THE FEDERAL CONSTITUTION

1. The Malaysian Constitution provides for a Constitutional Monarchy and a Parliamentary democracy. Of late there has been a tendency to ignore the constitution and to effectively change it by other means.

2. The Constitution can be changed but there are procedures for doing this. Nobody can change it on his own. States cannot change it nor can rulers without the approval of the Federal Parliament and the Federal Government.

3. If the Constitution is ignored by anyone, others will follow suit. The Constitution is the basic law of the country. When a precedent is established, it will become a base for other changes.

4. There is already a feeling of disrespect for the royals. This may lead to other forms of disrespect. Although by and large the Malays are for the institution of the monarch, when their ability to defend is eroded, they might forego their adat.

5. It is seen that some quarters are making use of royalty to overcome national policies and objectives. These people must stop especially when they are foreigners.

6. I will write more about this but as the Johor State Council is about to change certain rules, I deem it necessary that these attempts to effectively change the Constitution be realised by the citizens of this country.

  3. Apakah kekurangan undang-undang yang ada sekarang sehingga kerajaan Johor perlukan undang-undang baru? Hal ehwal tanah sudahpun menjadi hak mutlak kerajaan negeri. Jadi setiap masalah yang diutarakan adalah disebabkan kelemahan pentadbiran, bukannya kelemahan undang-undang yang sedia ada.

    Saya tidak nampak undang-udang baru dapat mengatasi masalah yang timbul. Yang diperlukan adalah memperbaiki kelemahan pentadbiran.

  4. Assalamualaikum Tun.

    Sorry, saya tak bermaksud nak berborak ngan HBT sorang je…tapi saya kira boleh faham apa yang HBT fikir. Mudah mudahan membawa kebaikan dan kefahaman pada ramai orang.

    Saya faham Datuk Mah tak boleh buat apa apa. Tapi Datuk Mah nak buat apa? Kita pilih pemimpin untuk pembangunan, ekonomi, masyarakat, insfratruktur secara keseluruhannya.

    Manakala pemilihan parti untuk memilih parti yang dapat menyediakan kemudahan kehidupan kepada rakyat seperti pembangunan masyarakat seperti dalam soal nikah kahwin, beri bantuan percuma, pendidikan, subsidi dan mewujudkan peluang pekerjaan.

    Untuk jadi kaya atau memiliki harta banyak, tentulah kena bekerja atsu berniaga. Berniaga lebih menguntungkan seperti maksud sabda Nabi Muhammad s.a.w.

    Umat Islam sejati memang telah lama bersetuju yang perniagaan adalah 9/10 dari rezeki. Jadi tak perlu orang cina gundah gulana bila kaum cina kaya..dengan andaian tiada tipu menipu dan halal dari segi agama ; tiada unsur judi.

    Saya kira tanggungjawab pemimpin adalah berkhidmat pada masyarakat yakni menyediakan kemudahan fizikal pada orang ramai. Ada pemimpin duduk saje makan gaji buta lebih baik dari ada pemimpin yang merosakkan.

    Yang lain lain untuk hidup, nak gaji besar kena belajar tinggi, nak isteri cantik kena cari wang banyak banyak sendiri, nak rumah besar kena niaga supaya dapat duit banyak….kena usaha sendiri.

    Datuk Mah nak buat apa?

    Saya dari kecik diajar usaha sendiri. Tak tahulah orang lain macamana.

    Saya kerja overnight masuk jam 11malam balik jam 7pagi atau lebih setiap hari. Kalau bussy nak rehatkan badan macam mana?

    Tapi paling kurang saya tahu, saya buat benda yang betul dan benar.

    Saya boleh bergurau dengan Tun, boleh tak setuju dengan Tun, boleh ambil hati Tun…dan boleh macam macam.

    Yang paling best, saya boleh beritahu orang ramai. Bila saya kata saya tak minat politik, Tun kata dengan politik boleh kenal ramai orang (maksudnya banyak gelagat orang).

