SUING IN COURT

1. Malaysian politics of today is frequently punctuated with court actions. In particular there are now a lot of litigation cases. And the amounts sued for invariably run into millions of Ringgit.

2. Despite the efforts of the learned judges there are still huge backlogs of cases of all kinds, civil and criminal, which probably will never be heard, much less adjudged. This is because the hearings take such a long time that the parties to the cases would have forgotten the facts or they would have died.

3. And, as they say, “justice delayed is justice denied”.

4. The litigations by politicians may be justified. But politicians must accept that as politicians they would be bad-mouthed by their opponents. It is up to them to counter the allegations made. They should not always be suing in court.

5. For Muslims they should be willing to swear properly that there is no truth to the allegations.

6. Often the litigation is intended to shut the mouths of their opponents. In Malaysia when a case is being heard in a court, it becomes sub-judice and comments outside can constitute “contempt of court”. By suing the matter becomes sub-judice and the opponents’ mouths would be shut. Through repeated appeals the case can be prolonged and the defendants’ mouths would remain shut to the advantage of the litigant for years.

7. For the person sued, much money would have to be spent on lawyers. For years he would be assailed with anxiety that he might be found guilty and if he is unable to pay he may be bankrupted.

8. Yet when the defendant wins, the litigant may need to pay cost only, which the court will fix. Often the amount would be a minute fraction of the amount he is sued for.

9. Because the cost to the litigant is so very little, the tendency is to sue for millions. This is grossly unfair to the defendants. If the law is intended to promote justice then the litigant should also suffer from the same anxieties for the length of time of the hearing and if his allegation is baseless he should pay his victim the same amount he sued for.

10. Then there would be justice and frivolous cases would not be brought before the courts. The judges would then have time for their other cases.

11. Incidentally I was sued for 100 million Ringgit. When after almost five years I won, I was awarded cost at 70 thousand Ringgit, which of course go to my lawyers.

  1. Point 9, paying for the distress caused to the defendant, is a more robust way of acting as a disincentive to those who bring about such suits than my earlier suggestion that they pay for the cost of goverment time and expense.

    Govt costs can become expensive if we benchmark pay against private sector, and if the private sector is dominated by the Govt, reinforcing each other’s fictions. China seems to have kept the two distinct, allowing anomalies in each sector to subsist and resolve themselves over time (decades if not generations).

    We have to accept the fact that there is no real justice in this world. Men are not perfect so are the laws they designed. Based on the current system, POWER is usually right. If you have money you can engage a good lawyer who have skill to create doubt/s in the case and the case will be dismissed. As the result, one can get away with even murder.

    But for the believers ( BERIMAN ) nobody will be able to escape of their crime during the Judgement Day.

    I am not a lawyer neither have good knowledge in laws, but I think Syaiful has a better chance to bring the case to a civil court. By this way, the case cannot be greatly politised by DSAI and even an out settlement can possibily be negotiated.

    Unfortunately this is how the justice is executed in the present world system and the best there is.

    DSAI dakwa beliau dibebaskan oleh mahkhamah atas desakan kuasa-kuasa asing yang sudah tentunya AS.Ini adalah pengakuan spontan yang menggambarkan beliau adalah proksi AS yang selama ini dinafikan oleh nya walaupun diketahui umum beliau memang.

    YB Karpal Singh cuba meredakan keadaan dengan mengatakan mahkamah bertindak atas keraguan munasabah yang beliau usahakan bersama barisan pembela.

    Saya tidak meragukan tindakan mahkamah melepaskan DSAI kerana mahkamah bebas membuat keputusan tanpa tekanan dari pihak dalaman mahupun luaran.

    Saya hanya ingin menyentuh tentang tiada tindakan kepada pencetus-pencetus provokasi terhadap kerajaan mahupun suara majoriti rakyat keseluruhannya seperti Namewee dengan Negarakuku, Ambiga dengan Bersihnya, En Mat Sabu dengan kenyataan polis adalah talibarut British dan terbaru Perhimpunan 901 dimana beribu laporan polis telah di buat oleh rakyat termasuk dan NGO.

