EQUALITY BEFORE THE LAW

1. One of the nonsense that we believe in is equality before the law. Of course this is one of the great fictions that democracy is said to uphold. But then democracy itself is often not even democratic. The people, the ordinary citizens never really govern themselves. But that is another story.

2. Now, about equality before the law that democracy is said to uphold. It is not upheld at all. Some people are actually above the law and some are far below it, i.e. they don’t really get the benefit or the protection of the law.

3. I will deal with those who do not benefit first. The democratic legal system gives the power to the courts to decide on disputes between individuals or organisations. The courts are presided over by legally qualified but very human judges. The contestants have to convince the presiding judge of their innocence.

4. Not being conversant with the laws the complainant and the defendant hire lawyers to argue their cases for them. Now some lawyers are clever and smart, but some may be just plain stupid. But both cost money. The smarter lawyers would naturally cost much more than the not-so-good ones.

5. Some lawyers have great reputations. In fact some may even be great politicians. Some of these political lawyers can be frightening to the judges.

6. The result of the inequality of representation by brilliant and fearsome lawyers on the one hand and the ordinary run-of-the-mill lawyers is most likely to be victory for the highly paid, brilliant and fearsome lawyers. The rights and wrongs of the case are of little consequence.

7. Effectively the law almost always favours the rich and not the poor. There is clearly no equality before the law. Get a good expensive lawyer and you can get away with murder. Get a bad cheap lawyer and you may be hanged for someone else’s murder.

8. International law is no better. If you lead a powerful country you can massacre a few millions and all that happens is a statue, as a war hero, will be put up in your honour.

9. If you lead a poor weak country and you act against violence by the opposition, then you may be accused of oppression and tolerating police brutality. The opposition, when they are clever enough to promise a variety of freedoms, can do no wrong even when they use violence to provoke the police into so-called acts of brutality.

10. If you are a favourite candidate of foreign powers for regime change, you can do what you like, and any Governmental action against you would be labelled as uncalled for oppression. If an election is near and the favourite is going to be a candidate and bring about regime change, then Government action against this privileged person would be regarded as attempts to undermine his chances of overthrowing the Government.

11. That the favourite purposely timed his violence just when elections are near would be ignored. That the provocation of the police is deliberate and meant to elicit “police brutality’” will also be ignored. That the police are beaten up, that police cars have their glass windshields smashed and the police car is overturned in full view of TV cameras – all these are inconsequential.

12. The main thing is the action against the favoured opposition by the Government will be deemed political rather than an exercise in legal equality by the Government.

13. The clamour is for the police to be charged for crimes against the people. Actions by the police to enforce the law must not be allowed. These must be regarded as criminal acts.

14. But blatant criminal acts by the opposition leaders must be regarded as permissible. In law they must be considered as privileged people.

15. There really is no equality before the law. Instead there is blatant inequality; there is bias in favour of some people especially the aspirants for regime change.

    1-I think Cherry is right that Tun is not authoritarian.An authoritarian leader would not bother to hear the views of the ordinary layman like I know Tun did.

    2-How do I know?Simply because I am one of those lucky chaps who managed to obtain an audience with Tun in Putrajaya back in 2001 after my application to meet him surrendered personally at the Putrajaya mosque managed to attract his attention.It is one of the most unforgettable experience of my life.

    3-It was a one to one meeting in Tun’s office for about 20 minutes to share a really crazy idea.He let me do all the talking panicked, I forgot whatever I had originally planned to say and was really disorganized at the beginning.Slowly I became so comfortable and started to talk things I shouldn’t have to a PM of Malaysia.I left a specially dedicated book about my whole global vision for him to read .

    4-Of course Tun didn’t come back to me because what I suggested to him is something a staunch Perkasa supporting people would not be able to swallow.Zulkiflee would definitely disown me and call me anti Melayu.But I believe Muslims who fear God would have no choice but to agree with what I had suggested.

    5-Tun’s eyes almost bulge when I stated what I believe was only obvious.The 1997 economic crisis had practically undone whatever Tun and Daim had been working hard for since taking office in 1984 and I was offering him an alternative plan.I sincerely believe Tun was shocked by what I dared suggest but I was sure glad he didn’t decide to send me to TR or worse still,Kamunting. I also surely hope Tun’s resignation in 2003 had nothing to do with the painful truth I had delivered in that meeting.

    6- I swear in the name of God that this is the truth and nothing but the truth.Surely and truly I would vouch, Tun is not an authoritative person.

