPA.
10. Rimba Emas sendiri ketika ini dalam delima akan jaminan kerajaan akan perjanjian TPPA. Belum pun perjanjian ditangani isteri Rimba Emas kehilangan pekerjaan dalam Syarikat milik negara Australia iaitu UBC Commercial Vehicles(Malaysia)sdn.bhd.
11. Setelah bekerja berbelas tahun inilah dugaan yang terpaksa di terima akibat bebanan hutang oleh pelabor asing.
12. Pemberhentian secara mengejut tampa gaji dengan bebanan hutang kredit ditambah kos kehidupan yang meningkat, adakah jaminan kerajaan oleh TPPA milik negara asing boleh menjamin apa yang keluarga Rimba Emas hadapi sekarang ?
13. Sedangkan sekarang pun keluarga Rimba Emas terpaksa menaggung sendiri kesulitan yang berlaku, adakah jaminan dari kerajaan yang tidak menerima musibah ini sanggup menerima perjanjian TPPA ini?
14. Benarlah sebagaimana kata-kata Allah s.w t didalam Al-Quran tangan-tangan manusialah yang merosakkan bumi ini.
15. Manusia-manusia didalam kerajaanlah yang akan merosakkan sesebuah kerajaan itu bukannya salahkan kerajaan yang menentang kerajaan yang telah dibentuk sekian lama.

The late Tun Razak was diagnose with one critical illness but even then he could deliver the best for his nation.
The late Dato’ Salleh Majid was on dialysis treatment for so many years and he too perform well his duties.
Today patient on dialysis have been recorded to sustain up to 30 years and there is no issue for Gani Patail.
Abu Kassim have no critical illness but his boss Najib is one sick person.
Najib need to step down to get proper treatment.

The rule-of-law movement cannot be fully successful without answering to the question: does the rule of law matter for economic, social, political, spiritual development or not?
Malaysia has to strengthen the rule of law – that is, the rules of society, as pertaining to the protection of property rights, individual/group rights, the rights to practice religion, the police, the judiciary, and the levels of crime and violence. But it is not as simple as passing legislation; the rule of law is also about the respect that those rules are accorded; whether the rules apply equally to everyone (regardless of socioeconomic or ethnic status), and whether those rules are implemented and abided by.
Malaysia should not be developed only in the economic sense. It must be a nation that is fully developed along all the dimensions: economically, politically, socially, spiritually, psychologically and culturally. We must be fully developed in terms of national unity and social-cohesion, in terms of our economy, in terms of social justice, political stability, system of government, quality of life, social and spiritual values, national pride and confidence.
So before we even speak about rule-of-law, we need to document and understand the existing implicit and explicit rule-of-law which some groups or individual may have problem in understanding them.

Mengikut maklumat yang Tun beri, sekiranya Abdul Ghani Patail mengalami penyakit buah pinggang, maka atas sebab kesihatan, beliau ditukar-ganti, adalah sesuatu yang waras dan boleh diterima Rakyat.
Dari perspektif yang lain, kalaulah seseorang Ketua MACC itu hanya berusia 40, apakah harus dia dikekalkan dalam jawatan itu sampai usia pesaraan pada 60? Jika sebegitu, maka dia akan menyandang kerusi selama 20 tahun, berdasarkan fakta usia bersara iaitu 60 tahun! Itu nampaknya kurang sesuai juga.

The rights to remove and appoint new AG in the hands of PM/ Government have been set since long time ago, and perhaps the authority/ power is something inherited from Tun’s era.
However, MACC was a valuable contribution of Pak Lah to help safeguard the nation’s interest in the long run. It is still new. If it is deemed less appropriate for the Head of Government to change in his capacity as PM, perhaps the lawmakers should voice it out, to change and reinforce independence of the body/ function. Perhaps the appointment/ removal of MACC Head shall be subject to the Parliament’s/ Agong’s approvals.