    Your topic ‘The Federal Constitution’ is a most appropriate matter to study and discuss at the present time. However, with the recent Birthday of our Yang Di Pertuan Agong, this brings to our minds the question of loyalty and thoughts of all that is good about our beloved Malaysia, And the ‘Gemilang’ which always leads the way.

    This is the time for all of us citizens to rally around our symbols of our Freedom, Democray and Way of Life which is our Yang Di Pertuan Agong, the Constitution and the Gemilang regardless of our origins.

    To rally around our age-old national icons which safe-guarded our ‘ SOVEREIGNTY, NATIONAL INTEREST, SELF-ESTEEM’ is a must for all of us because some of us are still not aware of foreign interlopers, troublemakers, ambitious little Hitlers who think we are easy meat and want to eat us twice for breakfast every morning !

    Many of our citizens are still naive and gullible to absurd foreign brainwashing to tell us how great and clever and how wealthy they are. This is absurd because at the end of the day like now after decades of brainwashing coupled with this spying nonsense which has now been exposed that these interlopers are downright dishonourable and low class.     It is good our loyal citizens are alerted to the the difference between us and the outside World. It is good our citizens realize that we have come a long, long way since the beginning of Time, centuries in fact that our beloved country Malaysia was built up on the backs and hard-work of all. No more. No less.

    And what is so good about our beloved Malaysia ?

    First, we must remember the noble deeds of all our former Prime Ministers who had played a part, an important part to ensure that the 3 noble words ‘Sovereignty, National Interest, Self Esteem’ were applied at all times.

    Our Tun Dr Mahathir Mohamad stands out because he safeguarded our ‘Sovereignty, National Interest, Self-esteem’ at all times for not only the 22 years of his Administration but even before this and then again on his self-retirement in 2003 to now and the future.

    Why is the Tun so important in the defense of our ‘ Sovereignty, National Interest, Self-esteem’ which are a must for any Democratic Nation ? The reason is he is the only person who has the very long political record of imbibing all the vital information which concerned our beloved Malaysia and the outside World for over 70 years ! With the vital information in a fertile mind, the wherewithal came naturally and easily unlike some who could not capture Putrajaya in 3 EASY STEPS whereas our friends, the Thais could do in ONE EASY STEP !

    Why do I repeat all the above-mentioned facts again ?

    IT IS BECAUSE THE WORLD, OUR WORLD IS CHANGING FAST SINCE THE HORRENDOUS CRASH OF WESTERN POLITICAL SOCIO-ECONOMICS WAY BACK IN 2007-2008. To this day, the World is still in trouble with trillions of US Dollars floating around from Quantitative Easing by the Fed which propped up the equity and commodity markets. And a small percentage of improvement of any statistic is loudly lauded as though the ‘green shoots of 2009’ have become trees. Financial reforms have been slow. We hear of financial instituions being fined by the billions of US Dollars ever so often. But no one goes to jail. It is 2014 now, 6 years after the events. Just last week, the EU Central Bank reduced their base lending rate to rock bottom. All the economists in the World are now looking high and low for the slightest glimmer of inflation to re-enhance the value of assets, any asset for that matter. And that is not happening anytime soon. With the lop-sided location of money in Wall Street and not High Street or Main Street, the rich financiers become richer and the poor becomes poorer.

    A case in point is squeaky clean Singapore and their RISING PROBLEMS CONCERNING THEIR MISPLACED (CPF) MONEY ! Everything was fine and dandy which was lubricated by flattery from the international good and the great before 2007-2008. But now with the 8 headed serpent of world political socio-economics, it takes a mighty swordsman to chop off all the heads not made in Singapore ! Hmm !

    With the above disturbing World political socio-economic scenario at play outside our shores, I again seek the attention of all that our beloved Malaysia which is now in peace and harmony with genuine and stable Malaysian Democracy at work and play which are safeguarded by our BN Government as led by UMNO with the 15 component parties that recent events in Ukraine which came about from the tussle between the United States with the West and Russia maybe the harbinger of unsavoury events to come.