    7-But I don’t think that Joshua lopez is incorrect either if he thinks Tun is authoritative.Its the strict culture of the civil service and the Govt controlled private companies that make the boss authoritative.You cannot fight the boss.The boss is always right.If you are not happy with whatever the boss has decided, talk about it only in the toilet.

    8-Tun came from a different environment altogether, having ran his own clinic so he may not be very aware of this taboo in the Govt.

    9-Everytime after he had presented and deliberated his ideas in the cabinet meetings he would asked his ministers for opinions,and all he hear is ‘alright boss,best idea in the world boss,you are a genius boss and other likely sychophantic responses’ .. so Tun actually thought that his ideas were all truly great so things happen just the way he had wanted it.

    10-Based on the true experience above I think Tun actually is an open minded person who had only wanted sincere feedback to improve his ideas.His ministers however,who are mostly Govt staff before lack the trust and so were not willing to take the risk.

    11-To save their backxxxx its better that they shut up.
    They are also aware the jutting nail will risk being hammered down.To play really safe and not make any mistakes at all some even simply choose to sleep with eyes half closed throughout the whole meeting during these twenty two Golden years.One of them finally became a successor and obviously flunked and caused this mess BN is now in..

    12-Tun only realized all these after he was no longer the PM when his ministers refused to share the blame for some erroneous policies made by the cabinet .

    13-That is what I sincerely think.

    You must got this “Tun M is an authoritarian” thing from the opposition.

    Non-opposition has never called him that.

    You can choose what you desperately want to believe.

    Why after you accused Tun M of several negative things, you came crying about the term “kafir” that has been used against people like you to Tun M ???

    Just to let you know that “kafir” is those who are not Muslims. It is in the Quran. If you do not like it so think about what your religion say about those who do not practice your religion. You may not have a word for it but hey, what is the problem. Too bad Malaysia is an Islamic Country.

    You suka-suka hentam and then when you need to air your grievences you need Tun M to listen to you.

    1-If true science have led you to the discovery of God and it is this that made you responsible on this earth,then it is religion- your knowledge of God -and not science that regulated you.In which case you shouldn’t be comparing science to religion because one is only a means while the other is an end.Anyway not all pure scientist discover God ,I am sure you have heard of the evolutionists?

    2-The moment you have discovered God shouldn’t you go one step further and find out who He is.Don’t you think this God who have given you the sophisticated brain and created the whole universe surely also want us to know who He is,the purpose and plan of his creation?

    3-Why don’t you research into all the known holy books perhaps one of them could be truly his revelations to us.Matters pertaining to God could only be known by revelation and not by using logic.We have the Vedas,The Torah,the Gospels,the Qur’an, etc why don’t you study thoroughly all these books using the scientific brains God had afforded you.

    4-Nature,pleasures of nature are all the creation of God.They have all been created for our use to help us serve God.Like all God’s gift they are to be used and enjoyed responsibly.They are all our tools to be utilized responsibly in this world in order to seek the real life in the hereafter.

    5-You believe in God but you do not believe in the hereafter?You believe that life in this world is ultimate,the everything there is hence your passion for hedonism.You must maximise your satisfaction on this earth because we are not coming back,right?

    6-Well its great for you to be able to enjoy hedonism,like the emperors who had a thousand concubines and the Caliphs who had harems consisting of the most gorgeous blondes and brunnetes around.

    7-But whatabout if you were unlucky to be a slave in these Chinese or Korean Kingdoms who have been chosen to be castrated to be turned eunuchs to look after their beautiful concubines? Life is fair you say?Jangan tipu nanti dosa.

    8-Life on earth is not fair.Some are born genius like you middle ages while some others are rubbish writers like me.Some are born white with blues eyes,polish nose,blonde hair while others are born thick metallic black with round nose thick lips and curly wired hair.

    9-Some are born children to billionaires and Kings while others born with nothing to eat that they are only skeletons alive.Some people are born close to perfect while others almost the opposite,handicapped and abandoned and unloved.

    10-Only when you understand that this life which you think is the real isn’t will things make more sense.This world is only temporary and what is temporary is not real.What is real is something that last forever.

    11-Why a dream is not real is because it was all already over.Our lives once its over its only another dream that has ended.A king after he dies will have a tough time to convince the other spirits that he was king before because he couldn’t bring along his crown to prove it.

    12-This life on this earth is not the real place for us.The real place for us is yet to come.We can choose that place to live our real live forever.This life on this earth is just the platform for us to work our way to to build that place in the hereafter.This life is only a temporary testing ground.

