2. It seems logical and right that those who receive illegal gratification should be considered guilty of breaking the law and should therefore be punished. But when we talk of corruption we think of those endowed with power abusing their power in order to gain personal benefit. We think that those who offer gratification as being the victim and should be given some consideration.
3. But the law says that those who pay for the service they receive should also be considered as guilty and should be equally deserving of punishment.
5. Besides the process of law would be much prolonged, as each would seek lawyers to argue on his behalf. Not only will the trial take ages but the result can be quite unpredictable.
6. But there is another factor. The person reporting would be marked by those sympathetic to the other party so that it would affect his dealings with them as well. If they are Government servants whose approval would be needed, the approvals may not be forthcoming at all later, even if other officers are involved.
7. Because of the ineffectiveness of the laws corrupt people often get away with their corrupt practices.
8. Yet corruption is such a bane on society that it must be stopped somehow. If the law is ineffective then it must be made to be effective. One of the ways is to give immunity to the aggrieved party reporting the case, provided that the evidence was substantial and not perjury.
9. In the case of political corruption both parties may be willing participants. The bribe is given by a candidate to a willing recipient to gain support for himself. Both are therefore unlikely to complain and reveal the act.
10. The recipients on the other hand would be glad to receive the bribe, unless he is a person of high principal unwilling to betray the cause his party was fighting for.
11. In political corruption it would be extremely difficult to get evidence of the bribe being given or received. Electronics now play a role to hide the act. The money is deposited into the account of the person (voter) concerned via the ATM machines. The recipient would be called via phone to ask whether the money had been received, giving the name of the candidate.
12. Despite the difficulties for detection, a Government that is truly determined to prevent corruption can find ways of detecting corruption. But if the Government itself is corrupt then corruption cannot be stopped. In fact corruption would spread in every direction and would become a way of life. At this stage nothing can really be done.

During your 22 years you were too busy building mega projects. And these mega projects had plenty “money leakages” or kick backs that coz’ taxpayers lots of money. You should take full responsible.

and these affects the rakyat badly … the sogokan is recovered by marking up the pricing … goods are more expensivve … or reducing the quality of goods produced … be it consumer goods, commercial or even properties
money can buy a lot of “evil” things but it is the vote that really make the difference when the rakyat are hurt

Yang pasti apa ada proteksi sehingga MACCnya Malaysia tidak bisa mengambil langkah penangkapan bagi memberanteras korupsi. Kesianlah kalau ada departemen yang menjalankan pemberantasan tapi orang yang harus dibanteras diproteksi pula, lebih baik jangan ada badan komisi.

It makes me want to cry to see how low human can be. In my humble view:
1. The fact of having any written law with regards to anti-corruption can change nothing if it is not being implemented properly.
2. Even if the anti-corruption law is being implemented properly, it doesn’t guarantee to free our country from corruption.
3. A good enforcement of law can possibly reduce the number of cases (if the consequence is considered somewhat rather stop a person from keep on doing it). Otherwise, we might end up having an increase in the statistics of proven cases due to the effectiveness of enforcement.
4. What would happen if the enforcers get corrupted in enforcing the law itself? Are we going to end up to come up with another independent body to enforce another anti-corruption law to the enforcer? And the chain goes on?
5. When we look at it closely, all this problem actually pointing out that without rectifying the real problem (which are human greed and lust), we’re trap in a never ending cycle as long as human still alive.
6. I believe in nurturing kids in their early age by instilling the right values and morals, and lifting human to their higher purpose of life are the best solutions. Law and enforcement are just for reinforcement, and not the whole answer.
It is not about how much money you earn that matters. It is all about how you earn that money.
It is not about how much money you earn that matters. It is all about how you spend that money.
It is a common sense right? But nowdays, to most people, common sense is nothing more than common.
I pray God provide His guidance to all of us.

It is not strange dear. When mistake was done, we will have to think of a way to solve it, that’s why we learn history. You are on the right track, macha, give yourself a new lift and move on with life.
I was glad that PM declared Kayveas as PPP President and maintained T Murugiah’s position in KDN. If I am not open minded and moderate, I will say it’s not fair for muslims and non muslims. PM had stressed clearly that we must work for the party (in swasta, means company or organisation), not to “merebut jawatan” for own sake.
Party is more important than the individual, without the individuals, party survives, however without party, individuals will not survive, you understand?
Be positive in your perception and you will see many opportunities out there waiting for you to reap. But if you do not change your attidute, no one out there will be willing to give you a chance. Maybe you did not acheive what you passionate for today, but if you open up your mind and heart, your future generation will be able to enjoy what you did not get today.

I was amazed and did not expect to get an interesting view from my children on the ranking of world corrupted nation. Malaysia is ranked 54th / 59th (am I right?). I told them that the 1st rank is Indonesia, China or Africa, if I am not wrong.
They told me that the countries that are ranked at the bottom level are the most corrupted countries. Why? Because their corrupt practices cannot be detected due to sophistication of IT and human intelligence. Well, the top rank countries are not so corrupted because they can be detected so easily, and my children believe that people do corrupt because of human greed regardless whether that country is capitalism, communism, socialism, islamism, etc. and this is a fact that we have to accept. Corruption can be good and also can be bad in reality!!!

Corruption is indeed difficult to be identified. In Malaysia, pehaps it is a way of life because it involves the government and rakyat. Can it be stopped? No, it cannot be stopped, however it can be minimized if the government and rakyat have the “moderate will” to put this out from their dictionary.
I remember 13 years ago, I have this nasty experience, and I did not know how to react to such problem and I did not join the prcatice. There was a veteran UMNO of the high profile post expressed his dissapointment and displeasure of this practice but he could not do anything to stop it because he was “blacklisted” and stored in the freezer. I believe that there are good and sincere UMNO members who know clearly what they should fight for the party and the country, and that is why I pilih BN. Today, I am very confident to say that I am not rich and powerful, but I can sleep peacefully without lights on.

