MALAYSIA’S SHAME

1. There was a time not so very long ago when Malaysia was admired for successfully raising itself from an impoverished third world country into a stable newly industrialised country. No one doubted that its announced intention to become a developed country by 2020 would be achieved.

2. But today when we go abroad we are asked, “Hey, what happened to your country.” Some mention 1MDB and the corrupt Government which has lost billions of dollars. Many comment on the lavish lifestyle of the Prime Minister.

3. They asked these questions because reputable foreign newspapers publish stories about 1MDB, about the Prime Minister having appropriated to himself billions of dollars, about huge amounts of money in his private accounts, about his lavish life-style. No Malaysian Prime Minister can afford the grand wedding that he had for his daughter.

AG TO AG

1. Following upon the Malaysian A.G.’s (Tan Sri Mohamad Apandi Ali) decision that the report of the Malaysian Anti-Corruption Commission showed there were no wrong doings by the Prime Minister in relation to the 2.6 billion Ringgit and 42 million Ringgit in his personal accounts, perhaps coincidentally, the French legal authorities have initiated legal action on the payment of so-called consultation fees to companies under the control of Razak Baginda, a close associate of Dato’ Sri Najib. Then the Swiss A.G. released a media statement against former officials of the state-owned fund 1MDB and persons unknown, on suspicion of bribery of foreign public officials (Article 322septies of the Swiss Criminal Code – SCC), misconduct in public office (Article 314295 SCC), money laundering, (Article 305bis279 SCC) and criminal mismanagement (Article 158 SCC). The office of the Attorney General of Switzerland (OAG) has requested the Malaysian Authorities for mutual assistance. This request for mutual assistance now puts the agreement in principle between Malaysia and Switzerland into concrete forms.

2. Investigation by the Swiss A.G. has revealed serious indications that the funds have been misappropriated from Malaysian State companies.

QUO VADIS MALAYSIA

1.In Malaysia the Attorney General decides if a law has been broken or not. That decision is in fact a judgement. The A.G. is both a judge and a prosecutor. This in itself is an injustice.

2.I admit I was not shocked when the A.G. decided that the report by the MACC does not show that the Prime Minister has committed any criminal act when 2.6 billion Ringgit is found in his private account or a further amount of 42 million Ringgit was also in his account. I had already said it would be his decision.

3.Merely having that amount of money in a Prime Minister’s account is already wrong even though it may not be criminal. But now the A.G. declares that the money was a gift from the Saudis.

4.It seems there was a letter by a Saudi stating that a sum of US$ 681 million or RM2.08 billion was a donation for the PM’s contribution to the fight against Islamic terrorists. Who is this Arab, how does he have the huge sum of money to give away, what is his business, what is his bank, how was the money transferred, what documents prove these. Just a letter from a deceased person or some nonentity is enough for the A.G.

5.Then he goes on to say that the balance of US$620 million or RM2.03 billion has been returned to the Saudis. How and when was this done? We are told the balance is frozen by Singapore. Can Singapore explain the unfreezing and the delivery back to the Saudis? Or does Singapore also believe in the free gift story, the letter and the Saudi admission.

6.Singapore is a financial centre. Can it be so gullible?

7.Then the A.G. concludes that there is no case for Najib to answer. He also directed MACC to close the case and cease investigation.

8.I thought the MACC is an independent body. Now it seems it is subordinate to the A.G. and it takes orders from him. No wonder Malaysia is included among the ten most corrupt countries in the world. The Anti-Corruption Agency is not free.

9.I was right when I predicted that the A.G. will reject the report by the MACC as he did with the report by Bank Negara.

10.A lot of people must know the contents of both reports. But they have all seen what can happen even when someone lodges a report to the police. And they are scared.

11.I am scared too. In Malaysia today laws and rules no longer protect the people. The OSA for example is used to prevent reports from reaching the people. On the other hand people are now exposed to abuse of the OSA and they may end up in jail. Even the ISA did not frighten people as much.

12.Quo vadis Malaysia.

VERSI BM

QUO VADIS (KE MANA ARAHNYA?)

12. Quo Vadis Malaysia (Ke mana arahnya Malaysia?)

THE TPP

1. The International Trade and Industry (MITI) Minister says it will take two years to amend 26 laws to meet TPP requirements.

2. This is a clear admission that the TPP limits Malaysia’s freedom to make laws deemed necessary for the country. These laws have been passed by the Malaysian Parliament apparently because they were considered essential and god for the country. But now they have to be amended because the TPP is apparently more powerful than our elected parliament in determining what laws Malaysia should have.

TUN RAZAK

1. It is difficult to think that 40 years have passed since the demise of Tun Razak, the much respected and beloved second Prime Minister of independent Malaysia .

2. Watching the T.V documentary on his life and times, I cannot help but feeling sad. Those were great days. Leaders then were dedicated, bent on developing the country and tackling the disparities in Malaysian society. It was Tun Razak who introduced the New Economic Policy.

3. He broke away from the apron-strings of the British Commonwealth past, and visited Russia and China. The winds of change blew strongly.