    13-How do I expect to convince others of hereafter? I can’t do that.Only God the creator can.All I can do is to try to rationalize the idea across the best I can.The rest I leave it to God.

    14-Should we believe only in one religion?If scientifically you have discovered there is only one creator to this whole universe shouldn’t all these creatures of God only fall in prostration to Him,this one Creator?Why should there be 100 religions to get to him when He is only one?All we’ve got to do is to discover which one is the confirmed word of God and share this with the rest.

    15-I agree that religion has been a cause of the troubles in this world but it is only that religion, being dynamic has a beginning,it grows and mature and eventually become corrupted. It is the corrupted understanding of religion that has caused all these troubles.

    16-However should we still have the original message that we are convinced have remained uncorrupted then there is still hope of reviving the true message of God whichever that it is.We must not take the easy way out by saying there is no religion just because of these confusion.We shall use our scientific minds to rediscover religion once again.

    17-I agree we need a common universal law for all mankind.That law will eventually prevail.But let us all try to find out which is the actual message that one universal God had sent to us.

    May i enlighten “kafir” Joshua Lopez.

    This word, used and abused to a very high degree by religious bigots or pricks as you call them, is by now a Malay word, but Malay themselves do not understand it.

    Kafir is translated as disbelief. Kafirun is an unbeliever. There is a Quranic chapter dedicated to unbelievers, and so religious pricks conveniently use this to term and verse to quote unbelievers, or simply anyone they do not like or do not agree. In other words, the religion is abused.

    Kafir is also relative. I am kafir to Amin Tan, but not to Abdul Aziz. I am kafir to one religious person, a siant to another.

    People are also kafir towards me, i.e. some people do not believe what i say. I however do not force or impose on them to believe me. If i tell them do not speed at Kesas Highway near Sri Petaling, and they choose to continue to label me as kafir and hence not to be believed, well then it’s their business.

    So do now worry kafirun Joshua Lopez, they can abuse religion and terms all they want, but God knows better. Their time will surely come, without fail.

  5. EQUALITY BEFORE THE LAW is never possible.Why? Human greed,pride and attachment arises when you are either in the ruling or opposition party. The ruling party will always have an upperhand as the government is in their control.Regime change only arises when the ruling party and government agencies have solidified as one entity like a mafia looting the nation wealth becomes wide spread.This is natures cycle of life . There is no freedom or democracy , only the cycle of life passing through good and hard times ; all b’cos of our own deluded desires.

    And of course this is rubbish. If you are into true science, you will be in awe of the power of God, or of the power of Nature, such that you would not do anything so stupid as to abuse the little power we are given. If you do not have that feeling in the study of science, it means you have not understood much at all.

    Pleasures in this world has nothing to do with God, it is in fact for us to appreciate life, to cope with life. Life is sacred. Malays are against hedonism, believing that it upsets God. I do not share this opinion.

    I think it upsets God more than we ignore nature, and live as if the purpose of life is merely to make money. We no longer see each other as humans, but objects of monetary or commercial gains.

    How we treat each other is a good measure of just how we Malaysians see each other. By the look of comments here on Tun’s blog, i live in constant fear in Malaysia. The level of hatred is extremely high. Can religion really diffuse this anger ? Is it not obvious to you it is actually the cause of this anger, amongst other reasons ?

    How do you propose to make everyone accept the life here-after theory ? And what about those who pretend to believe, for whatever reason ? Must we all subscribe to the same belief or religion, must all our heads be brain-washed until it is all the same ?

    Hence, we need a common law, a set of laws everyone will agree. Why is this logic so difficult to accept ? Is it because some people want special treatment ? Is it because we do not believe in equality ?

    What then do we really believe in ? Do we really believe God is unfair ? C’mon. There is surely something wrong with our belief system, but it seems no one is honest enough to admit it.

    mohon izin mengulas d.tan…..anda menyoal tentang pembakaran gereja di Malaysia sebagai cara menolak hujah saya mengenai toleransi yg amat tinggi Bangsa Melayu yg tidak kisah orang-orang asing seperti anda membini rumah-rumah ibadah mereka.

    bila gereja di bakar? kenapa? dan oleh siapa? Di Malaysia ini dan di seluruh Nusantara ini siapakah bangsa opportunist yg sentiasa berusaha men-sabotaj keamanan Negara?

    ketika isu penggunaan nama ‘Allah’ oleh umat kristian hangat di debatkan,masjid di lempar babi dan gereja di bakar.kalau kalau orang Melayu yg melakukan nya,ia dapat di fahami dan di maafkan sebab Penjajah Kristian sejak tahun 1511 hingga 1957 telah menimbulkan terlalu banyak dendam mendalam yg setiap satu nya cukup adil untuk men-justifikasi pembakaran walau Vatican sekalipun.