I am glad you finally raise this subject.
Having a good law is one thing and enforcing the law is another. I know that you have tried to reduce corruptions during your time as PM but it was not good enough. Many big fishes got away with millions!
When Pak Lah took over from you we were hoping for some improvements but it was a big disappointment because Mr. Clean did hardly anything and the corruptions became worst.
The Politicians, civil servants, military, police and private sectors at all levels appeared to get involved with corruptions in one way or another. As an example, just ask the Chief of Air Force whether there are certain serving Brigadier General, Lt Col and Majors ( may have retired on advice ) living beyond their means and are apparently working with some defence contractors. This Air Force major built multi- million dollar house in Bukit Jelutong and lives just next to a retired Air Force Chief.
Lacking specific anti-corruption could be just a small part of our problem but the biggest failure is that the government lacks political will, we condone cronies and senior officers. Many leaders at all levels do not have balls to take action against the culprits, may be they are also part of the team!
As long as the above persist, we are going nowhere in our battles against corruptions.
It’s better for Malaysia to dismiss the top 200 corrupted leaders and allow clean juniors to take their positions as opposed to retaining these corrupted leaders to continue spreading the cancer.
We will have to wait what is coming from Najib and I hope it will not be too long.
If there is one thing in the world that has deeply rooted in the society, it can be none other than “CORRUPTION”!.
Corruption is as old as the oldest profession and exist ever since the emergence of mankind.
It is impossible to do away with corruption as it has become an accepted norm in society.
The issue in question here is the magnimity of the figures measured in dollar and cents.
The intensity of corruption in a nation is directly related to its development structure and employment level of its workers.Corruption is rampant in third world countries where its economy is still in the developing stage. Countries such as China, India, Indonesia and Philippines are some of the countries in our region that are notorious for corruption. The evil of corruption in these countries is intense and the economy is almost held to ransom.
When we compare our country to these nations, we may be proud to disdain ourselves to the index tier of corruption level. For a small nation of ours, the value cash or favour involved for the purpose of corruption is astonishing. We may surpass these nations or may be on par with these nations in this sense.
It is impossible to eradicate this evil of corruption but it may be checked with the implementation of the law without fear or favour.
Our executive, legislative and the judiciary systems is worth revamption.
Our judges in the judiciary are having a lot of difficulties in the interperation of the laws so much so that execution of justice has become anybodys guess.Take the case of the interperation of the constitution in Perak. The peoples perception of the judiciary for a fair judgement is eroded.
The government owes everything to the people and should be accounted for every action.The administrators fail to realize their commitment and responsibilities towards nation building.
We can debate on this matter until the cows come home and nothing is going to change.
An Indian proverb that says “…..a crime is continuous process as long as the wrongdoer vehemently justifies his act”.
Corruption may never be eradicated, but lets not stop the enforcement of laws against the corrupted and hope that our country’s corruption index rating improves.
Is this too much to ask from a society that is hoping for a better MALAYSIA?

No need to be too concerned with trials taking ages and being ‘unpredictable?’ There is another court above the Federal court which sits every 5 yrs. This court is not selection-constituted, non-appealable and delivers written judgements.
You can control the police,AG,MACC,courts(regal and legal) but ignore the peoples court at your own risk. By that time all your sweets and goodies is pouring water on ducks.

Esuk akan mula lah persidangan agung PAS. Ada banyak jawatan di pertandingkan. Termasuk lah jawatan Timbalan President.
Apa yang menarik nya setiap calun telah cuba mengaitkan perkataan UMNO dan BN dalam kempen mereka untuk mendapat sukongan dan simpati dari perwakilan.
Nyata lah PAS tidak ada kekuatan sendiri untuk menjadikan sebuah parti yang indintiti atau pun sebuah parti yang akan jadi saingan pada UMNO.Ada calun2 ini bertegas dan sombong mengatakan mereka tidak akan membawa PAS kedalam UMNO. Tidak juga akan bersama BN. Maka apa yang dilihat disebalik kempen2 ini seolah2 ada dua pehak didalam PAS. Namun untuk mendapatkan undi calun2 ini senada menolak bekerjasama dengan UMNO. Sebenar nya PAS iri hati dan cemburru kerana UMNO menjadi Teras dalam BN dan kerajaan. Tidak seperti PAS hanya jadi balaci atau jadi kuda tunggangan DAP dan PKR. PAS memang sedar hal itu.
Ini jelas apabila suara Pemuda PAS mahukan PAS menjadi tulang belakang dalam Pakatan Rakyat bukan sebagai Pak Turut atau sebagai pelengkap kuota dalam gabungan itu. Apakah DAP atau Annuar sanggup berkorban semata2 untuk memenuhi hasrat PAS itu dan mereka pula akan jadi balaci PAS. Mana mungkin kerana PAS pun bukan lah kuat mana snagat jika di bandingkan dengan DAP dan PKR. Berapa sangat kerusi PAS dalam Parlimen dan undangan negeri.
Walau pun PAS nampak hakikat ini namun PAS lebih bersedia berpelukan dengan DAP dari saudara sebangsa dan seagama dengan mereka. Pemimpin PAS terlalu angkuh dan sombong dengan UMNO.
Kita lihat lah siapa yang kan menang dalam perebutan jawatan2 ini.

If the environment we live in is saturated with corruption and corrupt activities, if every little napoleons are on the take, and if no uniformed persons can be trusted with enforcing the rules as per their duties – what are the powerless individual citizens (like me) to do? Should we just capitulate and do a “if you can’t beat them, join them” stuff? Or should we “join them and beat them at their game” kind of thing? I was in Manila for quite a while during the late ’80s/early ’90s, and I thought Malaysia wasn’t so bad then. Now have we joined them and beaten them at that game already?
I think its the enforcement (or the lack of it). Does anybody really think that Singaporeans are so saintly and incorruptible? Huh, the way they litter the moment they crossed the border can be quite nauseating, to say the least, not so much from the smell of the garbage, but the notion that they are so neighbourly and law-abiding. I would not want to push it too much…but lets see what’ll happen when strongman K.Y.Lee is gone for good and weak government is at the rein…..well, yes, I’m merely speculating here, but I’ve seen enough for the right to be skeptical.
Me, I’ll just do my own things, mind my own business and lessen my dependence on the powers that be to get things done. So, of course I’ll have to accept the fact that not much things will get done, and I should then just go and complain to the public complaints bureau or something – if theres any, and not try to pay somebody off (or a few of them) up there….I’d just pay the traffic fine if stopped for overspeeding etc. (But funnily enough, the policemen nearly always let me go with a mild warning when they saw my face…muka welfe kot…hahaha!). I have not joined any political parties simply to avoid the temptations of ambitious politicos or (most unlikely) the temptations of office. I will not bid for contracts especially government contracts..etc. etc. etc.
I know, theres bigger forces at work. For some, theres too much at stake for them not to resort to bribery and corrupt practices….eg. a coveted political post perhaps…or a prized project…or theres something they can’t do without and they have to have it by hook or by crook…moral, ethics or integrity be damned!
Do not give even if you’re squeezed between the devil and the deep blue sea…you just have to pay the full price…no short cuts, no queue jumpings. If you can’t get what you want, just move on and do or find something else. Of course, all easier said than done. But then, if theres no giver, they can’t take, can they?