    Tiada tindakan terhadap isu-isu berkaitan seolah menggambarkan pihak berkuasa memang ditekan oleh pihak asing atau cuba mendapatkan pujian dari media-media asing yang memangnya proksi kuasa besar AS.Tindakan hanya akan dapat liputan buruk media antarabangsa.

    Pembatalan pembinaan jambatan bengkok juga mungkin akibat tekanan pihak luar tidak termasuk Singapura yang sememang tidak bersetuju. Permintaan agar pembinaan jambatan tersebut diteruskan oleh kebawah DYMM Sultan Johor pun masih belum dipertimbangkan hingga kehari ini.

    Memang kerajaan sekarang tiada majoriti 2/3 untuk lebih berkesan dan “affirmative” namun tiada tindakan atau kenyataan yang meyakinkan rakyat dari pimpinan kerajaan,Umno dan Barisan akan menghakis keyakinan majoriti senyap atas pagar.

    Pimpinan Umno masih belum berubah, semasa PA Umno hanya calon boleh menang akan diketengahkan namun tiada seorang pun Menteri dan Ketua Bahagian yang telah lama menjawat jawatan dengan secara sukarela membuat kenyataan media memberi laluan kepada calon muda dan berkemampuan.Malah telah ada ugutan untuk menyertai pembangkang sekiranya tidak dicalonkan.Mereka inilah yang dikatakan oleh En Mat Sabu orang dalaman BN yang akan menyokong pembangkang.

    Sekiranya tiada tindakan drastik yang menampakan perubahan, undi protes akan berlaku lagi tetapi bukan kepada pembangkang sebab mereka menyesal melakukannya pada PRU 12 tetapi dikhuatiri peratus undi rosak akan meningkat atau peratus keluar mengundi akan merosot.

    A good and responsible politician, or even a reasonably qualified one, should be able to explain and counter any bad-mouthing by his opponent or by any party/individual that show dislike towards him. It reflects his maturity and also his capability when handling situations.

    This Anwar maniac neither has political maturity nor capability.

    One of the two “anugerah Tuhan” that are clearly bestowed upon him, that is his ability as a commendable orator (the other being raja seks), he uses it to the utmost by ensuring that there is no competition for that elusive title of ‘king liar’. He has proven his worthiness and shrewdness over a long period in ensuring the title of ‘raja bohong’ is his alone for the taking!

    By looking at his plentiful and very taksub “I can fool them all of the time” supporters which included many Chinese & Indians, he certainly has proved to everyone and to himself as a most deserving winner!!

    1. Today we are relying on DNA evidences. That is the knowledge we have now. We are so certain on what we know that we tend to set aside the religious requirement on four witnesses.

    2. We need to remind ourselves that God knows best. And He is the best judge. Therefore, whenever in doubt, it is best not to punish the accused.

    3. God can forgive whoever He wants to forgive. Let us not be quick in punishing people for what we do may actually be wrong.

    Saya setuju dengan saranan Tun. Mereka yang menyaman orang lain dengan amaun yang tidak munasabah mesti MEMBAYAR DENDA yang sama banyak dengan jumlah saman jika kalah, malahan kena bayar lebih lagi untuk menampung KOS GUAMAN dan TEKANAN/KESENGSARAAN dari segi mental/fizikal yang dihadapi orang yang disaman.

    Ini belum termasuk jumlah masa dan tenaga mahkamah dan pihak di saman yang banyak terbuang. Lagipun niat untuk menutup mulut pihak lawan sudah pun tercapai & ini juga mesti diambil kira dalam pengiraan denda/kos yang patut dikenakan.

    Dalam kes Tun, kalau setakat RM70,000 saja denda yang dikenakan terhadap Anwar Ibrahim, memang TIDAK ADIL.