    There’s this new insensitivity which I find rather uncalled for whereby some self righteous pricks refer to non malays as ‘Kafir.’ It used to be ‘Pendatang’ but these words only came in the picture about 7 years now. Before, non malays were never referred with such derogatory words. They fail to realize that such words are absolutely unconstitutional. The Constitution and The Rule Of Law Is Above All. In the time of the Holy Prophet, he never referred to non believers as ‘Kafir’ and he never onced referred to Christians in such a manner. Infact, He was a very close friend of the Church & Clergy.

    1. I think Zul and Malays like him feel “tersepit” in between racial prejudice and progress. Thus his souts and screams.

    2. I think there is an element of truth to his dilemma. There are undeniably a certain sector, a certain group of people eager to make as much money as possible, and now wants political power to re-affirm their commitment to making money. These are the millionaires and multi-millionaires yang tak sedar diri. They do not really consider themsleves Malaysian, i doubt if they are even human.

    3. This group rapes our forest, destroys our ecosystem, steal our natural resources, laugh at our poverty, and then leave for greener pastures. Just because we remain as we are and watch our jungles grow does not mean they have the right to come and “develop” everything, chop every tree, pollute every river.

    4. And after that they say this is a bad land ? Was it bad when they came here ? I remember my old man used to fish for me, to feed the family. The same waters today hold no fish of any decent size, is pollluted and the stench is unbearable. We use to pluck “ulam” from the plants in secondary jungle, today they are palm oil estates and some are housing estates with prices none of us graduates can really afford, unless we cheat.

    5. If we wanted to cheat, we could have done so at school, at work, anywhere, because in this country one can cheat and get away easy. Thus we have an army of students with “excellent” results but unable to work, unable to handle even minor sophistication, because even teachers cheat, even governments cheat.

    6. Since we are on a march towards advancement, we need to be aware of this virus group out to benefit themselves only, pretending to support government. And the government is gullible enough to believe some of them. Maybe i am no supported of the government of the day, it does not mean i wish to rape this country.

    7. The government is weak in tackling these thugs, because Tun, lets not fool ourselves, money is powerful, a sack of ringgit notes is more powerful than a rocket propelled grenade. With RPG you can at least see bits of bones and meat left after the mess, with money you do not even see the victim, he will be “gone”.

    8. Actually i do not blame them for leaving the country, racism is so painful. Discrimination is sinful, positive discrimination has become negative and the government still plays the same song. But even if you want to leave for greener pastures, must you contaminate the land you are leaving ? Why not leave in peace. Better still, why not leave and then render help from outside, so that we can recover our beautiful land once again ?

    9. If we do not act, it is obvious development will take place at a pace no one can really govern, and our natural systems, our eco-system, our sanity even will all go down the drain. Because money can buy anything, even nations.

    So is there any equality in law? Pakatan say no. Kutu kutu pakatan say no. I also say no.

    So pakatan want to change that? Peliwat, mamat ngor dap racist, azmin si dayus, bar council president n x president want to change that so that the equality in law will happen? So that they can be charged and be found guilty as charged? Definitely not.

    So who will make this equality in law happen? No one i guess.

    I am just a humble and ordinary man. May be somebody can enlighten me regarding justise from this short simple scenerio:

    Mr house was robbed and I suffered RM100k loss. I reported the matter to the police resulting in the capture of a suspect who later was charged in court and found guilty. He was sent to the prison to serve his sentence. Here is the issue that make me wonder whether justice was served:
    1) Robber stayed in prison.. basically with free lodging & accommodation from the tax-payer money
    2) The prison complex was staff with warden, guards & others support personnel, also funded by tax-payer money
    3 ) Poor me as the victim, what do I have as compensation for my loss? Yet as a taxer-payer I am paying for the guilty person to have free “holiday”.
    Where is the justice? Can somebody enlighten me as I am at loss.//

    1-A very interesting situation.Looks like you have to lose more by trying to get justice isn’t it?

    2-If you choose to get his hands chopped,you need to pay for the salary of the hand chopper.After that this criminal cannot afford to do any job so his family will be qualified to receive Govt handout..and the taxpayer that includes you have to pay even more.

    3-Therefore if this is indeed a true case for you the only thing to console you , is please regard this lost as just a ‘test’ from your lord.