    It is imperative, and thanks to the Tun who brings up vital national topics for all to be aware of at all times, and to note that the World has been like this in the 1920s, 1930s and the decades which followed from 1945 to now if the World is not at War.

    It is imperative to be on guard and friendly with all Nations when super-powers who seldom visit us, suddenly decided that our beloved Malaysia is a good friend. No harm in that. But we have also have friends in the Middle East, India, Japan, Russia, South America, Africa etc. This is a chance to strengthen our Diplomatic Service and its personnal and upgrade what is already good to keep us informed of the rapid going ons in this small World of ours. like what our very very close neighbour Singapore as seen in the august pages of our New Straits Times.     Why Ukraine ? The United States and the West have their way of doing things. Thanks to their think-tanks ! It is up to us to decipher the tea-leaves in the cup.

    From the end of the Cold War, 1989 to 2013, I thought there was only low-key super-powers manuevering. But events became surprisingly unpredictable with the rise of the Arab Spring which is now fizzling out in Syria after the deaths and injuries to hundreds of thousands of Arabs who had never known what is Democary since the fall of the Ottoman Empire in 1919. But with the de-stabllizatin of Ukraine, the question naturally comes to my mind is whether this is a distraction created to alleviate the political socio-economic problems of the West which is now in limbo and apparently directionless without any expiry date.
    As forewarned is forearmed, it pays to glean from everyday news to gather vital information to give us a succinct view of future events which may unfold ! A more seirious tussle between the West and Russia ? How is it going to affect our beloved Malaysia as regards our politics and socio-economics ? Whichever way we toss the dice, it seems to be on alert and be friends with all is a better opition.

    The other news is the development of new sea routes, especially the North-West passage and others by China. And more rail connections via Sinkiang and Siberia were brought into operation. This is topped off by the latest Russia-China gas pipeline, a sort of umbilical cord between the two.

    The sudden importance of our beloved Malaysia’s strategic geo-political location which prompted the Foreign Minister of Singapore to visit Washington DC post haste only underlines what has been reported in the media which gave a view that SINGAPORE MAY HAVE BEEN BY-PASSED BY STRATEGIC THINKERS.

    Like all peace-loving, law abiding and loyal citizens, it is important to understand the going-ons outside our shores. Then, we are aware of to quote the Tun, ‘ The Greeks bearing gifts !’ or the POISONED CHALICE ‘TPPA’ which underwent 19 rounds of negotiations in ABSOLUTE SECRECY ! Why ? Because it is THE POISONED CHALICE SPECIALLY DESIGNED FOR MALAYSIA !

    Tun Dr Mahathir Mohamad has always safeguarded us and our ‘SOVEREIGNTY, NATIONAL INTEREST, SELF-ESTEEM.’ as I always emphasised.

    I agree with Tun that Malaysia practices constitutional monarchy. This means even though the Agong and Sultans are the head of their respective states, the governing is done by the executive branch of the government i.e the Prime Minister and cabinet at federal level, and the Menteri Besar and state exco at the state level. We have long abolished the feudal system in which the Sultan have absolute power. The Sultan is the head of state and only have powers over Islamic and culture matters (agama dan adat). The Malaysian constitution have laid down all this principles of power.

    The Sultan of Johor may have his reasons to want to have control over land matters in Johor. The Menteri Besar and other Johorean may feel obliged to give power to the Sultan to show that they are loyal subjects. It is understandable no Johorean would want to “menderhaka” to the Sultan of Johor.

    However, since Johor is part of Malaysia, and the federal constitution clearly states the power lies in the executive branch of the government and not the Sultan, then certain procedures need to be followed.

    It is common knowledge the constitution is the supreme law of Malaysia. Any laws that contradicts with the constitution is void and invalid. Any state law enacted at the state assembly which contradicts the federal constitution is void and invalid.