Its easy to say that corruption exists (and blaming Tun) but to prevent it is difficult as a whole! Corruption is a disease which every nations in this world face. I don’t think the opposition if they rule this country is free of corruption. They may be worse than the BN. You can expect this to happen when you see how their leaders behave and their credibility is very questionable. However I don’t agree that corruption should be practiced here and those found guilty must be punished and jailed.
I understand it is better to fight corruption at all costs but to be realistic it is not possible to get rid of it totally. I support the effort Tun is trying by commenting on the subject and its never too late even after Tun left office. Like I said its easy to blame you or others but these people behave irresponsible and probably did nothing in their lives to counter the menace except wasting time among themselves at coffee shops just talking endlessly about it!!

Sesungguhnya penyakit rasuah ni telah ujud sejak terciptanya manusia di dunia lagi, cuma cara transaksinya sahaja berbeza mengikut zamannya. I think its very timely you wrote on the subject of corruption.
The two collapses and the PKFZ fiasco come to mind.
Particularly the stadium roof collapse in K. Terengganu. Imagine if it had happened when the King and PM were there for a major function.
In the PJ case seven lives were lost.

Our “Islamic” government and “Islamic” leaders are bunch of hypocrites when it comes to corruption. Living examples are Ali Rustam in Melaka and the current Umno Youth head. They were found guilty weren’t they?
In the PKFZ case, one of the persons implicated was exco for Islamic affairs during BN rule in Selangor.
I think the stadium collapse is a warning from God to all “Islamic” leaders who fit into the ” hypocrites” category (Never miss their daily prayers, might even wear skullcaps and songkoks but engage in corruption with glee).
The next time such a thing happens, they might very well be on the receiving end.

Corrupt practices has been in existance for a long time even before YBbh Tun was the PM then.But what matter now is how the new PM would cope and dismantle, minimised the corrupt practices within the Goverment, UMNO & BN to start with.Matters are even worse when AAB was then the PM and is out of control.For a start I as an UMNO member would seek for KJ to be remove as the KP of UMNO and those quilty of corrupt practices. I know this is hard, and difficult for DSN but as indicate previously “Few bad apples will destroy the whole crates which is goood quality”.UMNO members from the Branch and Cawangan are mostly corrupted and has no respect for the Rakyat, only for themself and their immediate family members.Most have been in thier seats for a long time and confortable enough. How is UMNO going to be strong and respected if most of the old methods and system is still not being made right.UMNO must nominate those that are sincere and have the true hearts to serve the party and rakyat. As a Malaysian who has been residing and working in Singapore for past 18 years, I would like to share some critical points that might have contributed to corruption.
Who is not corrupted? Every human being from a mother to the ministers level are corrupted. The important points will be what is the level of corruption or how much he/she is corrupted. I believe the main culprit is the failure to our education system. The education system whether national level, tertiary level, religious level or home teaching. Parents, priests, ulamaks etc. are moving towards a very materialistics life. Moral and realism of life teachings are being totally ignored. Even those attended religious studies during their younger days which I believe almost every leaders (govt/opposition) should have attended.
When other bloggers mentioned that Hudud Law, Islamic states, I am puzzled? Does this will change the mentality of the rest? I doubt so as we are sincerely lacks of self being and changing mentality. The people of Malaysia only prepared for changes and follow the European or white skin men. Even they don’t trust their own ethnic people. We are a group of weak nations!!
Practically, corruption will exists when there are 2 parties being involved. One is the giving and another is the receiving parties. As a normal citizen, can we stop being the giving parties? I doubt so as we are a very short sighted and living with a very low moral esteem.
No point of condemning the leaders/civil servants, when we are not willing to abide the law and follow the correct path. We are actually encouraging those assholes to commit more adultery(corruption) because as the normal citizen we are lacking the moral of life. A better education is the only way to guide the people to become a better nations. Please study how the scandinavians countries have a very low corruption practices. I strongly believe that my parents has instill such mentality that I don’t willing to pay any extra to any idiots/assholes in achieve something. I have been trained to ignore such practices which I am sharing my next generations now.

Thank you for your thoughts on corruption. Yes there was corruption during your time though not for lack of trying to stamped it out. There was corruption before your time too. And I do not believe for there to exist a government that is not corrupt at all. Maybe this is the next oldest vice since man existed.
But I would argue that corruption is more prevalent, more abusive involving bigger states and bigger sums of money. Among the higher echelons of society. And they are more likely to get away with it because their know how and the technical knowledge of their disposal.
This is why there exist the prevalent perception among the general public that only the small fry gets caught whilst corruption involving people handing away millions, tens of millions, hundreds of millions all do it with glee and we have yet to see them in the courts.
The fact is this are the people who can bring the country to its knees. Selling away considerable and crucial interest of the nation and people for personal and selfish gains.
I would opine that this scourge became more pervasive during the last administration. We still need to know about Agusta to cite just one case and of course the aptly named fourth floor boys and the chief among them made almost obscene amongst of many by deciding who gets what. And they made it all during that short period of time. Thank God I fear to imagine what would become of us all if that administration had continued for much longer.
We need to eliminate corruption, that is the ideal, but I do not think we can ever achieve it, not in this country or any other country on the world. This includes all the powerful nations and the biggest democracies in the world.
The financial troubles plaguing the world now has its roots in the banking system of America and the decisions and awarding of huge remuneration to their chief executive officers. It is their greed and, the impossible to sate type of greed that has resulted in many floored decisions and brought about misery to thousands hundreds of thousands of lives besides that what about the overly powerful Jewish lobby. So many American presidents before now has had to apiece Israel no matter if the consequence is the alienation of many countries in Africa, the middle east, and Europe. The intense greed with which the Jews hold the U.S congress to ransom is corruption

So lets us all not be to dishearten with corruption in this country. Of course the government should continue with its effort to eradicate corruption. If you asked anyone why they take bribe…. they will probably reply “The government (BN la, siapa lagi) is the biggest corrupter. They took billions of rakyat’s hard earn money as ‘commission’. So what is a few hundred ringgit?”
Sadly, I have to agree with them. Kepimpinan melalui teladan. MV Augusta, Scorpene, Shukoi jets, Eurocopters, Scenic Bridge, PKFZ, Mr. Close-one-eye, KJ, Perwaja, AP, Matrade building, PSC Patrol Vessel, and etc.
Surely there are more projects which have not been exposed yet.
Oh yeah, talk about Anti-Corruption Law. If we have proper governance and enforcement, we don’t need to introduce so many laws. Singapore is one of the BEST countries with lowest corruption cases, why can we just ADMIT and LEARN from Singapore?!