    4-Everybody in this world have lost one thing or the other .No one have been so fortunate as to be able not to lose anything.Eventually everybody will lose their lives..now how much is that worth?

    5-Is your lost of a hundred thousand much worse than the predicament of some parents who have been given three all handicapped children or children who are suffering terrible pain and there is nothing they can do?

    6-Or how is your lost worse off than those people who have lost their little children to kidnappers and still have not found them until today?

    7-A 100,000 divided by 200 months is only a lost of 5 hundred ringgit per month,surely that is not the end of the world is it?I am sure you can find a 500 per month for the next 16 years to get back your lost hundred thousand.

    8-As a Muslim you should say in the light of this terrible predicament that has befallen you “innalillah huawinaa ilahirojiun” i.e “from Allah we come to Allah we shall return”and surely we will be the ones who will receive guidance from our Lord.

    9-If we redha with this small test from Him insyaALlah He would recompensate us with much more in the hereafter if not in this world.

    10-What we should do is try to find out how did we lose this 100,000? Had we been guilty of negligent ourselves if yes how could we make sure we would not repeat similar mistake in future.let that lost of a hundred thousand make us gain in our wisdom instead.

    11-For as long we have not lost our spirit to live our lives and still have hopes for the future we have not really lost anything.

    12-You better believe it ,I am only talking from my personal experience .I have lost just as much cheated by an Ustaz before that is why I am quite confident to share with you this bit of wisdom and philosophy.

Bila kena tuduh meliwat pun masih boleh bergerak bebas ke sana-sini untuk memfitnah & memburukkan Kerajaan. Kalau orang lain yang dituduh meliwat, adakah mereka ini juga bebas seperti beliau? Setahu saya kalau di Barat pun orang yang menghadapi tuduhan jenayah sebegitu akan ditahan. Sekurang-kurangnya kita nampak juga yang hak orang biasa dijaga.

    2. In Malaysia, the opposition leaders/followers have all kinds of privileges. It is okay for them to be rich and corrupt because when they are accused of any wrongdoings, they can always accuse the Government of being biased and claim that all the allegations are false. Tapi Kerajaan masih juga di tuduh zalim terhadap mereka walaupun mereka bebas untuk mengumpul kekayaan di bawah Kerajaan BN, walaupun ada juga yang “corrupt”; malahan ada yang jauh lebih teruk dari pemimpin UMNO.

    I have several responses due. Seems to me people on your blog are beginning to form some kind of cartel against me. I must have said something right Tun. Here goes.

    6-That is why we need religion and why I have to disagree with middle ages who think that religion is a failed science.

    As i explained to Amin Tan, this is not my own opinion, but of an atheist in one blog. To a certain degree i agree, but not absolutely, because i note religion has worked to a certain degree, it has been after all one of the many ways humantity progressed.

    But it has serious side-effects, and especially when religion is wrongly preached and practiced, it is disasterous. And so it is to a certain extent a failed science. If we wish to continue to use it, we should i think honestly acknowledge its weaknesses and side effects, and dispense it very carefully indeed.

    The problem is even one with a bad and evil heart is allowed to preach religion, and some command huge followings because, well, religion is powerful. But the evil and sick heart is evident in their speeches, and the followers who are blind are then led astray. This is what happened to Islam. It has happened to Chrisitanity in the past. It is nothing new.

    And so i agree with Tun, in order to advance, we need to use good values or nilai2 murni, not religion per se. In order words, the derivatives of the religion, or the essense of it, is more important than the religion itself.

    Religious authorities in Malaysia do not understand this. That is why Tun has to say it, and he has said it. It is now up to the people in power to act upon it, and benefit from it.

    I honestly do not know what you are on about when you say i am angry and am attacking you, i am not in the least in attacking mood, if at all here is any attacking to be done my God-sent enemy in this blog is Amin Tan, and i dearly would like to try the Christain philosophy of “love thy enemy” on him.     With regards to my praise for LKY and Ghandi, i do not understand why your sudden outburst for my honouring my neighbour, you have to admit he has contributed significantly to Singapore.     sepuluh tahun kemudian,pokok besar hujung kampung,kerana terlalu ‘keramat’,berubah menjadi kuil besar yg tersergam indah lengkap berpagar sebagai lambang perisytiharan ‘we are here’.

    dan kita orang Melayu yg memang sensitive terhadap kejujuran orang lain hendak beribadah,kita pun buat tak kisah sebagai lambang toleransi.

    padahal berapa banyak tanah Kerajaan yg hilang melalui strategi penipuan begitu?

    sebab itu saya begitu tertarik sekali membaca komen d.tan yg bukan saja menyebar propaganda LKY malah turut mempamirkan sikap nya mengambil posisi disamping sesiapa saja yg memusuhi kita.benar atau salah bukan lagi panduan hidup bagi bangsa mereka.