    Therefore, any state that wishes to enact a law that contradict the federal constitution need to bring the law in parliament to be approved. Case in point, is the hudud law, which the Kelantan government need to get parliament approval.

    Therefore, in my opinion, the state government is acting over its authorised power if it wants to give power to the Sultan. The state government needs to bring the matter to parliament instead. The federal constitution may need to be amended to allow the Sultan to be given such powers. Amendment in the constitution would require a two third majority vote by the members of parliament.

    In my opinion, if the Sultan of Johor feel he needs to have such powers, then the Menteri Besar should bring the matter up in Parliament.

    Once in Parliament, the member of parliaments will debate on the pros and cons. One of the areas of concern would of course be how to avoid from certain parties of foreign element to misuse this power.

    In my opinion, the Sultan should be above from being involve from such administrative matters. This Malays have great respect for the Sultan and by not being involved with this administrative matters, it will not allow certain parties to criticise the Sultan.

    it is my personal belief that a strong Malay leader, a “Hitler Melayu” if you like – someone with courage, wisdom and tenacity to improve the lives of ALL Malaysians ( Melayu, Bumi, Cina, India, Rojak) can put an end to this Royal Shenanigan. Our country will soon be another Singapore, an annex if we fail to act and respond correctly to this latest threat on our sovereignty.

    A MULTI-MULTI-BILLIONAIRE BECAME ONE ONLY WITH A GOVERNMENT GUARANTEED 22 PERCENT RETURN FROM HIS MONOPOLY. And in his gratitude he praised the Singapore Government sky high and to confirm this, the HUGE SUBSIDY PROVIDED BY THE HARD WORKING MALAYSIAN RAKYAT OF 22 PERCENT WAS USED TO SUBSIDIZE A LOWER DIVIDEND RETURN FROM SERONOK IN CASH STRAPPED SINGAPORE WHICH COULD NOT BE 22 PERCENT OTHERWISE HE IS EITHER WARREN BUFFET OR BILL GATES.

    HAS HE BREACHED THE TERMS OF HIS GUARANTEED 22 PERCENT PROFIT AGREEMENT WITH OUR FEDERAL GOVERNMENT BY USING A NATIONAL SUBSIDY TO SUPPORT STRUGGLING INDUSTRIES IN SINGAPORE, AUSTRALIA AND THE UNITED KINGDOM ? – The profits of his monopoly WHICH ARE ACTUALLY THE HARD-EARNED MONEY OF THE RAKYAT ?

    So stupid, we Malaysians permitting multi-multi-billionaires to donate the lush profits to cash-strapped Governments but not to ourselves ! And this happened after 2003 I believe !

    There is another multi-multi-billionaire who made good in KL and he only lends his precious 4 or 6 Stradivarius to the Singapore Philharmonic but not to KL in his gratefulness. which seemed to me to be mis-directed !

    All the above examples exhibit the power of brainwashing of innocent minds !

    The position of the rulers in Malaysia is no different to the position of the ruler in Britain. The so called doctrine of the separation of powers is merely that. A doctrine. That doctrine is more often recognized in the breach than for its observance.

    It is true that the MP for Tunku in Johor has to say. The sovereign has the capacity to exercise the powers of the three arms of government, if not at least direct the way in which it ought to be exercised under the present Federal Constitution as well as the state constitutions of Malaysia including of course Johor.

    The Johor sultanate has always been a ‘renegade’ Sultanate with little regard for the federal constitution or its own for that matter.

    The unfortunate and well documented history of the misconduct of individuals of the Johor sultanate even of late, the personal conduct set by the late former King (former Sultan of Johor) points to the dangers presented by the Johor constitution ( a product of British imperialism). That constitution was established by the British in order that they could annex Singapore. Johor’s position within the federation is a matter which has far reaching political implications for the entire region, let alone the psyche of the Malays of the peninsula and the constitution of Malaysia.