Tidak ada kah yang terfikir bahwa keputusan hakim untuk melepaskan Anwar Ibrahim mungkin disebabkan hakim sendiri mendapat ugutan dan tekanan dari rakan rakan Anwar Ibrahim diluar negara yang kita tahu bukan calang calang orang tapi dari kalangan kuasa kuasa ‘besar’ dunia dan bukan kerajaan yang mendapat tekanan.

    Walau apa pun sebagai orang Islam, kita harus yakin bahwa tidak ada siapa yang dapat menahan qadaq dan qadar Allah. Manusia merancang tapi Allah yang menentukan. Kita juga harus yakin bahwa setiap ketentuan Allah itu ada hikmah disebaliknya.

    a. Kebohongan 16 SEPT 2008. Satu dunia tahui, sebenarnya….
    b. Kebohongan bahawa Jam OMEGA ada pada Wan Azizah, DSAI kata dengan penuh spontan di depan kamera: Jam saya ada dengan Kak Wan. Mana jam tu sebenarnya??????? Tunjuklaaaa….
    c. Kebohongan bahawa ada orang nak bunuh DSAI. Tak mati-mati pun…… konon ada snipers nak tembak sampai lari pi Kedutaan Turki, konon kereta Mercedes kena sabotaj brek, konon separuh mati kena sembur gas masa BERSIH, banyak lah kes-kes dia ni nak kena bunuh. Ish… lemaih sungguh yang sorang ni.

    4. Yang di atas hanyalah 3 daripada apa yang kita semua tahu tentang DSAI ni. Bukan asing kepada kita semua.

  16. Dear Tun,

    Apparently technicalities decide the final judgment. Students of law now learn how to focus on technicalities, on any little thing that can be a source of doubt. That apparently is how the laws of justice seem to work. So lawyers emphasise on doubts – was it his semen? How was the DNA analyses conducted? Was the DNA analyst qualified? Was he/she in the sound of mind when doing the analyses? Was the DNA sample contaminated? One slight doubt then the defendant is not guilty.

    And so the Banting murder case may take similar recourse.

    The 9th. January 2012 judgement should be included into the curriculum at law schools in this country, as a case most unlikely to happen again to any one else in our life time, probably in the whole democratic world, assuming the so-called foreign pressure on the Malaysian Government is joke.

    And as for lawyers, it is very difficult to find one who is not after the money. Is there any lawyers left who fights for real justice to the victim? Is any there any one left in this country who fights for the little man who is a nobody? It seems to me might is right. You got lots of money, connections to international media, you can move crowds, you can create a scenario of being victimised and a victim of conspiracy, you can win the case.

    As for anyone in the position of DSAI, there are a few other things that can be done to boost the image:

    1. Get sick, or pretend to be sick, get hospitalized in a foreign country, and accuse someone (opponent of yours) of attempted poisoning, or give that impression.
    2. Get into an accident, or create one, and claim attempted accidental death.
    3. Run away into the Embassy of a country you are friendly with. This gives the impression someone is coming to get you. It works.
    4. Get into another sodomy case, and claim conspiracy, it seems to work favourably.

    All the above can work, I strongly believe, for as long as the lady keeps buying another ten or twenty million dollar diamond ring, bracelets, shoes and handbags, for as long as the national economy is sick, and as long as the UMNO fellows continue playing golf 24/7 and enjoying themselves and don’t come down to earth.

    Pada pendapat sebahagian penyokong-penyokong tegar DSAI seperti yang disiarkan melalui akhbar harian, isu liwat beliau telahpun selesai dan satu kemenangan bagi Pakatan Rakyat.
    Kita menghormati keputusan hakim mahkamah terhadap kes liwat DSAI kerana tidak cukup bukti selain dari DNA yang diragui mungkin telah tercemar. Jika tidak silap pemafahaman saya mahkamah tidak menyatakan bahawa perlakuan liwat itu tidak berlaku, tetapi keputusan dibuat berasaskan kepada masalah teknikal sahaja (tak cukup bukti nak sabitkan kesalahan). Mahkamah sudah tentu perlukan bukti tambahan yang boleh menyokong bukti DNA.