I totally agreed with you Tun!The chances of those who are poor to win a case in court are nil.In a criminal case, those who are represented by lawyers from the legal aid bureau provided by the Bar Council may as well pleaded guilty to the charges to save his/her time.To the lawyers (the stupid ones as you mention) why bothers to defence the poor when being paid with a paltry sum of monies? Injustice will always happen and the rich will always prevail.

    The Rule Of Law should remain independent for all and not be tainted by religion, culture and politics. The Law is meant to protect everyone irrespective of background, religion, culture and political divide.

    By Common Law i mean a set of laws applicable to all, not only a certain group, religion, or social status. I am not referring to any “Commonwealth” Laws, there is no need for us to look at others. But there is a need to stop religious nuts from ruling our beloved nation while my “non-muslim” friends laugh their head off.

    That is what i mean by common law, a set of Malaysian laws applicable to all Malaysians, as what the rule of law ought to be.

    I do not know if this is at all possible in my lifetime, given the religious madness that prevail in this country, but it would be a lie if i said i do not hope for a common law. One must always have hope, no matter what.

    So i hope someone can put a stop to the sheer unfairness and inequality before the law as explained in a censored version by Tun. I think Tun had been very economic with words. I am not so charitable with my comments i know, but then i am at the bottom most of the food chain.

    What is democracy? What is “the law” ? They are all man-made and all man-made things are made and designed to benefit the designer, its allies or a section of society. The only true law that our creator (GOD) given to us (HUMAN) is conceal in our heart and mind on the day we are born or conceive. The law is called “GUILT” all other man-made laws cannot be fair. Look at the laws in Malaysia it is designed to benefit a section of the people only and they are the elite group. Who are the elite group? They are the people that can influence the law-makers or elected representative or the Govt.
    So Tun whenever someone tried to tell to the world how holy, righteous or fair they are, the more we should be careful with these types of people. Why, because human cannot be fair or right or wrong as we were given something called “brain” and “mind” by our creator. With intelligences comes opinion, good or bad thoughts and greed or just simple “want”. To be fair or democratic is to be able to stand on your opponent side and understand their opinion and their grouses. In the case of the King of Democracy “ The US of A” they only think about themselves and how to use the word “Democracy” to benefit and enrich themselves. Look that their latest project, after wasting, killing, destroying and taking the wealth of middle-east countries and its people they are now looking and targeting Asia and South China Sea. Why? MONEY NOT DEMOCRACY

    as despotic system run by the rich and powerful. An
    Islam o-Socialist argument commonly used to paint a
    wide brush of Western Nations while trying to equivocate
    War Deaths in-defense of a nation or protecting citizens

    Pogroms (Jews,Armenians,Sudanese,Coptics etc) as a common

    I have always wondered why your comments on the 1969 riots
    are so vulgar as to explain the slaughtering of Chinese
    as being a Chinese problem. It seems to me that is how
    you can be so quiet as to Assad’s Butchery of his peoples
    in Syria. I feel very nauseated whenever i see the news
    on media on how Self-Righteous Islamic Nations do nothing.

    I think the reason you think of Democracy in that manner
    is because of what is commonly practiced in Malaysia. Namely
    Privilege, Aristocracy, and Corruption. That is the Democracy
    Malaysia practices. Affirmative Action of the Majority,
    Privilege of Royalty, and the Corruption of Government Officials.

    1-There will never be justice in this world no matter how much we can try to deliver.The great stumbling block to justice is power and its temptations.

    2-Power corrupts and absolute power corrupts absolutely.While you were the PM of Malaysia your heart is only in Langkawi.I don’t blame you we all follow our hearts.Just to prove a point.

    3-The best chance ever of achieving justice is when the guy at the top is really fearing God and understand that all the power , little or absolute is only lent to Him with great responsibility and not to be abused.

    4-In other words whoever is in charge of the nation either Pakatan or Barisan will not make a difference unless he has real taqwa..which is indeed something nobody will know who has it because it is hidden in the heart.

    5-You can’t tell it from his beard because even the goat has it.You can’t tell it from his oratory skills because most talkers are liars.

    6-That is why we need religion and why I have to disagree with middle ages who think that religion is a failed science.

