1. I hesitate to comment on the Proclamation of a State of Emergency for fear that I am motivated by a desire to become Prime Minister again.
2. But now I find that doctors and lawyers are commenting adversely on the promulgation of a state of emergency due to COVID-19. Also, on the management of the pandemic. And so I feel I have a right to comment.
3. My view is that emergency powers are not necessary in dealing with the pandemic. The Government has ample power and Malaysians have obeyed whatever orders or directives issued by the Government in dealing with COVID-19. They raise no objection. We are not like liberal western countries where the people openly disobeyed Government directives claiming that their rights and freedoms have been ignored.
4. But the Proclamation of a State of Emergency removes the last vestige of democratic rights of the people. It is worthwhile to note: –
i. This Government is not the Government they elected. It is a back door Government.
ii. This Government has now lost its majority and therefore the right to rule.
iii. Through the proclamation this minority Government has now gained absolute power to rule.
5. This is enunciated in article 11 of the Emergency (Essential Powers) Ordinance 2021 which reads:-
“For so long as the emergency is in force –
a) the Prime Minister and the Cabinet existing immediately prior to the issuance of the Proclamation of Emergency on 11 January 2021 who have been conferred the executive functions shall continue to exercise the executive authority of the Federation and such other persons who have been conferred the executive functions by law shall continue to exercise such functions;
Additionally in para (4) of 12;
For the avoidance of doubt, for so long as the emergency is in force, Clause (3) of Article 55 of the Federal Constitution shall have effect as if the words “for five years from the date of its first meeting and shall then stand dissolved” have been deleted.

14. (1) For so long as the emergency is in force –
(a) the provisions relating to the summoning, proroguing and dissolution of Parliament in the Federal Constitution shall not have effect; and
(2) Any Meeting of the Parliament which has been summoned before the coming into operation of this Ordinance but has not been held is cancelled.
6. Clearly with the Proclamation of a State of Emergency the Parliament elected by the people has lost its role in the governance of this country. The Prime Minister now has full authority to rule the country on his own.
7. The excuse for this seizure of power is said to be the massive increase in the COVID-19 pandemic.
8. What is there that the Prime Minister with his absolute power can do to solve this health crisis? One has to remember that its was his decision to seize power in Sabah that was followed with the four digit increase in the number of new cases. Before that the new cases had dwindled to single digit.
9. The best brains in the world are finding it difficult to stem the numbers of new cases. Can the Prime Minister with his power to jail people for up to 10 years and impose a fine of five million Ringgit reduce the number of cases.
10. We appreciate the work of the Director – General of Health for his management of the pandemic. But now the numbers are very big.
11. The problems are not the same. The frontline workers who dealt with the first phase have now to deal with thousands more cases daily. Still the COVID-19 numbers are increasing. Positive cases cannot be admitted, increasing their exposure to members of their families and others.
12. The workers, foreign and local, are posing massive problems as they stay in crowded rooms and cannot maintain social spacing when working.
13. Total lockdown cannot be imposed as the economy would be affected and poor people cannot earn money to buy food even.
14. The problem caused by the pandemic are very many and do not lead to easy solutions. Can the enhanced power of the Prime Minister tackle these problems?
15. What kind of advise can he give to the King that will reduce the numbers of those getting infected, those having to be hospitalised, those who will die.
16. But the declaration of emergency has given the Government tremendous powers.
17. Everything that is done is in the name of the Yang di-Pertuan Agong. They cannot be questioned. Nor can they be brought before Parliament as all sittings have been cancelled.
18. Effectively the rule of law has been abolished. We are assured that the intention is good. But when absolute authority is given, breaches and abuses will happen.
19. Whither Malaysia.

Our beloved Malaysia was not founded or built by one person alone. Even tiny Singapore had 2 founders !
Millions of Rakyat contributed from 1945 to 2021. During the Communist Insurgency many lost their lives or wounded 1948-1992. Let us hope their sacrifices were not in vain. Many more also contributed in the service of our beloved Malaysia, the Malays, Chinese, Indians, Dayaks, Kadazans and all. As a boy, I remembered the fear and the anxiety which gripped all between 1948-1957.
In present day Malaysia, we must not forget to keep our economy going with the full awareness that every year at least 300,000 school leavers and university graduates will look for jobs. Jobs may only be created in an equable environment for domestic and foreign investors because Malaysia has many other rivals which will offer better returns. There is no free lunch in this World.
WE MUST SINCERELY CREATE JOBS FOR OUR YOUNG PEOPLE IN A LAND WHICH HAS GOOD PEOPLE AND BOUNTIFUL NATURAL RESOURCES. Even though we lost much to the deceitful, we can make much more again with our Will and Determination. No problem.
It was Malaysia’s Open Market economy with the World which bolstered its attractiveness together with its Political Stability from 1957-2003. We must always provide jobs for our young people and give them a decent future which they expect in a land of good people and bountiful natural resources. ANYTHING LESS IS A TRAVESTY OF JUSTICE AND FAIR-PLAY concerning the young. WE MUST NOT BETRAY THEM !