Amirsham is not the right choice. If I were Najib I would pick Tan Sri Dato’ Mohd Ali Hashim of Johore Corporation to be the Chairman of NEC.
Najib is rather slow in getting the Council members on board and start cracking their heads to turnaround the economy. It seems there is no sense of urgency.
I don’t know what is Najib’s priority now. ONE MALAYSIA is already in place. We know more or less his mission for national unity. Now the next step is to spend more time to stir the economy which is dwindling into a negative zone. If he fails to stimulate the economy within this year I think he will be in trouble.
Tun Mahathir is still giving him the chance to breathe and settle down. But it won’t be too long. He hasn’t started crticising Najib yet. Once he smells something is not right then Najib will face hell just like what Pak Lah had experienced before.
Don’t let Tun Mahathir’s open his big mouth. Once he starts talking people will start thinking hard whatever he says and start making analysis of Najib’s performance.
We have to accept the fact that there are a lot more people still respect the views and opinion of Tun Mahathir. His chedet.com is the most powerful blog in terms of number of hits. People will always diligently read his comments and at the same time have the opportunity to react whatever comments he put forward. It could be disastrous for Najib if the comments made by Tun Mahathir are negative.
To Najib, I would like to advise him to be cautious and don’t take things for granted.

Can you comment on why we have so much problems with our buiding? From several buidling in Putra Jaya and now the latest one, the Sultan Mizan Zainal Abidin Stadium, many are “problematic”. How do you think we should tacklethis problem? Is it because we Malaysian do not know how to build the buiding right? or is it something else? I tend to think this is related to corruption or some unreported reasons, because hard for me to believe our contractors and our people are less capable…..

Rasuah satu gejala yamg tidak boleh di hapuskan sama sekali. Di seluruh dunia ujud perlakuan rasuah. Rasuah telalu besar skop nya dan agar sukar untuk di bendung kerana ia nya bukan sekadar bentuk sogokan wang. Dalam keadaan negara sekarang kerajaan BN memerintah maka kerajaan ini dilihat dan dituduh konon nya telah banyak melakukan rasuah. Pelbagai fitnah memburuk2kan kerajaan dalam issu rasuah oleh pembangkang adalah hanya untuk menjatuhkan kerajaan.
Namun jika dilhat pembangkang pun tidak kurang mengamalkan rasuah.
Jika mereka berkuasa rasuah tetap tidak boleh dihapuskan. Mungkin akan terus subur tiada siapa yang akan dapat menyakinkan. Ini kerana sebelum mereka berkuasa dan memerintah negara,didalam Parti mereka pun telah ujud rasuah untuk mendapatkan jawatan. Apa yang hanya dapat dilakukan kerajaan mengandakan usaha untuk mengurangkan nya di tahap yang paling rendah. Corruption is controversial. Does it mean bribery, favouritism, nepotism, cronism, gifts, commission payment for a certain contract awarded, favour done for a favour owed. Humans are gregarious and social animals. They tend to show favour to their kins and kinds. You normaly show favours to your friends and not to your foes. If a chief minister recommends a datukship to a chieften in umno election for supporting him, is it corruption. There is no surah in the Quran on corruption per se as being sinful. Quran talks more on being fair and just. Corruption may not be ethical and fair. Anwar Ibrahim was found guilty of corruption charges for asking the police not to take action against him for sodomy. There was no money or other incentives offered to the police. Giving bribe of rm5 to traffic policeman by motorbike rider asking the police not to summon him for not having motorbike licence is plain corruption. False and fictitious claims by government servants are considered corruption.
Recent claims of government corruptions are political propaganda with political motives. While the opposition claims the government is corrupt, at the same time they entice BN MPs to cross over while Pak Lah just kept quiet and be docile.
In my opinion claims of government corruption are mere jealoucy, sour grape mentalty and has hidden agenda. If anyone has any evidence of corruption by any individual he should report to the police. pada hemah saya,perbuatan rasuah politik dilakukan menggunakan duit hasil dari rasuah. saya ingin mengambil contoh seorang ketua menteri yang didapati bersalah mengamalkan politik wang yang pada pengetahuan umum mengetahui bukan dari keturunan berada tetapi mempunyai wang yang banyak untuk di beri kepada perwakilan.
Sudah sampai masanya UMNO dan kerajaan mengamalkan sistem memberikan tender kepada penawar yang terendah untul mengelakkan pemimpin2 dari menerima habuan untuk ditaburkan pada pemilihan parti. Ianya juga dapat memperkasakan kaum melayu kerana dengan sistem demikian, perlakuan ali baba dapat dibenteras kerana dengan harga terendah, tiada orang yang sanggup membuat kerja tersebut melainkan kontraktor itu sendiri terpaksa berusaha sendiri.

Dear Ayahanda Tun, I am 100% agreed with your comments especially the one regarding the political corruption. The two parties involved are definitely not to lodge any complaint as they are protecting their own interests.

We have heard so many cases of corruption but the judicial are so guided and toothless that we only heard no conviction, no case, etc.
What we need is not more laws because the judicial branch is not independent minded.
What we need is a strong political will to bulldoze away all the skeletons of corruptions surfaced. Get rid of Barisan Sampah and elect Pakatan Rakyat in to spring clean. After that sweep away the corrupt part of Pakatan Rakyat. After a few General elections, all the corrupt politicians will be removed.
Then you have integrity in the government.