    7-True science cannot deliver a man who would not succumb to the temptations of power.In fact the more he believes that there is no hereafter that is when he is going to ‘here after’ all the pleasures the world and his powers can deliver.

    8-Only when you believe that true justice shall prevail in the end on that great Day of Judgement will there be recourse and peace in your hearts immaterial for those who have been unjustly treated in this world.

    I am just a humble and ordinary man. May be somebody can enlighten me regarding justise from this short simple scenerio:

    Mr house was robbed and I suffered RM100k loss. I reported the matter to the police resulting in the capture of a suspect who later was charged in court and found guilty. He was sent to the prison to serve his sentence. Here is the issue that make me wonder whether justice was served:
    1) Robber stayed in prison.. basically with free lodging & accommodation from the tax-payer money
    2) The prison complex was staff with warden, guards & others support personnel, also funded by tax-payer money
    3 ) Poor me as the victim, what do I have as compensation for my loss? Yet as a taxer-payer I am paying for the guilty person to have free “holiday”.
    Where is the justice? Can somebody enlighten me as I am at loss.

    Sorry, maybe I am out of topic.

    The law can never be equal in Malaysia as long as umNO is in power. Even when you were brought to court to testify, you forget and no judge dared to question that. Its no wonder that you are not afraid if LKS were to open whatever files he needed to and charge you in court for “some” of your misdeeds. As it is, a small time criminal is given a maximum sentence for stealing RM50 but an umNO politician gets off scot free for squandering millions or even billions. Thats the equality of the law in Malaysia. Malaysia boleh…..

The opposition(Pakatan Rakyat), when they are clever enough to promise a variety of freedoms, can do no wrong even when they use violence to provoke the police into so-called acts of brutality(BERSEH 3).

If you are a favourite candidate(ANWAR IBRAHIM) of foreign powers for regime change, you can do what you like, and any Governmental action against you would be labelled as uncalled for oppression. If an election is near and the favourite is going to be a candidate and bring about regime change, then Government action against this privileged person(ANWAR IBRAHIM) would be regarded as attempts to undermine his chances of overthrowing the Government.

    11. That the favourite(ANWAR IBRAHIM MAKING USE OF AMBIGA AND SAMAD) purposely timed his violence just when elections are near would be ignored. That the provocation of the police is deliberate and meant to elicit “police brutality’” will also be ignored. That the police are beaten up, that police cars have their glass windshields smashed and the police car is overturned in full view of TV cameras – all these are inconsequential.

    12. The main thing is the action against the favoured opposition(PAKATAN RAKYAT MEANING EVIL COLLUSION OF POLITICIANS MAKING USE OF SIMPLE MINDED CITIZENS) by the Government will be deemed political rather than an exercise in legal equality by the Government.

    13. The clamour is for the police to be charged for crimes against the people. Actions by the police to enforce the law must not be allowed. These must be regarded as criminal acts.(THIS IS CALLED THE DICTATORSHIP OF THE PROLETARIAT OR DOWN TRODEN-communist lingo)

    I cannot agree with you more on your comments on equality before the law.

    Perchance I sued some Defendants who were Trustees for libel and slander in a foreign country. They had hi-jacked an important Malaysian Trust out of jurisdiciton. I won when the the law was not meddled with. I had full trust in my legal eagle lawyer and we went further. Little did I know that there was one set of laws outside the courts and another inside. The creation of meritocracy I presumed. Of course, I lost on all counts.

    This solidly confirms that the Malaysian courts are more than fair in the grand tradition of justice.

    Your comments can be confirmed by my Suits against the same group of Defendants who employed the biggest and most expensive legal firm in the country. They were able to delay my Suits for 9 years and spent RM 1.8 Million of Trust money. I won and in frustration a Defendant spitted out an expletive at the Judge in Chambers !

    I was happy that true Malaysian justice won that day !

    The political twisters and spinners will do their utmost masterworks at every turn on your true and fair comments. It is only part of a multi-billion ringgits industry which has been so created by the very rich politicians which became very rich somehow.

    It is time that all Malaysians are educated by the fact that Putrajaya is not the Bastille.

    Should we blame the opposition when there is no equality before the law in Malaysia?

    Is the opposition responsible for any inequality before the law in Malaysia?

    Should we blame the opposition when the government do not have smart, brilliant, fearsome, reputable prosecutors and lawyers?

    Should we blame the opposition if the government has only the ordinary run-of-the-mill prosecutors and lawyers?

    Should we blame the opposition if the judges scared with smart, brilliant, fearsome, reputable lawyers?