    Institusi perundangan perlulah mengambil kira dengan mengubahsuai kepada keperluan ujian DNA diwajibkan kepada
    seseorang yang dituduh melakukan sesuatu kesalahan jenayah
    termasuk kes rogol dan liwat. Disamping itu saksi dan yang dituduh diwajibkan mengangkat sumpah terlebih dahulu sebelum membuat sebarang kenyataan di mahkamah. Jika kedua-dua perkara tersebut diatas (DNA dan angkat sumpah) tidak diwajibkan semasa prosiding di mahkamah, kemungkin ada pihak-pihak tertentu mengambil kesempatan berbuat demikian (enggan beri DNA dan bersumpah), dan ini telahpun berlaku. Dimasa-masa akan datang sudah barang tentu ada pihak-pihak yang didakwa di mahmakah atas sebarang kesalahan akan mengikut rentak yang sama enggan beri DNA dan bersumpah apabila diperlukan, dan ini akan menjadi trend baru dan boleh menyulitkan keputusan di mahkamah. Walau bagaimanapun terserahlah kepada institusi perundangan negara yang lebih bijak dan arif mengambil pertimbangan terhadap isu kewajipan DNA dan bersumpah di mahkamah.

    Isu Majlis Peguam menyarankan supaya Peguam Negara tidak membuat rayuan terhadap keputusan mahkamah kes liwat DSAI juga menjadi tanda-tanya, apakah motif sebenarnya? Mohd Saiful Bukhari Azlan tidak sepatutnya disekat oleh mana-mana pihak dari meneruskan usahanya menuntut keadilan bagi dirinya mengikut peruntukan undang-undang yang diamalkan di Malaysia. Jika DSAI didapati bersalah sekalipun sudah barang tentu barisan peguambelanya akan mengemukakan rayuan diperingkat mahkamah yang lebih tinggi bersesuaian dengan undang-undang sedia ada. Setiap individu berhak mendapatkan keadilan tanpa mengambil kira kedudukan sosial seseorang samaada rakyat biasa, orang kenamaan, orang berkedudukan tinggi, pemimpin atau ahli politik tertentu.

    Mohd Saiful Bukhari Azlan amat perlu diberi bantuan oleh barisan pendakwaan yang akan mengemukakan rayuan di peringkat mahkamah yang lebih tinggi. Sebagai rakyat biasa Mohd Saiful Bukhari Azlan juga mungkin perlu dibantu dari segi kekurangan-kekurangan tertentu oleh individu atau organisasi tertentu yang mahu melihat keadilan dapat ditegakkan sepenuh dan sejelas-jelasnya.

    YB Karpal Singh ketua barisan peguambela dalam kes liwat DSAI mungkin sedikit terkilan kerana tidak menerima pengiktirafan secara jelas oleh DSAI, sebaliknya DSAI membuat kenyataan mahkamah membuat keputusan melepas dan membebaskan kes liwatnya oleh kerana menerima tekanan dari luar negara dan takut imej negara Malaysia akan terjejas. Kenyataan DSAI itu telah disangkal oleh YB Karpal Singh, jerit perih YB Karpal Singh dan barisan peguam yang lain seperti tidak dihargai sepenuhnya.

    Pilihanraya Umum ke 13 akan diadakan mungkin tidak beberapa lagi sebelum tamat tempoh pada bulan April tahun 2013. UMNO dan Barisan Nasional diharap tidak terjejas oleh isu keputusan mahkamah melepas dan membebaskan DSAI dari tuduhan kes liwatnya. Dari awal lagi kes liwat DSAI bukan kes politik, tetapi merupakan kes peribadi. Cuma DSAI dari awal kes liwatnya telahpun mempolitikkannya dan mengheret rakyat untuk menyokongnya, termasuk membawa kes dijalanan. Ambil contoh terbaik kes rasuh YB Dr. Khir Toyo bekas Menteri Besar Selangor dan lain-lain pemimpin yang pernah menghadapi tuduhan di mahkamah tidak menjadikan isu peribadi mereka dipolitikkan dan tidak mengheret rakyat dan penyokong mereka sampai berdemonstrasi di jalan raya. Kita perlukan pemimpin samada kerajaan atau pembangkang yang benar-benar berintegriti tinggi, lebih-lebih lagi pemimpin beragama Islam yang sudah ada tersedia garis panduan mengikut syariat Islam dan Nabi Muhammad s.a.w sebagai contoh utama yang perlu diikuti. Pas yang melabelkan parti mereka sebagai Islam dan lebih Islam dari parti Melayu lain khususnya UMNO seharusnya berkelakuan sebenar seperti pemimpin Islam, bukan seperti contoh-contoh yang ditunjukkan oleh kalangan pemimpin Pas pada hari ini yang kelihatan jauh menyimpang dari sifat-sifat kepimpinan Islam sebenar.