Saya setuju seranan undang-undang anti corruption yang lebih tegas untuk pemberi dan penerima. Tetapi undang-undang sahaja tidak cukup sekiranya sekiranya tidak ada enforcement.
Saya ingin merujuk contoh ynag berkait rapat dengan senario politik dalam UMNO sendiri yang menggariskan tata etika salah laku ahli dan siasatan dibuat oleh Lembaga Disiplin. Kes ini bukan kes rasuah tetapi memberi implikasi bahawa walau pun ada undang-undang yang bersalah masih boleh dilepaskan dari hukuman. Apabila Lembaga Disiplin telah menghukum sesaorang itu bersalah dan dia di gantung daripada keahlian maka dengan satu keputusan sahaja yg dibuat oleh Majlis Tertinggi maka yang bersalah akan menjadi tidak bersalah dan disebaliknya menjadi Wira.Ini ialah satu keputusan yang tidak adil telah dilakukan oleh MT terhadap ahli-ahli yang setia kepada parti.
Ketua UMNO Bahagian Pokok Sena Kedah telah didapati bersalah terlibat dalam MEMSABOTAJ parti dalam PRU12 tetapi peraturan baru MT membenarkan dia memegang jawtan Ketua Bahagian semula. Pada hal dia yang bertanggongjawab sapertimana yang terdapat didalam laporan pertuduhan dan sptmana yang disiasat oleh panel Lembaga Disiplin.
Disini undang-undang dan peraturan yang bukan berbentuk corruption pun tidak bermakna apabila ada badan yang lebih tinggi menukar peraturan dan yang bersalah menjadi tidak bersalah.
Keputusan begini menyebabkan ketidak stabilan politik didalam Parlimen Pokok Sena dan orang ramai tidak mungkin menghormati tatetika dan keputusan Lembaga Disiplin dimasa hadapan.

Actually I do really think that the law that documentted in our country is just enough to curb the corruption,though it still can be improved.I believe that the obstacle is about the implementation.Hong Kong ICAC even recognized that we have the better system than their but the implementation really drag our country to an adversity.

Maybe its time we study the real Hudud Law. Though its should to implement and practice it as a whole, we could also implementing it slowly, stage by stage. Islam was given to us in stages by Allah, the All-Knowing. There are a lot of things we could learn from this.
Maybe at first stage, we can study the concept of it, and implementing the concept. I do not know much of it, but I can comfortably say, it promoting “fear of doing wrong doings”. That is why hudud are carried out in public, as a lesson to the sinner, of “do not do this again”, and also as a lesson to those who saw it, “this is what you will get for breaking the law”. Those who still dare to do such unlawful acts, may Allah have mercy on him.
By the way, I am not an ustaz nor a pious man. I am certainly not a PAS member.

Undang-undang ciptaan manusia selalunya akan menyusahkan manusia itu sendiri. Kebanyakan undang-undang yang sedia ada di negara kita sendiri berasal dan merupakan tinggalan daripada pihak penjajah dizaman penjajahan dahulu.
Apakah dikira adil jika seseorang pesalah yang dengan sengaja dan nyata melakukan kesalahan tetapi atas sebab-sebab tertentu seperti kekurangan bukti ataupun tiada saksi telah dibebaskan. Keadaan seperti ini kerap berlaku dimana-mana mahkamah masa kini.
Siapa yang akan berasa takut dengan undang-undang ciptaan manusia kiranya peluang untuk melepaskan diri setelah melakukan kesalahan masih ada dan cerah jika berupaya melantik seseorang peguam yang pandai dan handal tentang seluk-beluk undang-undang tersebut.
Bila seseorang itu dibayar upah yang tinggi untuk melepaskan seseorang pesalah, maka orang tersebut bolehlah dikatakan sama-sama bersubahat dengan sipesalah seumpama menghalalkan kesalahan tersebut. Jika kalah, sepatutnya kedua-dua mereka patut menjalani hukuman dan bukan sipesalah sahaja.
Berkata benar dengan bersumpah sudah tidak bermakna lagi dizaman ini. Manusia sudah tidak mempercayai satu sama lain. Kata-kata seseorang sudah tidak boleh dipakai dan tidak boleh dipercayai. Segala nasihat berguna, tunjuk ajar dan petunjuk kepada kebenaran dan kepada keselamatan diri sudah tidak diperendahkan lagi.
Seakan-akan kebanyakan manusia sekarang ini sedang berkhayal serta mabuk dan sudah tidak dapat membezakan antara realiti kehidupan dan dunia khayalan. Minda manusia sudah berjaya dikawal oleh suatu kuasa yang tidak dapat dikesan kerana pengaruh persekitaran dan aktiviti rutin harian yang dilakukan oleh manusia itu sendiri.
Mungkin manusia akan hanya terjaga dan sedar sepenuhnya apabila ajalnya sudah sampai dipenghujung atau setelah berada di alam barzakh.

All your suggestions mentioned in this blog sound good and viable in the sense of favouring evidence gathering in order to fulfill the requirement of the Criminal Procedure Code and to bring compliance with the due process of court proceedings for getting an alleged convicted with substantiate evidence.
However, we may face some problems during the phase of implementation. Just take Chin Peng’s case for instance. The Federal Government of Malaysia under Tun’s administration had already signed up a peace pact with the former Secretary-General Of Malayan Communist Party (MCP), Mr Chin Peng, on 12.12.1989. As part of the terms and conditions of the peace pact, the members of MCP had to surrender their weapons to the Thai Armed Forces, with the supervision of Malaysian Police Force. When the peace pact was signed by Tan Sri Rahim Nor on behalf of the Federal Government of Malaysia, it was agreed by the Malaysian Government that ex members of the dissolved party MCP would be permitted to return to Malaysia.
However, during the stage of implementation of the peace pact, there were many government high ranking officials trying to play some dilly dally games by rejecting Chin Peng’s home-coming application with all sort of excuses, most of which were just lousy excuses. Some even cited long-lingering hatred, bitterness and unforgiveness as the reasons for rejecting Chin Peng’s application.
If Malaysians are proven to be promise-breaking and unforgiving people, how do we expect the majority of common Malaysians to be able to accede to a law which will give pardon to a crime participant who is willing to stand as a critical eye-witness in the court trial on corruption case in order to get the bribe recipient convicted with substantiate evidence, especially when the eye-witness himself was also the morally and legally wrong bribe initiator and the bribe giver who offered the bribe to the bribe recipient?
So Tun, what would you recommend to prohibits/reduce the corruptions in the country effectively?

