2. Many would say what is the use of a trial by a tribunal which is not recognised by any Government. And in addition the accused persons were not present although the summons were legally served on them.

6. In the charter of the United Nations no country is accorded the privilege or status of being above the laws, rules and regulations of the UN.
7. We frequently read reports of tribunals being set up by the UN and also by the victors in war to try war criminals. In Nuremberg and Tokyo the “war criminals” were sentenced to death by the tribunals.
8. However, it has become obvious that the powerful countries and their leaders have never been tried for the crimes they have committed. They are clearly above the law.
9. Do we accept this? If we do then we would be accepting what is a travesty of justice.
10.The general assembly of the United Nations and the weak nations of the world have found no way for applying the laws, international or otherwise, against powerful leaders of powerful countries who are clearly involved in international crimes.
11. The UN and the international community have failed.
12. The world should not accept this failure. Somehow some punishment should be meted to countries and leaders guilty of international crimes. Their deeds must be put before a court of law and the verdict pronounced, After that the world body would be informed as will the different agencies concerned with the maintenance of world peace.
13. This is the age of the NGOs, the Non-Governmental Organisations. Like it or not the Government must recognise the NGOs seriously and consider their views.
14. The Tribunal set up by the people is an NGO. It behoves Government and international institutions like the UN to take srious note of the Tribunal as an international NGO.
15. The general public also should take note of the verdict of the Tribunal. Otherwise they will, in one way or another, be honouring criminals, international criminals.

Strange as it may seemed that a War Crimes Trial was held in Kuala Lumpur recently. The Defendants were the leaders of two of the most powerful nations in the West. As it is said absolute power corrupts absolutely. The power to kill innocents without due consideration for their part as bystanders and not acive participants does not matter. In terms of modern warfare, the more death and destruction which could be unleashed on to an enemy’s territory and human resources the better as it would have been part of the overall strategy to win and to conquer.
Until the advent of the globalised multimedia led by the television and the Net, wanton killings of innocents in foreign lands were opaque. The imperial adventurism of the last few centuries which also led to mass killings, have been mellowed with time and re-written as heroic deeds. The killings of innocent villagers at Batang Kali, Selangor 1948, South Korea 1952 and South Vietnam 1971 were just as criminal as the killing of thousands in the Middle East.
The Defendants, Bush and Blair, were unfortunate to be caught under the glare of the international multi-media with its peripheral sharp-edge reporting. It was foolhardy to embark on an military adventure without the blessing and support of the international community at today’s age and without the cogent reasons of wrong-doing by the Iraqi regime. This has proved to be international gangsterism at its worst where the weak are bullied by the strong.
Was this the fall-out to inspire the Arab Spring of 2011 ?
However, we find the West is now having a big say in oil-rich Libya, Iraq and the Gulf. The rapid disappearance of despots which were supported by the West for 30 to 40 years and were useful during the Cold War, has now created an uncomfortable political vacuum in these leaderless lands. With hindsight, it would have been better if Bush and Blair had left Iraq alone and played for the long haul. They have now opened the Pandora’s Box and the weight of history will bear on them.
The surprising fact is that the United States and Britain with all the power and wealth and brain-power could not think of a better way than to kill and to kill. Meritocracy has its limits !
Apart from the oil lands which the West covets, when it came to sovereignty, national interest and self-esteem, the United States sic Britain tended to forget their best friends e.g. Lee Kuan Yew and Singapore, their nearest and dearest, were left to wallow in a gigantic loss of US$ 108 Billions on the NYSE in 2008. When America leant on Indonesia in 1997, Singapore had the chills too.
Tun, hopefully our leaders consider that sovereignty, national interest and self-esteem are paramount amongst their duties and responsibilities, like you for a life-time. These are honourable virtues which a leader of a nation must have.