    Pada pilihanraya Umum ke 13 nanti kita harus bijak memilih diantara kaca dan intan, demi kelangsungan kesejahteraan agama Islam, Raja Berpelembagaan, bangsa Malaysia dan kemajuan negara yang telah sedia sejahtera dan maju.

    My narrative was a factual account of my own experience with my family Trust through the Courts of Law in Kuala Lumpur. In fact, I left out much more about the events like my own lawyer asked me to drop the Suit a few minutes before the Court of Appeal heard my Appeal which I won. I told him that I waited a life-time for this.

    If Kuala Lumpur is to be a heavy-weight international financial centre which deals with a myriad of trusts and trustees every day, it pays to be serious when we handle the monies of the international community when claims and counter-claims are made ever so often. These world citizens cannot wait 9 years. Maybe, Malaysia should look into setting-up a Court to handle this specialised part of the laws.

    For your information, the Government appointed me as a Trustee to the Board of the Employees Provident Fund (EPF) when I was 32 years old. I have always commented in the interest of the Nation and its citizens, never for myself a whole lifetime !

    Thus, his comment if Kuala Lumpur aspires to be an international financial centre, the Malaysian Judiciary has to be up to the mark for the sake of the Nation and its wherewithal is way off the mark. Which country is up to the mark? USA? UK? Germany? Japan? China? Russia? France? India? In all cases, commercial and crime?

    One man’s meat another man’s poison, is not really a consolation is it? What was the satisfaction did he derived but must commensurate with with his right niat and course of action: he was right and it was proven the Trust lost money.

    I watch video on Tien Chua making speeches at the car park near the High Court where Anwar Ibrahim was waiting to hear the verdict on 9 Jan. Clearly he was the center of attraction. His starting speech was “yang paling jahat ialah Mahathir, Datuk Seri Najib…

    He was cheered on by the unruly crowd and he was holding a hailer when he spoke. He was seen to be surrounded by fierce looking crew cut big size Malay body guards numbering 3 or 4 persons or may be more. He spoke in very good Malay without any Chinese accent. He is the current vice president of Keadilan(PKR). This video is easily available in the internet by google search “video on Tien Chua”. The opposition calls it ‘peaceful’ demonstration.

    Why should the home ministry or the police allow such street provocations, disrespectful verbal abuse and bad mouthing of our former Prime Minister, our beloved Ayahanda Tun Dr Mahathir and our sitting Prme Minister of the day. He should have been arrested and charge in court for sedition or encouraging the people to hate our leaders who have been legally elected by popular vote.

    But, I sense the government does not want confrontation and try to avoid any controversy at all costs. So, the opposition will be emboldened and encouraged to continue to abuse the government leadership without any basis whatsoever.

    I am not a litigant nor a defendant but I am what you may call as one of the silent majority.
    We do not condone street demos but we do act behind the scenes to make things work and run smoothly.

    A lot of things can be said of our legal and judicial systems but I’ll summarize it all to just say that our justice system is not balanced.

    How does one account for the victim being victimized and the perpetrator glamorized by his supporters and certain foreign parties ?
    How does one account for a case to be prolonged unnecessarily at tax payers’ expense ?
    How does one account where a case, sodomy, khalwat or rape, which involved only the victim and the perpetrator, was dismissed due to no other [qualified] witnesses ?
    Like in the 22 years with Tun, our executive branch must continue to be firm and strong to lead our country for our future.