DISMISSALS AND REPLACEMENTS

1. The Malaysian Insider recently reported the MACC Chief Abu Kassim might be replaced, basing it on “source”.

2. Abu Kassim has some health problem but he himself says that he hopes to retire at 60, the mandatory retirement age. Obviously he does not think that his health would force him to retire any time soon.

3. Government has certain procedures for sick employees to retire before reaching retirement age. A Medical Board will have to be set up to examine the health of the person who seeks to retire early.

4. The Board will issue a proper medical report on the state of the person’s health and certify his being unfit to work.

5. If the officer’s appointment is at the pleasure of the Yang di Pertuan Agong, then the certificate must be produced for the Agong to agree to his retirement, and for his signature.

6. There is doubt whether in the case of the former A.G. Tan Sri Gani Patail the procedures were followed. When he was retired the PM stated that it was for health reasons. Gani himself denied this although he was suffering from kidney failure. A kidney failure person can work for quite a considerable length of time. It is not a cause for early retirement.

7. And now Gani is reported to begin a career as a lawyer. Obviously he is fit to work.

8. The question is whether the MACC chief will also be retired prematurely for health reason? It is known that the MACC has submitted its report to the AG. The AG says he would act without fear or favour. But he requires time as the report piles up to his height. How much time? Or is the AG to determine whether there is a case for the judges to judge or will he be the judge and dismiss the case as indeed he had done with the Bank Negara report.

9. There is currently a deficit in terms of trust in the present Government and its institutions. There are many reasons for this deficit. Saying that everything is fine will get the Government nowhere. Deeds count more than words.

10. The removal of Tan Sri Abu Kassim will only convince the people that all that is being said against the Government is true, that it exist merely to prevent the rule of law being applied to the leadership of the nation.

VERSI BM
PEMECATAN DAN PENGGANTIAN

1. The Malaysian Insider baru-baru ini melaporkan bahawa Ketua Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Abu Kassim mungkin diganti, berdasarkan pada “sumber”.

TPPA

1. The Government could not care less for whatever opposition that is voiced by anyone in Malaysia or abroad against signing the TPPA. It will go ahead and sign.

2. The MITI Minister assures us that we can get out of the agreement anytime we want.

3. Yes indeed we can. But it is not going to be easy and the cost would practically bankrupt us.

4. In the TPPA agreement companies can sue Government for loss of profit including future profit if Government action results in the loss.

THE PARIS ATTACK

1. Everyone, certainly every Muslim must condemn the dastardly attack by Muslims in Paris when more than 100 innocent people were killed. It was not one incident but it consisted of a series of coordinated attacks in different parts of Paris. It certainly gave Islam and the Muslims a bad image. It practically justified the claim that Islam is associated with terrorism.

2. Obviously, something has to be done to put an end to such attacks. The French Government is calling for a coalition of countries against the ISIS and against terrorism generally. The whole world seems prepared to join in the fight against ISIS in particular.

3. If we care to study history, we would not fail to note that such acts of terror have been escalating over the years. They are getting more and more terrifying and brutal all the time.

4. Those who feel concerned would notice that these acts of terror are largely confined to the Arab States in the Middle East. They began with the creation of the state of Israel on Palestinian land. The Palestinian Arabs were massacred and expelled from their country by Irgun and Haganah terrorist groups of the Israelis. They lost their land, their homes and their fruit orchards. They had to live in shabby refugee camps in other countries in the region. For well over 60 years they suffer the deprivations of displaced people. At first a few Arab countries tried to regain Palestine through conventional wars. From 1948 to 1982 they attacked Israel. But every time they were defeated as Israel was supplied with arms and money and even soldiers by America and the European countries.

5. The Arab countries accepted the fact that they could never win a war against Israel. So they ceased trying after 1982.

UCAPAN PRESIDEN UMNO

8.Tetapi kehilangan wang Kerajaan terlalu besar.

12.Tuduhan dibuat bahawa Bank Negara tahu. Apa buktinya Bank Negara tahu.

Hutang sebanyak RM 8 billion diambil alih menjadi jumlah hutang RM50 billion.

18.Stesyen digabung menjadi Edra.

25.Pendapatan dinaikkan tetapi daya beli turun kerana nilai Ringgit jatuh. Pengangguran bertambah, termasuk dikalangan lulusan universiti.

ENG VERSION
NAJIB’S BRIEFING

1. Najib claimed that the reason I do not support him is because I do not get what I asked for.

2. For my own self there is nothing that I asked for. I also refused Government’s offer of free land in Putrajaya at the time I resigned, just as offered to other former Prime Ministers. I offered to buy the land in Putrajaya and I paid a million for a piece. This money is from my savings fund after 29 years in government. No loan.

3. Gifts given to me while in Government I returned to the Government. All these can be seen at Galeria Langkawi and the old Prime Minister’s residence in Jalan Terengganu, off Jalan Damansara.

4. All that I ask from Najib is for the nation and for the people. All were rejected but in the GE13 I still supported Najib. Although I said Najib must resign if his achievement in the 13th General Election is worse that Abdullah in the 12th General Election, and indeed he fared worse than Abdullah despite victory in the 13th General Election, I still supported him as prime minister.