In order for us to be heard, we must 1)embraced human rights and then only 2) implement KL Tribunal on War Crime. There are some human rights where we must look at before we can be taken seriously by advanced countries. Pointless to gain support with say Cuba or Russia.
1) We must uphold human rights of all individuals, all human beings, regardless of creed or race. Do not discriminate.
2) Abolish all Act especially the ISA. And do not implement new spin-off Law to replace draconian Law.
3) Adopt current United Nations law & to respect each other

Saya sangat setuju dengan pendapat saudara mengenai Tok Guru LKY (heehee) mengenai Meritokrasi atau term sebenarnya yang di praktikkan adalah selected/choiced Meritokrasi.
Daripada bangku sekolah rendah (circa 70’s) hingga umur saya sekarang dalam lingkungan 40’s, diskriminasi terhadap perluang untuk orang melayu berkebolehan dan qualified amatlah tipis.
Apatah lagi bila Anggota Melayu Singapura selalu in apoletic mode – yang kita ini selalu ada macam2 masaalah. Tetapi yand berkebolehan dan qualified kebanyakkan tidak mendapat jawatan yang mereka layak. Saya rasa Melayu yang berkebolehan dan qualified kalau nak maju jaya, harus mencari opportunity di luar Singapore. Dah ramai Melayu tersebut berjaya di luar negeri.
Untuk sekarang dan masa depan akan lagi banyak challenges yang Melayu Singapura akan hadapi. Lihat sahaja. Pemerintah Singapura dah open floodgates for foreigners to come and work here. ‘Bijak’ sunnguh Pemerintah Singapura. Orang asal dari Cina,India, Philippine, Myanmmar are all here to take away the good jobs.
Dah lah Melayu di discriminasi from the 70’s, I fear what the future holds here for the future generation Orang Melayu here.
Of course future anak anak Melayu educated with Masters, PHDs and what not.
But all these achievements and titles mean nothing if they cannot get good jobs and continuously being discriminated.
I sincerely think the should look for opportunities elsewhere. I have been telling my children to do that. Kesianlah mereka but no choice. No point living in denial. Bettere to be discriminated in other country than in your’s.

I fully agree with you on the issue of tribunal on war crimes. I believe every sensible and fair minded individual should come out strongly and support Tun, irrespective of their political loyalty or leaning.
The war against Iraq and Afghanistan by the American and British has resulted in hundreds of thousands of innocent Muslim lives killed. There is not much difference, if not worse than the crimes committed by Pol Pot of Cambodia or Mladic of Serbia. Bush and Blair and those military generals who colluded and supported the genocide of Muslims in Iraq and Afghanstan are cruel (zalim). They will pay for their crime and sin for killing the innocents and non combatants in this world and the hereafter.

Thank you very much for having a thought for highlighting the wrongdoings of the powerful nations through this War Tribunal. I have not read the indictment but I am disgusted with the bullying and double standard practised by the West and its cronies.
The ICC and UN Secretary is puppet of the West. They were quick to condemn leaders of countries like Libya and Syria but chose to close their eyes to the crimes committed by leaders of NATO and USA. We all know the West are supporting rebels in Libya and Syria and yet threatening leaders of these countries for protecting their citizens against these rebels.
I have not heard from Ban Ki Moon on the death of Pakistani soldiers by NATO strikes. Strangely silent. What kind of a man we have as UN Sec Gen?
Even here where you haven’t completely receded from the scene, objectivity is under assault. What more in countries where terror has been the norm for generations?