    After reading your article, I couldn’t help but wonder whether this is a “trick article” if there is such a word for it. Something like in the Sherlock Holmes mysteries where items or objects have double meaning. In this case, the theme of the article is “court” and the current issue regarding “court” is Dato’ Seri Anwar’s case. I may be wrong but I’m sure other commentors are bound to talk about Dato’ Seri Anwar’ case when reading this article.

    My take on Dato’ Seri Anwar’s case is first and foremost is the case is between an accuser, accusing another person sodomising him. In Malaysia, sodomy is against the law. It just so happens the one being accused is a top opposition leader. In no way, was there any shred of evidence that it was the government led by Dato’ Seri Najib was involved in this case.

    In yet, when I read newspapers commentaries and blogs, they are saying why the government waste time and effort to prosecute DSAI. They are saying government should be more focused dealing with the economy, inflation, jobs, etc.

    Do they not see that the government is doing just that developing KPIs, embarking on the Government and Economic Transformation programs?

    It is amazing how in Malaysia, a muslim country, one would think if someone were to even been accused of sodomy, then he would be looked down upon. Instead, the accused actually benefited from the case and seen as a hero, and the government was blamed as the villain, even though there was no proof the government was involved in the case.

    I guess that is Malaysian politics nowadays. People believe what they want to believe.

    Congratulations Dato’ Seri Anwar for being able to turn the case to your advantage.

    Just like when a person wants to buy a house worth rm200,000. He pays deposit of 10%. If for some reasons he does not want to proceed with the purchase, he has to forgo his deposit. Conversely, the seller has to compensate 10% if for some reasons he does not want to sell the house.

    The unwillingness of a muslim to swear by the Quran in a mosque on his innocence, speaks for itself.

    You save the country,Tun. You have contributed so much for the country.

    Izinkan saya menyentuh serba sedikit isu perbicaraan DSAI yang dituduh meliwat bekas pembantu khasnya Mohd Saiful Bukhari Azlan, dan berkesudahan Yang Arif Hakim melepas dan membebaskan DSAI dari pertuduhan tersebut, kerana tidak cukup bukti kukuh dan mahkamah tidak bolehhanya bergantung kepada DNA semata-mata tanpa bukti sokongan yang lain, sepertimana yang difahami. Sebagai rakyat Malaysia yang mempunyai jati diri, menghormati perlembagaan dan undang-undang negara, kita seharusnya akur dengan keputusan Yang Arif Hakim sebagai mengormati keluruhan undang-undang yang diamalkan di Malaysia. Walau bagaimanapun mungkin masih ramai lagi masyarakat dan rakyat Malaysia yang mengikuti perkembangan isu liwat DSAI ini masih tidak faham sepenuhnya dari sudut penghakiman di mahkamah, maka golongan ini perlu mendapat penjelasan yang lebih terperinci dari pihak yang berkenaan supaya tidak timbul persepsi yang boleh dianggap menghina mahkamah.

    DSAI mendakwa keputusan mahkamah atas pertuduhan liwat nya kerana mendapat tekanan dari pihak luar negara dan kerajaan terpaksa menjaga imejnya. Malah sepanjang prosiding di mahkamah DSAI telah dengan sewenang-wenangnya di luar negara mendakwa institusi kehakliman di Malaysia tidak bebas dan di bawah pengaruh kerajaan yang memerintah. Selepas hakim yang membuat keputusan, ternyata dakwaan DSAI tidak benar, rakan sekongkol politiknya DAP dan Pas mengeluarkan kenyataan bahawa institusi kehakiman telah bertindak adil. Pengerusi DAP YB Karpal Singh sendiri menyanggah dakwaan DSAI bahawa keputusan mahkamah terhadap isu liwatnya bukan disebabkan tekanan dari luar. Sepatuntnya DSAI mengeluarkan kenyataan terbuka berterima kasih dan menghargai kewibawaan kumpulan peguambelanya yang diketuai oleh YB Karpal Singh.