    Or should we blame the government for not hiring competent prosecutors and judges?, for having judges who are scared with Karpal Singh?

    A court case is about providing justice to both parties, the defendant and prosecutor. The most important factor is to have a smart and a fair judge. It is difficult for a smart, reputable, expensive lawyer to outsmart a judge that is smart and fair.

    Do we have smart judges when Khir Toyo was sent for a year in prison for a RM 3 million graft? (RM 6.5 mil – RM 3.5 mil)

    Do we have smart judges when a person who stole 5 pairs of shoes was sent into prison for a year?

    Why both of them were sentenced to a year jail when the cost of the 5 pairs of shoes were obviously not RM 3 million?

    Our courts and judges FAILED to uphold justice when they (the judges) sentenced a person for a year in prison for stealing a RM 100 jersey but also sentenced Khir Toyo for a year in jail for a RM 3 million graft.

    Maybe there is something wrong with our law when RM 3 million has the same value as RM 100.

    The responsibility to uphold justice is on the government, not on the opposition.

    The only party to be blame when justice is not been uphold is the government.

    I would like to comment on point no. 8 is regarding the war criminal Bush and his associates. The Kuala Lumpur War Criminal Tribunal have found Bush and associates guilty of torture. What makes this a significant historic event is that 1) it is the first to have found a former president of a powerful country guilty of war crimes and 2) the tragedy is one of the most horrific event in the modern times where a president lied to go to war which killed hundred of thousands of innocent afghans and Iraqis. The Afghans and Iraqis till this day are suffering from the effects from the war i.e daily suicide bombings, death of loved ones, trauma, etc. They were promised once Saddam and the Taliban were removed they would have everlasting peace. Have they got the peace promised to them?

    Because this is a historic event, of finding Bush and associates guilty in a court of law, I would expect the international media to highlight this. If the tribunal is wrong in giving out the guilty, then prove it. Prove that Bush and associates are innocent.

    This is your chance (i.e the elite so called developed world) to humiliate Malaysia that Malaysia does not know how to conduct a proper court verdict). You can do this by highlighting this far and wide around the world about the tribunal findings and then debunked it to show how silly Malaysia is.

    But what happened in the international media? Total blackout! Such a significant historical event and no one in the international media reported it.

    The international media always portray itself of report news with bias or favoring anyone. Clearly by not reporting this, the international media is favoring Bush and associates.

    From this findings, we can say what we have already known all this while. The international media is being controlled by an elite group of people! I believe this elite people are the real puppet masters in the staged wars and Bush is merely the puppet doing their bidding.

    Looking from a strategic point of view, why would they want to protect Bush? Bush have already served his purpose. It is to their advantage if Bush takes the blame and reduces the angry of the international community for wars based on false presences.

    Let Bush become the fall guy.

    3. I will deal with those who do not benefit first. The democratic legal system gives the power to the courts to decide on disputes between individuals or organisations. The courts are presided over by legally qualified but very human judges. The contestants have to convince the presiding judge of their innocence.

    Isn’t your above conclusion a fundamentally ill-lead thought? Or Is Malaysian Law so fundamentally different from the Law in other democracies I know? There “the contestants DO NOT have to convince the presiding judge of their innocence”, rather it is the accusing party who has to prove that the contestants are guilty!

    Guilt must be proven – not innocence! Innocence is assumed.

    Under all democracies I know the Assumption of Innocence prevails under their Laws and before their Courts.

    Is this really different in Malaysia?

    Well, you were PM for 22 years and UMNO/BN have been in power as Government since independence in 1957 i.e. for 55 contimuous years.

    What prevented you, and now PM Najib and UMNO/BN from tabling and introducing “unbiased and more equitable laws”?

    This is the biggest cop out I have heard for some time, when due to incompetence and epidemic proportions corruption, UMNO/BN is in clear and present danger of being consigned to the footnotes of history books after GE 13!!

    1. I remember the quotes of two great leaders, both of whom studied law, Lee Kuan Yew and Mahatma Ghandi. In their biographies, both said something like ” if you want justice, settle your settle disputes out of court. “.

    2. I believe in learning from elders, especially from great people. I never went to court, at least not out of my own doing. I mean , just look at what they did to D.S. Anuar.

    3. I think the court system is simply to give lawyers jobs. It’s no wonder in Mr Bean’s comic sketch, lawyers are put in the same group of thieves and looters ready to be burnt in eternal hell.

    4. I think Bill Gates said it best. “Life is not fair, get used to it”.