Alangkan nama negara Islam pun PAS dah tukar kepada negara kebajikan, apatah lagi yang lain2. PAS lagi lemah dan lembik lagi dari UMNO. Orang suruh bergabung dalam BN pelbagai fatwa depa keluarkan. Bila insiden demi insiden seprti kes gereja di Selangor, bila DAP melenting, pemimpin PAS ialah antara paling pertama bersama2 golongan DAP menentang JAIS. PAS berkasihsayang dengan orang DAP tetapi menunujkan sifat bengis dan bencinya kepada orang UMNO. Tetapi PAS kata perjuangan Islam?
Meritokrasi DEB adalah perkara yang baik tetapi meritokrasi ciptaan Lee Kuan Yew yang diterimapakai oleh Pakatan Rakyat adalah meritokrasi sesat, zalim dan menindas golongan lemah!!!
Kepada semua orang Melayu, lihatlah secara menyeluruh perjuangan UMNO bukannya cebisan2 saja. Bandingkan pula dengan PAS… Kepada bumiputera bukan Melayu,yakinkah kamu bahawa Pakaran Rakyat akan berlaku adil? Keadilan itu subjektif. Keadilan ikut Parti Keadilan adalah sesat. Pilih pemimpin sesama mereka pun bukan cara adil, boleh diharap jaminan keadilannya? 1. InsyaAllah, this trial will be a precursor to more effective and widely supported attempts to hold war criminals accountable even if Muslim nations cannot effect arrest on these individuals.
2. At least in principle, we have put them to the same international law they impose on others at their will and this is in itself a display of moral courage lacking by the rest of the world.
3. The record will state that these war criminals had been found guilty under the same international law they claim to uphold but the UN and the ICC had shown they are ineffectual in being a just world body.

At long last, a long over due judgement has been passed.
Both Bush and Blair are guilty of crime against humanity and they are self acknowledged war criminals. But blinded by their own arrogance they strut around the world preaching peace.
The UN and the ICC has failed even to discuss or indict these criminals, even though they were caught red handed by the whole world in broad daylight, so to speak.
An issue even greater than punishing these lowly criminals is the existing UN system that not only allows, but facilitates these criminals to continue to commit crimes with impunity.
There is no doubt that the UN has failed. But it is not a failure of ommission or neglect, it is a failure by design. The whole UN system created in the wake of WWII has built-in institutions in the form of the five permanent members of the Security Council with power of veto, that can ‘legitimise’ crimes committed by the Bushes and Blairs of the past and more to come in the future.
A global movement needs to be launched calling for the abolishing of veto power and permanent security Council membership, before peace can be established in the world and war made a criminal offence.
What is this madness? Is this a joke?
No one will take a toothless court seriously. Jurisdiction of a court comes with recognition of its power.

I would like to congratulate our brave Malaysians who have held this trial on war crimes. Personally, when you see the world in a global view, you can notice that the ‘great’ United Nation is just a tool for the rich and powerful country.
For example, how can Israel get away from all charges on Palestine-Israel issue? And the Iraq war, 500 000 people died, so that they could ‘earn’ their black gold.
I hope that Malaysia could become one of the leader in promoting peace and stability around the globe.

1. You do not have to look internationally to find that there are many cases where powerful people are above the law and escaped justice.
2. A Mongolian girl was murdered and the true perpetrators behind it will never be brought to justice.
3. We will never know the people who caused a young man to allegedly “strangle himself” before “committing suicide” by jumping off a 20-storey building.
4. Tens of millions of the Rakyat’s money were siphoned out from a state-owned steel company with no one taking accountability.
5. Billions of ringgit of government money has been wasted in a port and free trade zone scandal but it is likely that the parties involved in it will get away scot free.
6. Many of those believed to be responsible carry the titles Dato’, Dato Seris, Tan Sris and Tuns.
7. It seem that in one way or another, we are honouring criminals, national criminals.