5. Only when the secret debts and losses of 1MDB were uncovered that I pulled back my support for Najib.

6. If it is just because the bridge was not built, I would have long ceased to support him. If it is just because the electrified double track from Johor Bahru to Padang Besar was not built, I would have long ceased my support to Najib. It is not merely because he did not entertain requests for the nation that I withdrew my support for Najib.

7. Najib used to come to see me to ask me what I wanted. I thought he was sincere, and I mentioned several development projects for the nation. Then I realized he was trying to bribe me this way so that I do not bring up the question of 1MDB.

8. But the loss of Government fund is too big. By just being entertained is no excuse for me to close my eyes on the loss of billions of Government money. So I kept on raising the question of 1MDB. What more, when 2.6 billion Ringgit suddenly appeared in the personal account of Najib.

9. Never in the history of independent Malaysia, has the Prime Minister of Malaysia so much money. For whatever purpose the Prime Minister should not have 2.6 billion Ringgit.

10. What is clear is that even without so much money, BN and UMNO has won so many times better than Najib in 13th General Election. It is not money that brought victory. It is service to the people and sincerity of intentions that gave victory to the party.

11. Apparently the money was donated by donors who do not like to be identified. They were not prepared to give direct to UMNO but as a “leader” they are prepared to pay just to Najib as a leader for him to keep in a personal account. This makes no sense at all unless there is an intention to not explain where the money came from, to conceal expenses.

12. An allegation was made that the Bank knew. If Bank Negara knew what is the evidence. Why was the report of Bank Negara rejected by AG. Was it because AG did not believe Bank Negara whereas we are required to believe Bank Negara in respect of something mentioned only by Najib, but not by Bank Negara.

13. It will more convincing if the report of the National Bank be exposed rather than only Najib saying Bank Negara knew. Any money of 50 million and more deposited into any bank must obtain the approval of Bank Negara. Just show documentary evidence of the approval by Bank Negara of the RM2.6 billion and Najib will be believed.

14. Attempts were made to discredit me by saying I also lost Government money because of actions and money losing investments. Najib himself admitted that in business sometimes there are profits and sometimes losses. The key is everything must be accounted for in a transparent and in an open manner. And all transactions are done by responsible Government officers. I was not involved in management particularly management of capital funds. My job ends with approval of the investment. I am not a manager or executive advisor.

15. On the other hand Najib established 1MDB financed only 1 million by the Government. He also became adviser to 1MDB.

16. 1MDB borrowed RM42 billion which is 42,000 times larger than the capital. Money was borrowed at very high interest and commission to Golden Sachs stood at 10%.

17. This money was used to buy power stations which were obsolete and with almost expired license at a price higher than the market price. Debts of RM 8 billion were assumed and total debts now stood at RM50 billion.

18. The stations were merged into Edra. But the returns are so low that it cannot pay interest and had to be sold. It could not be listed because its accounts cannot be verified by the auditors. It had to be sold to a company from China as TNB could not pay a price that can resolve the debt of RM18 billion.

19. The balance of the borrowings were used to buy government land at a greatly reduced price of RM60 psf, while adjacent lands sold for RM7,000 psf. The purchase price of the airport land is not mentioned.

20. The land occupied by squatters was bought in Penang at a very high price. Difficult to develop.

21. An attempt was made to sell the land at Jalan Tun Razak purchased at the price of RM60 psf from the Government to Tabung Haji at RM3,000 psf (50 times the purchase price). Should the Government lose RM2,940 psf. Is this 1MDB strategic business?

22. Did I do things like this? Prove. Not just wild accusations.

23. It seemed that the economy is not in a bad state.

24. The fact is, the value of the Ringgit and share prices has fallen drastically. The cost of living rose with GST, fuel subsidies reduced, tolls and fares increased, etc.

25. Income increased but purchasing power decreased because the value of Ringgit fell. Unemployment is increasing, including among university graduates. Business and industry face insurmountable problems.

26. Am I damaging the country’s image?

27. The world press have reported much earlier about Jho Low and his friendship with Najib, his way of life and luxury house purchases, his financing of the film “Wolf of Wall Street” with Najib’s stepson, than the mention of 1MDB by me. All these are demonizing the country. It is made worse by reports of 1MDB investments, and then the RM2.6 billion money in Najib’s personal account.

28. If there is anyone who is damaging the image of the nation, it must be Dato Sri Najib himself. Before this the image of the country has been good.

29. If what Najib have been accused of is just slander, Najib must prove they are not true. Najib should even sue the newspapers that reported. Although it seems action will be taken there has been none, other than frightening those who make complaints or report to the police with threats of being interrogated by the police, put into custody and brought before the court. It has never happened anywhere where people reporting crimes to the police are being accused of sabotaging democracy or attempting to overthrow the Government. Also lawyers of complainants are questioned by police and taken into custody.

30. The ordinary people may not be bothered. The reason may be because the press are not allowed to report. But just because ordinary people do not care, cheating and criminal actions still should not be legitimized.