I reiterate in this distinguished Blog again that I have always been a Constitutionalist and not a Communalist since 1954. As such, I have always supported the incumbent elected Government of the day.
In my Lifetime, my view has always been to give or contribute whatever I could to make our beloved Malaysia a success, a great success like the many thousands or millions of Rakyat before me – from billionaires to Civil Servants who also contributed to make our beloved Malaysia a great success up to 2003. Thereafter, money and greed took over and destroyed our traditional Malaysian Golden Values which led to the political conundrum of today, 2004-2018.
Malaysia’s success could only be achieved through the combined efforts of all the Rakyat, rich and poor from 1957 – 2003.
BUT IT WAS THE WISDOM AND THE COMMON SENSE OF THE PRIME MINISTERS 1957-2003 WHICH CREATED GROWTH AND HELD THE COUNTRY TOGETHER DESPITE OF ITS COMMUNAL DIVERSITY.
Besides the Rule of Law which prevailed throughout 1957-2003, the key element was the socio-economics for the Rakyat based on the ‘current account surplus’ as the glue which held the country together. This was Public money spent with transparency and integrity on Public projects of value. This was the fine balancing of the different desires of different communities BALANCED ON A KNIFE’S EDGE !
But with the Central European Yiddish song, ‘CASH IS KING’, the balanced equation in favour of the different communities became imbalanced in favour of the few. In no time at all, the Government’s coffers ran dry.
For an individual like myself, 101 years old and humble but contributed like ALL the other Malaysians, thus
1. Donated my father’s mansion with 13 acres for the First Istana Negara.
2. Through my 1972 Sime Darby Concept to fast trek the Malays into big corporate business for only RM 23 Million with the support of Tun Abdul Razak and his confidant YBM Tengku Razeleigh Hamzah.
3. The idea of the founding of the National Savings Bank in 1975.
4. Donation of the finest Malaysian paintings to the National Art Gallery.
5. Donation of the World’s best collection of 18th & 19th Malay Sultanates Gold and Silver Coins to Bank Negara Malaysia 1972.
6. Donations of the World’s best collections of Straits Settlements, Malaya Coins to both Bank Negara Malaysia and Maybank.
7. Donation of the World’s best Malaysiana books to a university.
8. Saved the biggest corporate bankruptcy in the 1970s in a key BN constituency of Taiping and was paid only RM 7,000 per month, an Alfa Romeo and no other allowances for 9 years. After collecting their loans in full, MIDF and the Consortium just walk away as though they did not know me.
9. In 1990, I lent 9 Million Renong shares without security to UMNO Baru to redeem the assets of old UMNO from the Official Assignee.
10. Many, many more to individuals both Malay and non-Malay.

The present situation in Malaysia today is a HEALTH PROBLEM NOT A SECURITY PROBLEM WHICH REQUIRES AN EMERGENCY TO BRING OUT THE GENERALS AND THE TROOPS WITH GUNS.
History is the finest Arbiter of the Truth. IT WAS THE SOCIO-ECONOMICS WHICH MADE OUR BELOVED MALAYSIA SUCCESSFUL 1957-2003. We must return to that with a wise Leadership.
A long Emergency without a cause will keep ALL FOREIGN INVESTORS AWAY CREATING ZERO FDI with a downgrade by Moody’s and Fitch to add to our borrowing costs. With such a scenario, all our imports, food etc will shoot up in prices. This will end up like a cat chasing its tail. Money will seep out in greater and greater amounts. ALL THE RICH AND POOR WILL BE IMPOVERISHED.
At best, this Emergency should last only ONE MONTH in all wisdom before it damages our socio-economy at the core.
Our beloved Malaysia has the good people and good natural resources to make much more than what was stolen from us by HOOK OR BY CROOK -2004-2018 without an emergency !
For example our beloved Tun Dr Mahathir Mohamad’s Strategic Legacy Plan or TDMSLP can create RM 250 Billion – RM 500 Billion given the opportunity.