Freedom Rider: War Criminals

We live in a world ruled by people who call evil good and good evil. They designate people, the powerful ones, as being worthy of respect and admiration. The presidents and prime ministers are given a pass, no matter how awful their actions, as long as they do their dirty deeds in the names of certain countries.
Institutions such as the United Nations and the International Criminal Court are indispensable to them as they cut a swath of terror throughout the world. So great and seemingly untouchable are they that very few people will bother to look at what they really do, and to whom they are beholden. When NATO wanted to carve up Libya, they went to the United Nations claiming that the people of that country needed protection from their president Moammar Gaddafi. The imprimatur of a Security Council vote, and words of support from the Secretary General made the aggressive war appear as if were anything but that.
The same critique can be made of the United Nations’ sponsored International Criminal Court. The ICC was established in order to punish war criminals who were not prosecuted by their own countries. So far, the ICC has only managed to prosecute Africans. The current cases presented for investigation involve Democratic Republic of the Congo, Uganda, Sudan, Kenya, Central African Republic, Ivory Coast and Libya. In the past a few Serbs were thrown in for good measure, but otherwise Africa has been the ICC target.
If Libya is presented as a prosecutable case, it is not Saif al-Islam Gaddafi who ought to be investigated, but Barack Obama, Nicolas Sarkozy, and David Cameron. It is they who waged war of aggression and who used the United Nations to make their dubious case.

There is a precedent for calling out the western world’s capitalist war criminals. Earlier this month in Kuula Lumpur, Malaysia, former prime minister Mahathir Mohamad convened a tribunal to investigate George W. Bush and his partner in high crimes, former U.K. prime minister Tony Blair. The Kuala Lumpur Foundation to Criminalise War, found Blair and Bush guilty of “crimes against peace” as a result of their plot to invade and occupy Iraq. This tribunal has no power of enforcement, but correctly made the case that the U.K. and the U.S. were unwilling to punish their leaders for the horrible deeds they committed.
The United States congress and indeed state legislatures had the power to impeach Bush for the Iraq outrage, but they adamantly and quite publicly refused to do so. Even when the so-called opposition party had the electoral majority and the ability to file charges, they pointedly refused. Obama’s ascension may provide a clue for this seemingly inexplicable behavior. The Democrats already knew that when their turn came to be in the driver’s seat, they would not want the public to have any notions of making them accountable for their criminality.
In reality, the United Nations and its International Criminal Court act at the behest of the western capitalist countries only. They turn a blind eye when Bush and Blair invade Iraq or when their successors kill Libyan civilians. Their partners in the corporate media don’t allow true debate about how they operate and they paid no attention to the Kuala Lumpur tribunal. Once again, we are left to our own devices in finding this or any other information that may deviate from the party line.

None of the television networks and none of the major newspapers reported to their American viewers and readers that the rest of the world is prepared to put their leaders in the dock. Last week NATO, that is to say the United States, killed six children in Afghanistan in a drone strike. These human beings are given the awful label “collateral damage” when the war criminals want to give a name to the horror they unleash. The Peace Prize winner said nothing, and neither did his supporters.
It doesn’t matter that most Democrats are prepared to again anoint Barack Obama with the title leader of the free world. Perhaps he should be called the lead criminal of the world and dispense with any idea of freedom. The only freedom involved is his ability to do whatever he likes without ever being called to account.

1. What tribunal will it be that can question the rationale and use of race superiority as a means of governance ?
2. It is indeed a method for mankind to rule, used in several geographical locations, but as we evolve, there is a tendency to do away with this approach, and rather use the humanity approach. That is what the world is trying to advance towards.
3. Granted. democracy has its limits, but the failure of western economies is not due to democracy, it is as Michael Moore puts it, “the lack of democracy in economics”. This means we the ordinary people has no say at all in how and what economic policies are being shaped and and what principles are used. We are merely worker and soldier ants, born and designed to work and defend the rights of the rich and influential.
4. Therefore, economic policies and laws are made to benefit the select few, while the larger group or number succumb to the policies and laws designed to supress new ideas and risk taking. In this manner, the oligarchy ruled and became greedy. They want everything.
5. Scemes are devised to generate more money out of nothing. Sting was right after all, “that’s the way to do it, money for nothing, chicks for free”.
6. The belief in such faulty schemes is religious. And they defend it religiously. An entire system skewed towards protecting this very scheme is working at maximum efficiency. This is called “work”. The aim is simply to make more money. Forget goods and services. There is only one service, the service to make more money.
7. Hence, the economic system finally collapse. But to attribute this downfall to the failue of democracy is flawed logic, Tun knows it too, but there is a reason Tun preches the philosophy of failed democracy. I need not say here.
8. It is clear, from what is happening in western countries, that there is one element of democracy that they have forgotten, the down trodden people. I am talking of the sick and por people. Of course the wealthy and healthy are not forgotten. They are always around and makes the most noise, being healthy as they are.
9. Less i be accused of being anti-government and such, i am surely not. But the government considers the por and the sick as people needing help, and doles out accordingly. This is definitely not the answer. Charity is best left to NGOs and religious organizations.
10. What is needed is the recognition of the potential of the many who are sick and por, for among them are talents and skills painfully acquired throughout the years, but they typically do not show their true colours, and wisely too i think. If we are to progress, this is the breed of people the government should utilize towards our common good vision. Yet this breed is the one being supressed to the extremes. Someone said if there is a Malaysian “Steve Jobs” living here, we would still not have had the iPods and iPads.
11. I do not have or pretend to have the answers for this mess. But then, i would like to think we have a government who does the seeking of answers and solutions for us taxpayers. I hate to beleve we have a government who tells us what to think and believe.