If the Govt has no will-power, all it requires is for the King to insist we have an Anti-Corruption Law and force the issue where:-
1. The convicted giver will be fined or sentenced to prison twice the amount the receiver will be punished by.
2. Whistle blowers’ identity will be completely protected, and if necessary, they may be placed under a witness protection programme.
3. The head of the ACA should be appointed by a representative committe of Parliament. The ACA Head should report to Parliament and be given the power to prosecute without refrence to the PM or the Attorney General.
mnay other important clauses can be included in a new Act, but the (1) to (3) above are the key ones. Take a leaf out of the ACA in Hong Kong and ASustralia.

Spot on!! An interesting topic!! Just to share a remark by a friend who does business in Indonesia and Malaysia, who says in his experience corruption is worse in Malaysia!! Yes, something that I felt disgusting. What is happening to our country?? Are there too many “greedy” Malaysians?? A real shame!!
It looks like political corruption is not only rampant for those in power but also among the opposition. The irony is that they do not deem it as corruption. I guess it is a matter of interpretation to suit one’s needs and wants!! Well Tun, if everyone is clamoring to be rich it is fine for as long as it is gained via working hard for it and not certainly not via short cuts. I guess this is referred to as the “work smart” syndrome!! Alas, it is doing more harm than good to the economy and the country.

Sebagai seorang rakyat Malaysia dan juga seorang penjawat awam, saya amat mengalu-alukan saranan Perdana Menteri ini dan tertarik mengulas tentang gejala rasuah dan salahguna kuasa di kalangan kakitangan awam.
Apa yang saya ingin kongsi dan dedahkan kepada pembaca dan golongan penggubal dasar adalah tentang keadaaan dimana pegawai rendah didalam sektor kerajaan seringkali diarahkan oleh pegawai-pegawai atasan kerajaan untuk menyalahgunakan kuasa dan melakukan sesuatu yang mempunyai kepentingan peribadi pegawai kanan berkenaan. Biasaanya, arahan-arahan dari mereka-meraka ini adalah jelas secara lisan dan pegawai-pegawai rendah mesti melaksanakannya walaupun bertentangan dari etika kerja dan melibatkan rasuah. Masalahnya, apabila pegawai-pegawai rendah ini tidak melaksanakan arahan secara lisan tersebut, pegawai-pegawai rendah ini akan ditekan,didera secara mental hingga sukar untuk bekerja dan diminta untuk ditukarkan ke jawatan lain. Untuk melaporkan perkara tersebut adalah agak mustahil kerana tiada rekod bertulis atau bukti-bukti yang membuktikan arahan pegawai kanan tersebut. Keadaan ini menyebabkan Pegawai-pegawai rendah ini tiada pilihan selain dari terpaksa mengikut arahan lisan tersebut. Situasi kami sebagai pegawai-pegawai rendah ini umpama ditelan mati emak,diluah mati bapa. Dilema ini telah saya saksikan sendiri dengan mata kepala saya dimana rakan setugas saya sendiri telah dikenakan hukuman kerana melakukan sesuatu yang bertentangan dengan kehendak pegawai atasan saya. Dia ditekan dalam pejabat, deraan secara mental dan ditukarkan ke jabatan lain dan imej beliau digambarkan sebagai seorang yang bersalah hingga terbawa-bawa ke tempat baru. Dan saya juga telah manyaksikaan pegawai rendah dikenakan tindakan kerana menuruti kehendak pegawai atasan dan pegawai atasan tersebut tidak mengaku memberi arahan secara lisan apabila disoal siasat. Untuk melaporkan perkara tersebut kepada pihak berkenaan seperti BPR juga mempunyai risiko tinggi takut-takut memakan diri sendiri dan lebih membimbangkan, dikenakan tekanan dari pegawai atasan. Untuk melaporkan perkara ini kepada pegawai yang lebih atasan juga adalah tidak praktikal kerana pegawai yang lebih atasan itu kawan-kawan rapat mereka juga. Malah saya juga mengambil masa yang lama untuk memberi respon pada situasi semasa dan menulis perkara ini kepada media. Bimbang akan apa jua kemungkinan buruk yang mungkin berlaku kepada saya.

With corruption things come easily,from favors to monetary gain. Go to hell with moral obligations,by hook or by crook I must consolidate my stature and with money there will be respect and power will soon creeps in.
One example the Drug Act,with the mandatory of death sentence drugs distribution is still rampant and the question is WHY? So from here it is self-explanatory why corruption cannot meet its death?

1. One thing for sure, when people get tired of the corruption, they will vote others party in the future election.
2. Current government will sure somehow hide their wrong doings and this will give a bad impression of themself.
3. What should we do? The oppossition is not proven to become a good leadership. The current leadership is now being corrupted and afraid of their mistake.

Rampant bribery is due to lack or no enforcement of current law / regulation. If an application is supposed to be processed in 5 days, it should be in 5 days or less. But when it is more than 5 days, nobody cares. This opens opportunities for bribery. all govt servants must be given KPI and answerable to thier actions. Today there are a lot of opportunities to create situation where a person has to bribe to get things done.
A very good example, is when DS Najib visited Puduraya recently, he was not happy of the development and happenings around Puduraya. There are scumbags selling tickets at higher price, busses parked at roadside, etc. Whose job to ensure there is no scumbags selling high priced tickets? JPJ? DBKL? Police? Why are bus operators choose to park along the roadside – there are already laws for this. Why the relevant authorities are not enforcing it??? The same when we go to several areas, where double and triple parking is a norm? Why? Are the authorities blind? Or they are full (kenyang)?
Then govt have to fork out money to rectify what should have been rectified should the law being enforced. Like in the case of Puduraya 20 million is allocated. total waste, that is my money too !! Government set many Commissions to rectify problems, eg. Suruhanjaya Penambahbaikan Polis, etc, etc, money wasted, result = nothing.
If Tan Sri Koh Tsu Koon and other Government officials are reading this, just enforce the law, ensure KPIs are set and make sure civil servant deliver as they should, then bribery can be reduced.

I agree with you totally on your article. You are right and I think the first few measures taken should be :-
1. Protect the whistle blower
2. Give a reward as being done in Penang by Lim (RM10,000)
3. Assign corruption ‘policemen’ personnel in UMNO to walk about and inter-mingle with UMNO members to snoop on who is practising corruption. He should not wear uniform.
4. Use electronic advanced devises to eavesdrop on UMNO party leaders
My last point may be quite controversial but since UMNO has been labelled as a party “having corruption and with a high number of corruption reports lodged”, it is a necessary measure to do so.