    Unless of course the current Prime Minister of Malaysia has the courage to make changes even if these have to be enforced from the centre, there will always be the potential for political instability in the region.

    Singapore has always had a certain degree of influence over the Johor Royal Household stemming from the days of Sultan Mahmud Iskandar and his legendary run ins with the law in the island state.

    The dealings between the powerful Yakuza run Japanese construction giant Kumagai Gumi and the Sultan has been likewise well documented and presented to Australian authorities by the late Neville Wran former Premier of New South Wales whose firm acted for a party in conflict with the sultan.

    The continued interference in state affairs by state sultans in an extra constitutional manner is likely to tempt the military to usurp the role of parliament in order to restore some semblance of order in Malaysia.

    Interference in the constitution and in the workings of a constitutionally elected government has not only been the work of the Johor Sultanate. But unless the central government, the Federal government exercises leadership and strong leadership at that, it is not only the Sultans who will interfere but also the so called NGO’s (funded by Governments from abroad) and religious organizations such as the churches and Islamic fundamentalist groups. The latter only being a recent phenomenon.

    There are legitimate means of circumventing constitutional restraints on government which of itself is not unconstitutional. The constitution may be suspended. Civil rule may be ended and the powers of parliament subordinated to those of the king or the army or caretaker government appointed by the King.

    The idea that Johor become an offshore enclave of land starved Singapore or China is becoming a reality. With it will come the gradual erosion of Malay sovereignty in Malaysia.

    It is never too late to reverse the trend by the exercise of the prerogative powers of the PM and his government or the King in the exercise of the sovereignty of Malaysia as a sovereign nation.

    Unless of course the current Prime Minister of Malaysia has the courage to make changes even if these have to be enforced from the centre, there will alays be the potential for political instability in the region.

    Singapore has always had a certain degree of influence over the Johor Royal Household stemming from the days of Sultan Mahmud Iskandar and his run ins with the law in the island state.

    The dealings between the powerful Yakuza run Japanese construction giant Kumagai Gumi and the Sultan was well documented and presented to Australian authorities by the late Neville Wran former Premier of New South Wales whose firm acted for a party in conflict with the sultan.

    The continued interference in state affairs by sultans in an extra constitutional manner is likely to tempt the military to usurp the role of parliament in order to restore some semblance of order in Malaysia.

    Interference in the constitution and in the workings of a constitutionally elected government has not only been the wok of the Johor sultanate. But unless the central government, the Federal government exercises leadership and strong leadership at that, it is not only the sultans who will interfere but also the so called NGO’s (funded by Governments from abroad) and religious organizations such as the churches and Islamic fundamentalist groups. The latter only being a recent phenomenon.

    There are legitimate means of circumventing constitutional restraints on government which of itself is not unconstitutional. The constitution may be suspended. Civil rule may be ended and the powers of parliament subordinated to those of the king or the army or caretaker government appointed by the king.

    The idea that Johor become a n offshore enclave of land starved Singapore or Chia is becoming a reality. It is never too late to reverse the trend by the exercise of the prerogative powers of the PM and his government or the king.

    Saya tak baca akhbar hari ni. Cuma baca berita dalam blog. Saya baru selidik sedikit cerita berkenaan Negeri Johor, tapi Malaysiakini lebih advance.

    Bagaimana Malaysiakini terlebih dahulu menyebarkan cerita ini samada betul atau tidak?

    Saya mungkin lebih mempercayai berita dari Malaysiakini jika saya fikirkan tentang kehidupan masa depan sama seperti masyarakat Cina.

    Manusia memang punyai nafsu pada harta dan pangkat, tapi untuk fikir keterlaluan pada pemimpin orang Melayu, masyarakat Cina perlu lebih berhati hati memerima maklumat.

    Sebelum bangsa lain bersuara, bangsa Melayu sendiri akan menentang perkara perkara yang tak elok dari berlaku.

    Kerana orang Melayu bersifat menjaga dan melindungi.