You have an unthinkable things.. a stateman with great courage to highlight that such criminal acts had been carried out with impunity by so called “world great leaders” just because of them being the leaders of powerful countries and not based on rights or wrongs in treatment of any human being.
To some and perhaps many, would argue that what you have done is waste of time. This is the level of thinking that reveal the difference between man of vision and who are not.

While you may think that you are absolutely right and flawless at all times coupled with perfect morality in your 23 years of leadership, i shall not comment on this but really what is the use of such a tribunal given the fact of time lapse and practicality? Have you stopped for a moment to think who are our biggest investors? Yes, The Americans & The Europeans. Do we need their investments? Yes Off course! Do you see the damage that the tribunal may cause in terms of our business and bilateral ties with these countries?
Talking about International Laws, The Rule Of Law & Universal Principles laid down clearly by The UN, Malaysia is definately guilt in many ways but off course we use Religion as our Bailout from being questioned or convicted. But i find it rather Appalling that we who believe that we aren’t a third world nation but find it rather difficult to uphold Human Rights & Civil Liberties in it’s totality, we conveniently brush it aside as “International Culture” or better still, a Threat to Religion!
Little do we realize that ultra conservative and religious countries like India have managed to uphold Human Rights & Civil Liberties in totality. Yes, there is more democarcy in India and Myanmar is begining to work towards this direction. The Indian Courts are fully Independent and “People Power” is very much alive, The Laws remain independent without giving space to any religion or politics. In a nutshell, there is seperation of powers in totality. This is International Law in it’s fullest which upholds the Rule Of Law and they don’t find it a threat to their religions, culture and governance and they do not brush it aside as “International Culture”. At the end of the day, The Law must provide equality and protection to ALL irrespective of religion, culture, colour, creed, social class, political parties and sexuality. Every Humanbeing must be treated with equal respect and not fall into the hands of uniformed forces or religious authorities just because they are different or not in norm with society. In many cases, the conduct of the uniformed forces and religious authorities lack religion in itself, brutal and disgusting and it conveniently doesn’t get media coverage. Why do we use our uniformed forces against our own citizens who have voting rights? Did their opinions, religion or lifestyle stand as a huge threat to society? Aren’t they born with human rights and civil liberties? Did they cause bodily harm to anyone? So why do We Moral Police those who vote for us? Where’s The Logic? A government’s business is to manage the country’s finances, bring in revenue and develop the country. Not to be a Parental Government!
So who are we to judge Former President Bush & Former PM Tony Blair when we ourselves aren’t all that perfect? Infact we tend to be a laughing stock in the international arena.

Not the same can be said for trials in Malaysian courts. Some suffer from selective amnesia when testifying and others simply get cold feet and submit applications to set aside subpoenas. Get things in order in our own backyard before judging others.