I am not going to write anything you don’t already know. I’m writing to vent out my frustration, so please bear with me…
The Malays, from what I know, are Muslims and therefore to the Muslims, corruption is HARAM. The Chinese however, regard corruption as part and parcel of business. They will not call it corruption. They usually regard it as gift. The Malays, being the majority in the government, will receive these ‘gifts’, initially with much ‘malu-malu’, but then over time, these gifts that appear during Chinese New Year, Hari Raya, bithday and other special occassions, become something expected.
The Chinese business people would rather deal with those in power who will name their price and accept the gifts. They know it’s a relationship thing. Those who receive will protect them and will be a conduit for future opportunities. When the Malays see these, especially the business people and those officers from the lower rung, initially they are disgusted. Some may have reported these, but as you say, since it’s very difficult to prove, and since they can see with their own eyes those who are guilty with corruption not only get away scot free, but also prosper enormously, they also join in. What with the paltry amount that the government servants get at the end of the month with so many things to fulfill, corruption is the only way to go to ensure the family and self gets everything that they need and want. Further, with the Malays’ attitude that they can ‘bertaubat’ before they die, they live in denial that everything will be AOK…
With regards to the giver, what is happening today is it is expected that if we want anything to move or any work to be done, or some problems to be solved, there must be ‘imbuhan’, otherwise things will be difficult. Under the circumstances, those that tries to do the right thing will not get anywhere. It’s just like queing in a traffic jam, we see other cars ‘potong’ from the left, most of the time using emergency lane, and get in front, and nothing happens to them. No police, nothing, absolutely nothing. Initally ‘sakit hati tidak terkira’, but after awhile we not only live with it but join the race to use the emergency lane. So, it is implied that you must give something to get something, doesn’t matter if it’s wrong, because later everyone can ‘bertaubat’. Now who can tell me what is wrong with this situation? Who can say why the poor people have to give ‘imbuhan’ to get work done?
My take is if the ‘Kerajaan’ wants to make things right, the ‘Kerajaan’ can make things right. It has been shown that when the ‘Kerajaan’ wants something, the ‘Kerajaan’ gets it, never mind if it’s doing something wrong to the rakyat who voted them in in the first place. But when the ‘Kerajaan’ itself is corrupted, does the ‘Kerajaan’ wants corruption to end? What advantage does the ‘Kerajaan’ get if corruption ends? They can’t squeeze anymore…
I know how much you and many other people, including me, hate the Singaporean Government for what they did to the Malays there and what they have done to us, but I will be the first to admit that their Israeli tactics and methods with regards to running their government machinery is the right one. They still have a bit of corruption as can be seen from the corruption index, but not nearly as bad as us. We don’t have to go far to learn. We just need to see what they are doing and we can learn a lot from them.
I don’t know where this will go, or whether this writing will achieve anything, as I’m sure it will not, but I am sad to see what this country has become when the subject matter turns to corruption. I can’t be proud to speak my mind in a conversation with foreigners, all I have is shame when they attack our policemen, our government servants, our politicians and our people. How can I defend my country when the anecdotal evidence are overwhelming?

Kalau kita tak corrupt, Bangsa lain yang jauh lebih kaya dari kita mesti dalam kesusahan apabila mereka cuba membuat benda-benda yang salah. Disebabkan kerakusan kita sendiri, kita telah menjual masa depan bangsa kita. Apakah kita rela anak-anak cucu kita diherdik dan dimaki-hamun sebagai bangsa yang tidak boleh dipercayai, seperti mana kita melihat sepupu kita di seberang laut? Apakah dengan kesenangan yang sedikit kita rasai sekarang ini kita akan berpuas hati bila?
Dan kepada kepimpinan dalam kerajaan sekarang ini, jangan tipu kita lagi. Kalau harga barang-barang naik melambung, jangan katakan harga barang tidak naik banyak supaya harga gaji pekerja tidak dinaikkan. Barang-barang sekarang sudah mahal, kehidupan semakin tersepit. Bayarlah gaji pekerja dengan spatutnya supaya corruption dapat dikurangkan. Jangan cuba berhelah lagi….

I think in this world nowadays, very difficult to find sincere/honest people. Material has been the priority in life.
Pada saya ia bergantung kepada kehidupan bagaimana yang kita consider as happy life. Ada orang bawa Proton sudah memadai dan bersyukur dan ada juga yang bawa Mercedez baru di panggil happy life.
Sekiranya mereka berpolitik, sejauh mana kejujuran mereka untuk mempertahankan prinsip diri sendiri dan juga Party. This is very subjective.
Mana-mana Party sekalipun corruption akan terjadi. Cuma, how obvious and how serious it will be.
UMNO sekarang sudah menjadi begitu leka dalam issue ini. Even di tempat saya mereka bergaduh pasal nak dapat kuasa untuk jadi ketua cawangan saja (which is pada mereka this is the way to be jutawan express). Sanak saudara mereka akan dapat kontrak. This is why they will find any way to be selected.
Saya adalah supporter UMNO dari dulu lagi. Cuma kita agak sedih bila keadaan ini berlaku. Saya masih lagi memilih UMNO kerana mengenangkan bagaimana susahnya UMNO dulu mempertahankan negara dan bangsa.
Walaubagaimanapun, saya percaya masih ramai lagi orang yang berfikiran seperti saya. Cuma kita optimis kepada Management baru akan sedar dan buat sesuatu untuk mengelakkan UMNO terkubur.

Human being, with out regards who is he/she, peoples or government apparatus, politicus and so forth are not vulnerable from the pratice of corrupt, even the religious priest.
So that’s why we need one tools to enable us to curb these malady from protract.
I sometimes stuck in to clue, why since these days many Malaysian regards of their races, religious, education level, social stratification level and so forth easy to involves in corrupt practices.
If we bribe the trafic police officer to cover up our reckless driving let say RM10, it can also described as corrupt. But these corrupt fashion just only involve two parties and the effect still consider as small scale because it did not slash the entire nation system. Though, it still prohibit under Islam code of ethics.
I do not know whether Malaysia education system is failed totally or not. Or the education policy maker failed to recognize the motives of education. A latin quotes said that “Non scholae sed vitae discimus” which means “we study or learn not for the school or institution but for our live.”
I’m scared to read newspaper everyday where corrupted become popular practice among Malaysians. Though Malaysia CPI index still under 50/50 not bad, but these practices is maddening.
If peoples, organization, institution, the arms of government, and the government it self involve or snare in this practices, nations no more longer exist or established untill the end of the day. It just being a dust of history.