    Pakatan Pembangkang (Pas, DAP dan PKR) sudah terperangkap dengan dakwaan mereka selama ini terhadap kewibawaan institusi kehakiman di Malaysia yang dikatakan tidak berwibawa dan dipengaruhi oleh kerajaan Barisan Nasional. Sebenarnya semenjak dari dahulu lagi institusi kehakiman di Malaysia memang bebas dari unsur campur tangan mana-mana pihak termasuk kerajaan. Apapun inilah sifat-sifat dan perlakuan pembangkang yang sentiasa mencari ruang untuk menjejaskan imej kerajaan Barisan Nasional. Majoriti rakyat Malaysia diyakini tidak akan begitu mudah dipengaruhi oleh pembangkang untuk menyokong perjuangan politik songsang mereka.

    Mohd Saiful Bukhari Azlan dalam menuntut keadilan bagi dirinya masih ada ruang untuk membuat rayuan terhadap keputusan mahkamah sepertimana yang diperuntukkan dalam perlembagaan negara Malaysia. Saya tertarik dengan pandangan Tan Sri DR. Nordin Kardi penyandang Kursi Za’ba Universiti Pendidikan Sultan Idris (UPSI) dalam akhbar Utusan Malaysia hari ini 11/01/12 menyarankan agar Mohd Saiful Bukhari Azlan mengemukakan rayuan melalui mahkamah sivil bukan mahkamah jenayah dengan memberikan beberapa contoh terbaik apa yang berlaku di mahkamah luar negara. Mungkin juga ada pihak lain (NGO dan sebagainya) yang lebih arif tentang perundangan dapat membantu Mohd Saidul Bukhari Azlan meneruskan usahanya merayu keputusan mahkamah. Mohd Saiful Bukhari Azlan hanya seorang rakyat biasa yang mungkin banyak kekurangan yang perlu dibantu oleh golongan yang berkemampuan dari segala bidang. Jika rayuan ini tidak berlaku, Mohd Saiful Bukhari Azlan akan terlepas peluang menuntut keadilan buat dirinya, dan akan meninggalkan kenangan pahit yang amat sukar dilupakan sepanjang hayatnya.

    I report the following with no comment.

    1. 2002. After many years of requests for the release of a Trust account for an investigative audit from the Trustees and I was left with no response, I sued the Trustees.

    2. 2003. The High Court Judge ruled that the Trust was a Singapore Trust even though Probate was granted in the Supreme Court of Malaya, Kuala Lumpur. The Trustees all lived in Singapore. After his ruling, the Judge promptly retired.

    3. 2004. The Court of Appeal ruled in my favour on a technicality. But the subsequent High Court Judge sat on this Suit for 3 years and then he was promoted.

    4. 2006. The Third Lady High Court Judge requested the litigants to settle out of Court. Of course, the Defendants refused because they had refused to do so for so long.

    5. 2007. The Fourth Lady High Court Judge requested the litigants to do what the Third Lady Judge had requested. Again, the Defendants refused which they had been doing for years.

    6. 2008. The Fifth Lady High Court Judge requested that the request for an investigative audit by the Plaintiff was too wide and he was given just 4 days to do the needful. Four days later, the amended Affidavit was rejected and the Lady Judge told the Court that she had been transferred – a matter which she must have known well before hand.

    7. 2010. The 6th High Court Judge told the Defendants in no uncertain terms that he is ready for an immediate Trial but prefers not to waste time if the litigants come to a consent Judgement. The Defendants agreed in 5 minutes after spending over RM 1.5 Millions of the Trust’s money to defend themselves over a period of 9 years and 6 High Court Judges. One of them even spitted out an expletive but was not charged with the contempt of the Court.

    My only comment is that if Kuala Lumpur aspires to be an international financial centre, the Malaysian Judiciary has to be up to the mark for the sake of the Nation and its wherewithal.