1.Sebab itulah Allah s.w.t suruh melaksanakan hukum “hudut” atas perbuatan mencuri.Mungkin tiada jalan putus untuk mengatasinya di dunia ini.Sementara hukum sebenar keadilan akan terlaksana diakhirat nanti.
2.Kelebihan kepada manusia yang berakal sesungguhnya membuatkan manusia mengelak melaksanakan hukum-hukum yang ditetapkan oleh Allah s.w.t akibat tiada kawalan keatas nafsunya.
3.Akal sahaja bukanlah sesatunya anugerah yang boleh mendekatkan diri kita kepada Allah s.w.t.Sebaliknya perlu kepada PENETAPAN oleh HATI kita terhadap sesuatu KEPERCAYAAN.Kalau dihati sudah di cap sudah tidak PERCAYA..segala kajian terhadap KEBENARAN tidaklah akan memberi sinar kepada PERUBAHAN…
4.Kita boleh kategorikan “RASUAH” seperti keadaan itu selagi tiada hukum-hukum Allah s.w.t yang maha berkuasa atas dunia ini dan di alam gaib..maka gejala rasuah yang tidak nampak keberangkaliannya untuk menyelesai secara hukum buatan manusia sering kali menghampakan kita.
5.Kita selalu dihampakan oleh JENIS HUKUMAN YANG DIKENAKAN TERHADAP PESALAH.Adanya perbezaan hakim-hakim yang melaksanakan hukum-hukum yang berasaskan undang-undang atas “demokrasi” ini dengan hukum-hukum Islam sebenar sekarang.
6.Dalam Islam..hakim beragama Islam diminta bijaksana serta berkemampuan dan berijtihat(bersungguh-sungguh guna fikiran mencari yang terbaik yang timbul dari niat yang baik.(dapat pahala)
7.Adil membela yang lemah jangan sampai teraniaya dan yang kuat merasa pula ikhsan jika dia dihukum..hukuman itu patut seimbang dengan kesalahan dilakukan.
8.Penghukuman mestilah tazkiyatun nafei iaitu pembersihan diri-timbul niat baik dari iman yang dalam dan amal salih..adakah golongan ini ada sekarang ?
9.Hakim-hakim dalam Islam diminta jangan menjual kebenaran dengan harga sedikit….jangan dituruti kehendak hawanafsu…waktu menghukum seseorang tak boleh ditakuti melainkan Allah s.w.t.
10.Hukum Allah.s.w.t untuk kebaikan semua manusia dunia dan akhirat…

It is undeniable that efficiency is important in our personal capacity and centrally vital in our capacity as a nation. i might be young in age because of not knowing what is the rationality of bribery in politics.
but what i do understand is,
the rationality of being honest, clean while maintaining intergrity in order to make malaysia a better place to live.

If Malaysia wish free of corruption the 1st thing is set all who have the authority in BN frm the government post and all whatever head & head, then choose 1by1 who is really possible and probably clean but if the person now is clean also does not mean future he wont be dirt so it is really hard.. Really honestly said “amalan rasuah dalam BN memang berleluasa cara yg paling berkesan adalah biar Pakatan menang dan kononnya sesiapanya skrg orang kuat semua menjadi pembangkang tiada kuasa tiada rasuah..
Also I am not saying that Pakatan take over there also no corruption bcos prove show that there also have frogs in Pakatan, where is human there will be corruption but at least it will be better than arrogance BN because BN already to powerful in last few decades especially in Mahathir Era ppl all not dare speak about BN wrong because if speak any wrong then the fate is ISA..
Mostly ppl now joining BN also have certain demand but less contribute( Do u know how many poor person who can suddenly becoming very rich if there are their cronies becoming leader in UMNO? Satu lagi projek Barisan Nasional can causing a poor becoming a rich?) so a balance government will help alot to the government and rakyat, so rakyat must have the responsible to balance it dont always let BN 2/3 and for me I hope and pray that forever BN wont have the 2/3 majority..
If the leader or head (or behind the power) of the BPR is corrupt then how corrupt can stopped?! We are not hope to stop the corrupt bcos it is impossible to do it in every country but we hope that we can bring it to the lowest percentage! Izzit so hard?! No it is not hard if our the 1Malaysia minister is willing but are they willling? For what o becoming politician? Izzit really for the sake of million million rakyat? No.. 1. Apakah rasuah?, secara global..? secara nilai2 malaysia?.. nilai2 setiap kaum di malaysia yang mempunyai pelbagai sifatnya? ataupun interpretasi secara agama boleh dipakai atau dipersetujui oleh semua pihak? adakah bila melibatkan wang baru dikirakan rasuah? bagaimana jika kegagalan menjalankan kerja juga dikirakan rasuah?
2. Isu interpretasi inilah perlu dinilai dan dipersetujui oleh semua pihak dan diterapkan nilai2 ini di bawah satu sistem persekolahan ( dimana malaysia mempunyai tri sistem persekolahan dimana mempunyai tri definasi rasuah-LoL)
3. Faktor2 penyebab rasuah dan sistem yang boleh mengelakan rasuah berlaku( jangan seperti masaalah parking kenderaan di malaysia dimana samada parking tiada atau tidak mesra parking- adakah adil kereta semua di saman atau ‘town planner’ dan pembuat dasar di surcajkan . hahahaha)
4. saya tertarik kepada isu laluan di bukit mahkota di cheras dulu, adakah kita boleh caj rasuah kepada developer? town planner? ydp? ahli majlis? dan juga kepada menteri kerja raya yang sudi membayar sejumlah wang rakyat kepada kepada konsesi lebuhraya disebabkan laluan terpaksa dibuka. urmm..kelemahan pengurusan juga boleh dikenakan rasuah lah kan… sebab tiada bukti menunjukan unsur wang wujud…hahahaha
5. Bagaimana dengan janji pembangkang kepada rakyat yang tidak ditunaikan, boleh kita caj kan rasuah kan, hahahahah
